Nad 61-godišnjakom koji se sumnjiči za niz kaznenih djela gospodarskog kriminaliteta dovršeno je krim istraživanje o svim nedjelima koje je uspio provesti: utaju poreza ili carine, pomaganje u svezi kaznenog djela utaje poreza ili carine, povredu obveza vođenja trgovačkih ili poslovnih knjiga, krivotvorenje službene ili poslovne isprave, pogodovanje vjerovnika i povredu dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje, javljaju iz PU Dubrovačko-neretvanske.

Osmislio je poreznu prijevaru, proveo je preko trgovačkog društva iz Metkovića u kojemu je on odgovorna osoba i triju vlasnički povezanih društava. Sve s ciljem izvući novce iz državnog proračuna preko Porezne uprave i to tako da je koristio pretporez PDV-a.

Osumnjičeni je od početka 2021. do kraja 2022. g. izdavao neistinite i nepotpune ulazne račune od vlasnički povezanih trgovačkih društava koji uopće ne obavljaju gospodarsku djelatnost te trgovačkih društava iz inozemstva, pa zatim nabavljao razne robe, pa ulaznim računima omogućio da trgovačko društvo u kojem je on odgovorna osoba  u mjesečnim prijavama PDV-a neosnovano umanji svoju poreznu obvezu u ukupnom iznosu od 6.065,58 eura. Za istu robu je potom ispostavljao nevjerodostojne izlazne račune prema vlasnički povezanim trgovačkim društvima s uračunatom nerealno visokom maržom, a sve u cilju izvlačenja pretporeza PDV-a iz Državnog proračuna od strane spomenutih društava u ukupnom iznosu od 14.069,48 eura.

61-godišnjak je svoje poslovne knjige trgovačkog društva vodio tako da je bilo teško utvrditi imovinu društva, a za vrijeme blokade računa društva omogućio je jednoj od vlasnički povezanih tvrtki naplatu nepostojećeg potraživanja od 8.643,43 eura. Time je oštetio druge vjerovnike društva počinivši kazneno djelo pogodovanje vjerovnika. I njegovim financijskim malverzacijama tu nije kraj, osumnjičen je i za kazneno djelo povrede dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje iz Zakona o trgovačkim društvima. Znajući da je društvo nesposobno za plaćanje zbog neizvršenih osnova za plaćanje u razdoblju dužem od 60 dana te da je račun društva u neprekidnoj blokadi od ožujka 2022. g., protivno Stečajnom zakonu, nije podnio prijedlog za otvaranje stečajnog postupka nad trgovačkim društvom. U svemu ovome uzeo je 28.778,49 eura. Protiv osumnjičenog slijedi kaznena prijava nadležnom državnom odvjetništvu u Metkoviću.

Nad 61-godišnjakom koji se sumnjiči za niz kaznenih djela gospodarskog kriminaliteta dovršeno je krim istraživanje o svim nedjelima koje je uspio provesti: utaju poreza ili carine, pomaganje u svezi kaznenog djela utaje poreza ili carine, povredu obveza vođenja trgovačkih ili poslovnih knjiga, krivotvorenje službene ili poslovne isprave, pogodovanje vjerovnika i povredu dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje, javljaju iz PU Dubrovačko-neretvanske.

Osmislio je poreznu prijevaru, proveo je preko trgovačkog društva iz Metkovića u kojemu je on odgovorna osoba i triju vlasnički povezanih društava. Sve s ciljem izvući novce iz državnog proračuna preko Porezne uprave i to tako da je koristio pretporez PDV-a.

Osumnjičeni je od početka 2021. do kraja 2022. g. izdavao neistinite i nepotpune ulazne račune od vlasnički povezanih trgovačkih društava koji uopće ne obavljaju gospodarsku djelatnost te trgovačkih društava iz inozemstva, pa zatim nabavljao razne robe, pa ulaznim računima omogućio da trgovačko društvo u kojem je on odgovorna osoba  u mjesečnim prijavama PDV-a neosnovano umanji svoju poreznu obvezu u ukupnom iznosu od 6.065,58 eura. Za istu robu je potom ispostavljao nevjerodostojne izlazne račune prema vlasnički povezanim trgovačkim društvima s uračunatom nerealno visokom maržom, a sve u cilju izvlačenja pretporeza PDV-a iz Državnog proračuna od strane spomenutih društava u ukupnom iznosu od 14.069,48 eura.

61-godišnjak je svoje poslovne knjige trgovačkog društva vodio tako da je bilo teško utvrditi imovinu društva, a za vrijeme blokade računa društva omogućio je jednoj od vlasnički povezanih tvrtki naplatu nepostojećeg potraživanja od 8.643,43 eura. Time je oštetio druge vjerovnike društva počinivši kazneno djelo pogodovanje vjerovnika. I njegovim financijskim malverzacijama tu nije kraj, osumnjičen je i za kazneno djelo povrede dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje iz Zakona o trgovačkim društvima. Znajući da je društvo nesposobno za plaćanje zbog neizvršenih osnova za plaćanje u razdoblju dužem od 60 dana te da je račun društva u neprekidnoj blokadi od ožujka 2022. g., protivno Stečajnom zakonu, nije podnio prijedlog za otvaranje stečajnog postupka nad trgovačkim društvom. U svemu ovome uzeo je 28.778,49 eura. Protiv osumnjičenog slijedi kaznena prijava nadležnom državnom odvjetništvu u Metkoviću.
