U jedno predvečerje ove zime panulom sam lovio lignje, prilično udaljen od obale, i u nekom trenutku, dosta po krmi, primijetio sam kolegu kako plovi prema nešto daljoj pošti. Nešto kasnije, prateći dubinu, u jednom sam se trenutku okrenuo udesno i ugledao ga kako ide ravno na mene. On je odmah reagirao, okrenuo je udesno i tako u zadnji čas izbjegao sudar. Poslije u lučici nikako se nismo mogli usuglasiti tko je bio u pravu. On tvrdi da je imao prednost jer je meni prilazio s desne strane, a ja smatram da je u svakom slučaju morao izbjegavati moje plovilo koje je ribarilo. Tko je u pravu?

Kratko – ni jedan ni drugi. Premda ste bili u ribolovu, vaše plovilo nije ono koje ribari. Pravilnik o izbjegavanju sudara na moru u članku 3. stavak 4. jasno navodi na koja se plovila to odnosi, pa kaže: Izraz 'brod koji riba' označuje svaki brod na ribanju pomoću mreža, povraza, potegača (koča) ili drugog ribarskog pribora što ograničuje mogućnost manevriranja, ali ne uključuje brod koji riba povlačnim povrazima ili kojim drugim ribarskim priborom što ne ograničuje mogućnost manevriranja.

Alat u moru

Dakle, prednost koja se daje plovilu koje ribari nije radi toga da ga se ne ometa u ribolovu, nego radi arti, ribolovnog alata koje u tom trenutku koristi, a koji mu ograničavaju mogućnost manevriranja.

Inače, kod određivanja prava puta, prednosti, istim je Pravilnikom ustanovljena hijerarhija:

1. Brod koji ne može manevrirati
2. Brod ograničene sposobnosti manevriranja
3. Brod koji riba
4. Jedrenjak, jedrilica dok plovi na jedra
5. Brod na mehanički pogon,

prema kojoj brod iz niže navedene skupine ustupa put brodu iz ranije navedene skupine, izbjegava ga. Kako bi se izbjegla svaka nedoumica, Pravilnik definira i riječ brod, koja označava svaku vrstu plovila koje se upotrebljava ili se može upotrebljavati kao prijevozno sredstvo na vodi.

U vašoj situaciji oboje ste u istoj skupini plovila, brod na mehanički pogon, pa se članak 18. ovog Pravilnika, na koji se vi pozivate, ovdje ne može primijeniti.

Međutim, ni vaš kolega nije u pravu kada tvrdi da je on imao prednost jer je prilazio s desne strane, premda je neposredno prije potencijalnog sudara bio u toj poziciji.

Križanje i pretjecanje

​Ovdje se ne radi o križanju kursova, nego o klasičnom pretjecanju, za koje Pravilnik u članku 13. stavak 2. jasno navodi:

Držat će se da brod pretječe kad se približuje drugome brodu iz smjera većega od 22,50 iza subočice prema krmi toga broda, tj. da je u takvu položaju prema brodu kojega pretječe da bi mu noću mogao vidjeti samo krmeno svjetlo, a da mu ne vidi nijedno od bočnih svjetala. Isti članak u stavku 4., koji glasi: Svaka iduća promjena smjera između dvaju brodova ne može učiniti da se brod koji pretječe drži brodom koji presijeca kurs onome drugom, prema ovom pravilniku, i ne može ga se osloboditi dužnosti da se ukloni s puta dostignutome brodu, sve dok ga konačno ne prijeđe i dok se ne udalji, jasno objašnjava i vašu situaciju.

Dakle, ako vas je i izbjegavao, on se nije uklonio dovoljno daleko, međutim, dio odgovornosti je i na vama. Naime, isti Pravilnik obavezuje vas da kao plovilo kojem se ustupa pravo puta morate zadržati nepromijenjen kurs i brzinu.

U jedno predvečerje ove zime panulom sam lovio lignje, prilično udaljen od obale, i u nekom trenutku, dosta po krmi, primijetio sam kolegu kako plovi prema nešto daljoj pošti. Nešto kasnije, prateći dubinu, u jednom sam se trenutku okrenuo udesno i ugledao ga kako ide ravno na mene. On je odmah reagirao, okrenuo je udesno i tako u zadnji čas izbjegao sudar. Poslije u lučici nikako se nismo mogli usuglasiti tko je bio u pravu. On tvrdi da je imao prednost jer je meni prilazio s desne strane, a ja smatram da je u svakom slučaju morao izbjegavati moje plovilo koje je ribarilo. Tko je u pravu?

Kratko – ni jedan ni drugi. Premda ste bili u ribolovu, vaše plovilo nije ono koje ribari. Pravilnik o izbjegavanju sudara na moru u članku 3. stavak 4. jasno navodi na koja se plovila to odnosi, pa kaže: Izraz 'brod koji riba' označuje svaki brod na ribanju pomoću mreža, povraza, potegača (koča) ili drugog ribarskog pribora što ograničuje mogućnost manevriranja, ali ne uključuje brod koji riba povlačnim povrazima ili kojim drugim ribarskim priborom što ne ograničuje mogućnost manevriranja.

Alat u moru

Dakle, prednost koja se daje plovilu koje ribari nije radi toga da ga se ne ometa u ribolovu, nego radi arti, ribolovnog alata koje u tom trenutku koristi, a koji mu ograničavaju mogućnost manevriranja.

Inače, kod određivanja prava puta, prednosti, istim je Pravilnikom ustanovljena hijerarhija:

1. Brod koji ne može manevrirati
2. Brod ograničene sposobnosti manevriranja
3. Brod koji riba
4. Jedrenjak, jedrilica dok plovi na jedra
5. Brod na mehanički pogon,

prema kojoj brod iz niže navedene skupine ustupa put brodu iz ranije navedene skupine, izbjegava ga. Kako bi se izbjegla svaka nedoumica, Pravilnik definira i riječ brod, koja označava svaku vrstu plovila koje se upotrebljava ili se može upotrebljavati kao prijevozno sredstvo na vodi.

U vašoj situaciji oboje ste u istoj skupini plovila, brod na mehanički pogon, pa se članak 18. ovog Pravilnika, na koji se vi pozivate, ovdje ne može primijeniti.

Međutim, ni vaš kolega nije u pravu kada tvrdi da je on imao prednost jer je prilazio s desne strane, premda je neposredno prije potencijalnog sudara bio u toj poziciji.

Križanje i pretjecanje

​Ovdje se ne radi o križanju kursova, nego o klasičnom pretjecanju, za koje Pravilnik u članku 13. stavak 2. jasno navodi:

Držat će se da brod pretječe kad se približuje drugome brodu iz smjera većega od 22,50 iza subočice prema krmi toga broda, tj. da je u takvu položaju prema brodu kojega pretječe da bi mu noću mogao vidjeti samo krmeno svjetlo, a da mu ne vidi nijedno od bočnih svjetala. Isti članak u stavku 4., koji glasi: Svaka iduća promjena smjera između dvaju brodova ne može učiniti da se brod koji pretječe drži brodom koji presijeca kurs onome drugom, prema ovom pravilniku, i ne može ga se osloboditi dužnosti da se ukloni s puta dostignutome brodu, sve dok ga konačno ne prijeđe i dok se ne udalji, jasno objašnjava i vašu situaciju.

Dakle, ako vas je i izbjegavao, on se nije uklonio dovoljno daleko, međutim, dio odgovornosti je i na vama. Naime, isti Pravilnik obavezuje vas da kao plovilo kojem se ustupa pravo puta morate zadržati nepromijenjen kurs i brzinu.
