Saborski zastupnici pozdravili su u srijedu Vladinu nakanu da zaštiti građane koji se ne mogu brinuti za sebe pa sklapaju ugovore o dosmrtnom ili doživotnom uzdržavanju i često ostaju i bez imovine i skrbi, a neki drže da ugovore o dosmrtnom uzdržavanju treba ukinuti.
"Predatori kruže oko starijih za koje znaju da imaju vrijedne pokretnine i nekretnine, a stariji toga često nisu pošteđeni ni u domovima za starije“, upozorila je Vesna Nađ (SD) u raspravi o izmjenama zakona o obveznim odnosima i o parničnom postupku.
Tim se izmjenama, među inim, uvodi Registar ugovora o doživotnom i dosmrtnom uzdržavanju u koji će se unositi podaci o sklopljenim i raskinutim ugovorima te postupcima koji se pokreću radi utvrđenja ništetnosti, poništenja ili raskida ugovora.
Registar, koji će se voditi pri Hrvatskoj javnobilježničkoj komori omogućit će provjeru jesu li ugovaratelji uzdržavanja već sklopili ugovore i koliko, a broj takvih ugovora ograničava se na najviše tri.
HDZ drži da te promjene unapređuju sustav, da su dobar temelj, ali da zakon može biti još bolji.
Možda bi bilo dobro da predstavnik centra za socijalnu skrb bude nazočan kad se potpisuje ugovor o dosmrtnom i doživotnom uzdržavanju i kad ih netko objašnjava, kazao je Dražen Bošnjaković.
Smatra i kako je, umjesto odredbe da su postupci radi raskida i poništenja ugovora, hitni, bolje odrediti okvirni rok za njihovo trajanje.
Zastupnici su apostrofirali podatke da je u 2021. bilo sklopljeno više od 7500 ugovora o dosmrtnom i doživotnom uzdržavanju, te da 63 posto osoba koje su ih sklopile ne razumiju njihove posljedice.
Hrelja: Napravili bi dobar posao ukidanjem ugovora o dosmrtnom uzdržavanju
Posebno problematičnim drže ugovore o dosmrtnom uzdržavanju kod kojih imovina odmah prelazi u vlasništvo uzdržavatelja.
Ukidanjem tog ugovora napravili bi dobar posao, jer to je duboko nemoralan ugovor, ističe Silvano Hrelja (NZ).
Treba li nam takav tip ugovora, ili ga možemo izbaciti, pita se i Urša Raukar Gamulin (Možemo!) i upozorava kako su zbog ugovora o dosmrtnom uzdržavanju starije osobe završavale na ulici, te kako je to "eklatantan lešinarski biznis".
Na istom je tragu i razmišljanje Željka Sačića (HS) koji se pita što je država do sada čekala da uredi to područje. Predlaže i da se "prisili" centre za socijalnu skrb da sudjeluju u procesu sklapanja ugovora kao kontrolni čimbenik kako se ne bi dogodilo da stariji građani padnu pod utjecaj "hinjene brige onih koji im zapravo žele naštetiti".
Dalija Orešković (Centar) predlaže da se građanima prije sklapanja ugovora omogući obavezno pravno savjetovanje i da im se objasni što će im donijeti jedan, a što drugi ugovor, te da se institucijama, npr. centrima za socijalnu skrb, uvede obveza da periodično provjere kako žive oni koji su ugovore sklopili.
Ne slaže se zastupnicima koji o davateljima uzdržavanja govore kao o predatorima, te ističe da je predator država koja se nije na vrijeme pobrinula što će biti sa starijima kad se za sebe ne mogu skrbiti.
Martina Vlašić Iljkić (SDP) smatra pak da treba uvesti obvezu da se kod sklapanja ugovora prilože potvrde o zdravstvenog sposobnosti osobe koja ga sklapa te da je osoba prošla savjetovanje i razumije što potpisuje.

Saborski zastupnici pozdravili su u srijedu Vladinu nakanu da zaštiti građane koji se ne mogu brinuti za sebe pa sklapaju ugovore o dosmrtnom ili doživotnom uzdržavanju i često ostaju i bez imovine i skrbi, a neki drže da ugovore o dosmrtnom uzdržavanju treba ukinuti.
"Predatori kruže oko starijih za koje znaju da imaju vrijedne pokretnine i nekretnine, a stariji toga često nisu pošteđeni ni u domovima za starije“, upozorila je Vesna Nađ (SD) u raspravi o izmjenama zakona o obveznim odnosima i o parničnom postupku.
Tim se izmjenama, među inim, uvodi Registar ugovora o doživotnom i dosmrtnom uzdržavanju u koji će se unositi podaci o sklopljenim i raskinutim ugovorima te postupcima koji se pokreću radi utvrđenja ništetnosti, poništenja ili raskida ugovora.
Registar, koji će se voditi pri Hrvatskoj javnobilježničkoj komori omogućit će provjeru jesu li ugovaratelji uzdržavanja već sklopili ugovore i koliko, a broj takvih ugovora ograničava se na najviše tri.
HDZ drži da te promjene unapređuju sustav, da su dobar temelj, ali da zakon može biti još bolji.
Možda bi bilo dobro da predstavnik centra za socijalnu skrb bude nazočan kad se potpisuje ugovor o dosmrtnom i doživotnom uzdržavanju i kad ih netko objašnjava, kazao je Dražen Bošnjaković.
Smatra i kako je, umjesto odredbe da su postupci radi raskida i poništenja ugovora, hitni, bolje odrediti okvirni rok za njihovo trajanje.
Zastupnici su apostrofirali podatke da je u 2021. bilo sklopljeno više od 7500 ugovora o dosmrtnom i doživotnom uzdržavanju, te da 63 posto osoba koje su ih sklopile ne razumiju njihove posljedice.
Hrelja: Napravili bi dobar posao ukidanjem ugovora o dosmrtnom uzdržavanju
Posebno problematičnim drže ugovore o dosmrtnom uzdržavanju kod kojih imovina odmah prelazi u vlasništvo uzdržavatelja.
Ukidanjem tog ugovora napravili bi dobar posao, jer to je duboko nemoralan ugovor, ističe Silvano Hrelja (NZ).
Treba li nam takav tip ugovora, ili ga možemo izbaciti, pita se i Urša Raukar Gamulin (Možemo!) i upozorava kako su zbog ugovora o dosmrtnom uzdržavanju starije osobe završavale na ulici, te kako je to "eklatantan lešinarski biznis".
Na istom je tragu i razmišljanje Željka Sačića (HS) koji se pita što je država do sada čekala da uredi to područje. Predlaže i da se "prisili" centre za socijalnu skrb da sudjeluju u procesu sklapanja ugovora kao kontrolni čimbenik kako se ne bi dogodilo da stariji građani padnu pod utjecaj "hinjene brige onih koji im zapravo žele naštetiti".
Dalija Orešković (Centar) predlaže da se građanima prije sklapanja ugovora omogući obavezno pravno savjetovanje i da im se objasni što će im donijeti jedan, a što drugi ugovor, te da se institucijama, npr. centrima za socijalnu skrb, uvede obveza da periodično provjere kako žive oni koji su ugovore sklopili.
Ne slaže se zastupnicima koji o davateljima uzdržavanja govore kao o predatorima, te ističe da je predator država koja se nije na vrijeme pobrinula što će biti sa starijima kad se za sebe ne mogu skrbiti.
Martina Vlašić Iljkić (SDP) smatra pak da treba uvesti obvezu da se kod sklapanja ugovora prilože potvrde o zdravstvenog sposobnosti osobe koja ga sklapa te da je osoba prošla savjetovanje i razumije što potpisuje.
