- Za vrijeme boravka u zatvoru u Splitu u kojem je bio 73 dana Kristian se nikada nije žalio da je maltretiran. Imao je daleko najbolji tretman od svih zatvorenika. Uvažavali smo njegovu mladost i bolest. Dan prije nego je smješten u bolnicu imao je zdravstveni pregled na inicijativu naše liječnice, a ona je zaključila da je smiren, staložen i zadovoljan. Liječnica mi je, nakon što se dogodilo to što se dogodilo, rekla da je to što se dogodilo bilo izuzetno teško u smislu liječenja. Usporedila je to s nogometašem koji umire na terenu za vrijeme utakmice - rekao je u srijedu na Općinskom sudu u Zadru Marinko Bujas koji je bio Upravitelj Zatvora u Splituu vrijeme smrti Kristijana Vukasovića iz Jesenica kraj Omiša, mladića koji je u kolovozu 2019. godine umro u splitskoj bolnici nakon što je u komatoznom stanju doveden iz zatvorske ćelije.

Bujas, koji se jedini od ukupno troje pozvanih svjedoka odazvao pozivu na ročište u nastavku postupka u kojem Kristijanovi roditelji traže naknadu štete od države zbog njegove smrti, opovrgnuo je moguću krivnju sustava za mladićevu smrt.

- Zabilježen je jedan verbalni sukob sa zatvorenikom u vezi Cedevite. Pravosudni policajci koji su razgovarali s njim zaključili su da je riječ o bezazlenoj prepirci. Kristian je bio specifičan zatvorenik. Nije bio zločest, ali nije bilo lako s njim boraviti u istoj sobi, niti njemu s drugima. U 73 dana promijenio je pet do šest ćelija i davdesetak cimera. Nakon incidenta u kojem je zapalio madrac u zatvorskoj bolnici, nije smio imati upaljač sa sobom iako je bio pušač. Kad bi imao potrebu zapaliti, pravosudni policjaci bi ga izveli van i sjeli bi s njim i razgovarali dok bi zapalio. Bio je hospitaliziran u tri navrata zbog anksioznosti, depresije i površinskog samoozlijeđivanja, što je bio njegov način da ukaže na probleme koje je imao. U 73 dana koliko je bio u zatvoru, 18 puta ga je pregledala liječnica, i to četiri puta je on tražio pregled, a 14 ona, jer se htjela uvjeriti u kakvom se stanju nalazi - rekao je Bujas.

U srijedu je trebala svjedočiti i zatvorska liječnica, te dvoje 'cimera' iz Vukasovićeve ćelije. Liječnica I jedan od Vukasovićevih 'cimera? Opravdali su svoj izostanak, dok je drugom 'cimeru'dostava poziva nije bila uredana. Vukasović je bio dijete s razvojnim poteškoćama i s nizom poremećaja među kojima i ADHD uz mentalna i tjelesna oštećenja. Dok je izdržavao kaznu, Krstian bio je u teškom psihičkom stanju zbog čega je u tri navrata prebačen u zagrebačku zatvorsku bolnicu. Unatoč tome vraćen je u ćeliju gdje mu se stanje pogoršalo, pa je prebačen u KBC Split.

Bujasov iskaz Vinko Ljubičić, odvjetnik Kristianove obitelji, nazvao je 'obranaškim nastupanjem' koje u ovom postupku ne može biti odlučujuće.

- Bujas je iskazivao naučeno. Služio se nekakvim brojkama koje je Ministarstvo utvrdilo u nadzoru. Smiješno je kada kaže da je Kristian imao dobar tretman, a iz zatvora u koji je ušao relativno zdrav izašao je mrtav- rekao je Ljubičić. Naglasio je kako mu se I dalje uporno odbija dostaviti dokumentacija i podaci koje je tražio od zatvorskog sustava.

Zaključujem da se odgovorna tijela državne uprave, ovdje pokušavaju izvući od odgovornosti. Znalo se da se radi o djetetu s posebnim potrebama, a niti je liječen niti tretiran na način na koji je to propisano. Fizičkog maltetriranja je neprijeporno bilo, jer je na tijelu pronađeno više modrica i ozlijeda koje su bile vidljive prostim okom – rekao je odvjetnik.

Uprava za zatvorski sustav i probaciju, međutim, nije našla propust u radu djelatnika zatvorskog sustava u odnosu na njegovu smrt, niti je DORH utvrdio vezu između postupanja nadležnih tijela i Vukasovićeve smrti. Iako je obdukcijom utvrđeno da je umro prirodnom smrću obitelj smatra da je neprikladan tretman od dana uhićenja zbog nekoliko požara kraj njegove obiteljske kuće, te tijekom četiri mjeseca u istražnom zatvoru doveo do moždane kome njihovog sina u ćeliji Zatvora u Splitu odakle je prebačen u KBC Split. Odvjetnik Ljubičić koji zastupa roditelje za svakog roditelja traži po 300.000 kuna na ime duševnih boli zbog smrti bliske osobe. Obitelj smatra da je smrt pokojnog Kristijana uzrokovana propustom u sustavu tretiranja i liječenja tijekom pravosudnih postupaka, osobito prilikom izdržavanja istražnog zatvora, a najviše imajući u vidu način na koji je Kristijan liječen.

Iduće ročište zakazano je za 9. lipnja.

- Za vrijeme boravka u zatvoru u Splitu u kojem je bio 73 dana Kristian se nikada nije žalio da je maltretiran. Imao je daleko najbolji tretman od svih zatvorenika. Uvažavali smo njegovu mladost i bolest. Dan prije nego je smješten u bolnicu imao je zdravstveni pregled na inicijativu naše liječnice, a ona je zaključila da je smiren, staložen i zadovoljan. Liječnica mi je, nakon što se dogodilo to što se dogodilo, rekla da je to što se dogodilo bilo izuzetno teško u smislu liječenja. Usporedila je to s nogometašem koji umire na terenu za vrijeme utakmice - rekao je u srijedu na Općinskom sudu u Zadru Marinko Bujas koji je bio Upravitelj Zatvora u Splituu vrijeme smrti Kristijana Vukasovića iz Jesenica kraj Omiša, mladića koji je u kolovozu 2019. godine umro u splitskoj bolnici nakon što je u komatoznom stanju doveden iz zatvorske ćelije.

Bujas, koji se jedini od ukupno troje pozvanih svjedoka odazvao pozivu na ročište u nastavku postupka u kojem Kristijanovi roditelji traže naknadu štete od države zbog njegove smrti, opovrgnuo je moguću krivnju sustava za mladićevu smrt.

- Zabilježen je jedan verbalni sukob sa zatvorenikom u vezi Cedevite. Pravosudni policajci koji su razgovarali s njim zaključili su da je riječ o bezazlenoj prepirci. Kristian je bio specifičan zatvorenik. Nije bio zločest, ali nije bilo lako s njim boraviti u istoj sobi, niti njemu s drugima. U 73 dana promijenio je pet do šest ćelija i davdesetak cimera. Nakon incidenta u kojem je zapalio madrac u zatvorskoj bolnici, nije smio imati upaljač sa sobom iako je bio pušač. Kad bi imao potrebu zapaliti, pravosudni policjaci bi ga izveli van i sjeli bi s njim i razgovarali dok bi zapalio. Bio je hospitaliziran u tri navrata zbog anksioznosti, depresije i površinskog samoozlijeđivanja, što je bio njegov način da ukaže na probleme koje je imao. U 73 dana koliko je bio u zatvoru, 18 puta ga je pregledala liječnica, i to četiri puta je on tražio pregled, a 14 ona, jer se htjela uvjeriti u kakvom se stanju nalazi - rekao je Bujas.

U srijedu je trebala svjedočiti i zatvorska liječnica, te dvoje 'cimera' iz Vukasovićeve ćelije. Liječnica I jedan od Vukasovićevih 'cimera? Opravdali su svoj izostanak, dok je drugom 'cimeru'dostava poziva nije bila uredana. Vukasović je bio dijete s razvojnim poteškoćama i s nizom poremećaja među kojima i ADHD uz mentalna i tjelesna oštećenja. Dok je izdržavao kaznu, Krstian bio je u teškom psihičkom stanju zbog čega je u tri navrata prebačen u zagrebačku zatvorsku bolnicu. Unatoč tome vraćen je u ćeliju gdje mu se stanje pogoršalo, pa je prebačen u KBC Split.

Bujasov iskaz Vinko Ljubičić, odvjetnik Kristianove obitelji, nazvao je 'obranaškim nastupanjem' koje u ovom postupku ne može biti odlučujuće.

- Bujas je iskazivao naučeno. Služio se nekakvim brojkama koje je Ministarstvo utvrdilo u nadzoru. Smiješno je kada kaže da je Kristian imao dobar tretman, a iz zatvora u koji je ušao relativno zdrav izašao je mrtav- rekao je Ljubičić. Naglasio je kako mu se I dalje uporno odbija dostaviti dokumentacija i podaci koje je tražio od zatvorskog sustava.

Zaključujem da se odgovorna tijela državne uprave, ovdje pokušavaju izvući od odgovornosti. Znalo se da se radi o djetetu s posebnim potrebama, a niti je liječen niti tretiran na način na koji je to propisano. Fizičkog maltetriranja je neprijeporno bilo, jer je na tijelu pronađeno više modrica i ozlijeda koje su bile vidljive prostim okom – rekao je odvjetnik.

Uprava za zatvorski sustav i probaciju, međutim, nije našla propust u radu djelatnika zatvorskog sustava u odnosu na njegovu smrt, niti je DORH utvrdio vezu između postupanja nadležnih tijela i Vukasovićeve smrti. Iako je obdukcijom utvrđeno da je umro prirodnom smrću obitelj smatra da je neprikladan tretman od dana uhićenja zbog nekoliko požara kraj njegove obiteljske kuće, te tijekom četiri mjeseca u istražnom zatvoru doveo do moždane kome njihovog sina u ćeliji Zatvora u Splitu odakle je prebačen u KBC Split. Odvjetnik Ljubičić koji zastupa roditelje za svakog roditelja traži po 300.000 kuna na ime duševnih boli zbog smrti bliske osobe. Obitelj smatra da je smrt pokojnog Kristijana uzrokovana propustom u sustavu tretiranja i liječenja tijekom pravosudnih postupaka, osobito prilikom izdržavanja istražnog zatvora, a najviše imajući u vidu način na koji je Kristijan liječen.

Iduće ročište zakazano je za 9. lipnja.
