Visoki kazneni sud Republike Hrvatske odbio je žalbu 28-godišnjaka iz Selina i potvrdio prvostupanjsku presudu Županijskog suda u Zadru kojom je utvrđeno da je počinio teško ubojstvo i ubojstvo u pokušaju.
U obiteljskoj kući u mjestu Seline, 24. srpnja 2022., godine oko 21 sat u neubrojivom je stanju, bez ikakvog povoda, nožem zadao 61-godišnjem ocu ozljede uslijed kojih je on iskrvario i preminuo. Potom je nožem uboo i majku, te joj nanio laku tjelesnu ozljedu nakon koje je ona uspjela pobjeći iz kuće.
- Prvostupanjski sud je pravilno utvrdio da optuženik u stanju neubrojivosti usmrtio svojeg oca i pokušao usmrtiti svoju majku, koja ga je pokušala spriječiti u napadu na oca kojem je zadao 26 ubodno-reznih rana među kojima i rasjeklinu desne karotidne arterije na vratu. Protivno tvrdnjama optuženika, prvostupanjski sud je pravilno primijenio odredbe Zakona o kaznenom postupku te je na tako pravilno utvrđeno činjenično stanje pravilno primijenio odredbe kaznenog zakona.
Optuženiku je izrečen prisilni smještaj u psihijatrijsku ustanovu u trajanju šest mjeseci. Daljnje postupanje provodi se prema odredbama Zakona o zaštiti osoba s duševnim smetnjama - navodi se u obrazloženju Visokog kaznenog suda RH koji je odbio žalbu osuđenika.
Preko svoje odvjetnice žalio se zbog bitne povrede odredaba kaznenog postupka, pogrešno i nepotpuno utvrđenog činjeničnog stanja i povrede kaznenog zakona s prijedlogom da Visoki kazneni sud Republike Hrvatske ukine pobijanu presudu i predmet vrati na ponovno odlučivanje sudu prvog stupnja a podredno da preinači pobijanu presudu u skladu s zakonom.
U žalbi je istaknuto da je počinjena bitna povreda odredaba kaznenog postupkau odnosu na način napada optuženika na majku, te postojanje namjere optuženika i uporabu sile,
Naime, optuženik smatra da je njegovo djelovanje bilo usmjereno prema ocu, te da nije postojala namjera da ubije majku jer je za to imao, da je to htio, dostatno snage i energije, a što je vidljivo iz brojnosti intenziteta uboda koje je zadao ocu.
Ukazuje da je njegova namjera bila ‘otkloniti od sebe‘ majku i spriječiti je da ‘ona njega spriječi da ubije oca‘.
Visko kazneni sud je odbacio žalbu utvrdivši kako pitanje motiva postupanja optuženika prema majci u konkretnom slučaju nije od relevantnog značaja.

Visoki kazneni sud Republike Hrvatske odbio je žalbu 28-godišnjaka iz Selina i potvrdio prvostupanjsku presudu Županijskog suda u Zadru kojom je utvrđeno da je počinio teško ubojstvo i ubojstvo u pokušaju.
U obiteljskoj kući u mjestu Seline, 24. srpnja 2022., godine oko 21 sat u neubrojivom je stanju, bez ikakvog povoda, nožem zadao 61-godišnjem ocu ozljede uslijed kojih je on iskrvario i preminuo. Potom je nožem uboo i majku, te joj nanio laku tjelesnu ozljedu nakon koje je ona uspjela pobjeći iz kuće.
- Prvostupanjski sud je pravilno utvrdio da optuženik u stanju neubrojivosti usmrtio svojeg oca i pokušao usmrtiti svoju majku, koja ga je pokušala spriječiti u napadu na oca kojem je zadao 26 ubodno-reznih rana među kojima i rasjeklinu desne karotidne arterije na vratu. Protivno tvrdnjama optuženika, prvostupanjski sud je pravilno primijenio odredbe Zakona o kaznenom postupku te je na tako pravilno utvrđeno činjenično stanje pravilno primijenio odredbe kaznenog zakona.
Optuženiku je izrečen prisilni smještaj u psihijatrijsku ustanovu u trajanju šest mjeseci. Daljnje postupanje provodi se prema odredbama Zakona o zaštiti osoba s duševnim smetnjama - navodi se u obrazloženju Visokog kaznenog suda RH koji je odbio žalbu osuđenika.
Preko svoje odvjetnice žalio se zbog bitne povrede odredaba kaznenog postupka, pogrešno i nepotpuno utvrđenog činjeničnog stanja i povrede kaznenog zakona s prijedlogom da Visoki kazneni sud Republike Hrvatske ukine pobijanu presudu i predmet vrati na ponovno odlučivanje sudu prvog stupnja a podredno da preinači pobijanu presudu u skladu s zakonom.
U žalbi je istaknuto da je počinjena bitna povreda odredaba kaznenog postupkau odnosu na način napada optuženika na majku, te postojanje namjere optuženika i uporabu sile,
Naime, optuženik smatra da je njegovo djelovanje bilo usmjereno prema ocu, te da nije postojala namjera da ubije majku jer je za to imao, da je to htio, dostatno snage i energije, a što je vidljivo iz brojnosti intenziteta uboda koje je zadao ocu.
Ukazuje da je njegova namjera bila ‘otkloniti od sebe‘ majku i spriječiti je da ‘ona njega spriječi da ubije oca‘.
Visko kazneni sud je odbacio žalbu utvrdivši kako pitanje motiva postupanja optuženika prema majci u konkretnom slučaju nije od relevantnog značaja.
