Visoki trgovački sud u Zagrebu potvrdio je presudu (prvostupanjskog) Trgovačkog suda u Zadru prema kojoj osiguravajuća kuća Euroherc, u vlasništvu Dubravka Grgića, jednog od najbogatijih Hrvata, treba isplatiti odštetu za poslovno-stambenu zgradu na Putu Murvice izdignutu u velikoj poplavi 2017. godine.

Vijest je potvrdio arhitekt Željko Predovan koji je projektirao spomenutu zgradu.

- Osiguravajuća kuća žalila se na prvostupanjsku presudu koja je nakon pet godina donesena u našu korist. Predmet je otišao na Visoki trgovački sud u Zagrebu koji je također presudio u našu korist, s tim što je dao opasku da treba izračun potraživanja vezanu uz kamate i još neke troškove ispraviti, pa je predmet opet vraćen na sud u Zadru, međutim potvrdili su da osiguravajuća kuća mora platiti odštetu što je za nas najbitnije.

Sad je samo stvar visine iznosa koju treba ispraviti. Startni zahtjev bio je 27 milijuna kuna (oko 3,6 milijuna eura, op.a.), ostalo se odnosilo na zatezne kamate, troškove vještaka i ostalo, pa se ukupni iznos penje na najmanje 35 milijuna kuna (4,6 milijuna eura, op.a.).

Iskreno, meni je veći problem što sam u sporu s "Krekić Avangardom" oko naplate potraživanja, a taj bi novac od odštete trebao sjesti na tu tvrtku. Grupa investitora okupljena je u tvrtki "Centar" koja je u stečajnom postupku, pa se nadam da će se naći razuman način da dođemo konačno do svoga novca, a da opet sve ne završi u novom sudskom procesu – rekao nam je Predovan.

Arhitekt je dodao da su sve poslovno stambene jedinice u zgradi prodane, od čega su se uglavnom naplatili svi vjerovnici, pa bi se iznos od osiguranja trebao podijeliti među investitorima shodno pojedinačnim troškogvima i udjelima u tvrtki.

Podsjetimo, konstrukcija poslovno stambene zgrade na Putu Murvice morala je biti porušena zbog izdizanja kao posljedice velikog povodnja 2017. godine, pa se građevina s ukupno 120 stanova opet gradila ispočetka. Rušenje konstrukcije obavila je tvrtka "VDM Promet" iz Zagreba koja je uklonila tri gornje etaže i isto toliko podzemnih etaža, kao i samu temeljnu ploču.

Još se nikad nije do tada dogodilo u Hrvatskoj da se morala rušiti nova konstrukcija zgrade u fazi gradnje zbog izdizanja iz temelja. Katastrofa s novogradnjom na Putu Murvice bio je nezabilježen slučaj u hrvatskom građevinarstvu, koji je zadarskim investitorima zadao hrpe problema s obzirom da je osiguravajuća kuća kod koje je gradilište osigurano, odbila platiti štetu nastalu uslijed velike poplave 11. rujna 2017. godine, pa je taj slučaj završio na sudu, a investitor je odlučio zgradu srušiti i ponovno je izgraditi iz temelja.

Zgrada je dovršena i useljena uglavnom prema prethodnim planovima, ljudi u njoj žive, a tamo se nalazi i veliki broj poslovnih subjekata među kojima i uredi Hrvatskog zavoda za zdravstveno osiguranje i Fine.

Isplatom odštete konačno bi se zaključio taj slučaj, ako se nekadašnji poslovni partneri dogovore oko pojedinačnih udjela u odšteti.

Visoki trgovački sud u Zagrebu potvrdio je presudu (prvostupanjskog) Trgovačkog suda u Zadru prema kojoj osiguravajuća kuća Euroherc, u vlasništvu Dubravka Grgića, jednog od najbogatijih Hrvata, treba isplatiti odštetu za poslovno-stambenu zgradu na Putu Murvice izdignutu u velikoj poplavi 2017. godine.

Vijest je potvrdio arhitekt Željko Predovan koji je projektirao spomenutu zgradu.

- Osiguravajuća kuća žalila se na prvostupanjsku presudu koja je nakon pet godina donesena u našu korist. Predmet je otišao na Visoki trgovački sud u Zagrebu koji je također presudio u našu korist, s tim što je dao opasku da treba izračun potraživanja vezanu uz kamate i još neke troškove ispraviti, pa je predmet opet vraćen na sud u Zadru, međutim potvrdili su da osiguravajuća kuća mora platiti odštetu što je za nas najbitnije.

Sad je samo stvar visine iznosa koju treba ispraviti. Startni zahtjev bio je 27 milijuna kuna (oko 3,6 milijuna eura, op.a.), ostalo se odnosilo na zatezne kamate, troškove vještaka i ostalo, pa se ukupni iznos penje na najmanje 35 milijuna kuna (4,6 milijuna eura, op.a.).

Iskreno, meni je veći problem što sam u sporu s "Krekić Avangardom" oko naplate potraživanja, a taj bi novac od odštete trebao sjesti na tu tvrtku. Grupa investitora okupljena je u tvrtki "Centar" koja je u stečajnom postupku, pa se nadam da će se naći razuman način da dođemo konačno do svoga novca, a da opet sve ne završi u novom sudskom procesu – rekao nam je Predovan.

Arhitekt je dodao da su sve poslovno stambene jedinice u zgradi prodane, od čega su se uglavnom naplatili svi vjerovnici, pa bi se iznos od osiguranja trebao podijeliti među investitorima shodno pojedinačnim troškogvima i udjelima u tvrtki.

Podsjetimo, konstrukcija poslovno stambene zgrade na Putu Murvice morala je biti porušena zbog izdizanja kao posljedice velikog povodnja 2017. godine, pa se građevina s ukupno 120 stanova opet gradila ispočetka. Rušenje konstrukcije obavila je tvrtka "VDM Promet" iz Zagreba koja je uklonila tri gornje etaže i isto toliko podzemnih etaža, kao i samu temeljnu ploču.

Još se nikad nije do tada dogodilo u Hrvatskoj da se morala rušiti nova konstrukcija zgrade u fazi gradnje zbog izdizanja iz temelja. Katastrofa s novogradnjom na Putu Murvice bio je nezabilježen slučaj u hrvatskom građevinarstvu, koji je zadarskim investitorima zadao hrpe problema s obzirom da je osiguravajuća kuća kod koje je gradilište osigurano, odbila platiti štetu nastalu uslijed velike poplave 11. rujna 2017. godine, pa je taj slučaj završio na sudu, a investitor je odlučio zgradu srušiti i ponovno je izgraditi iz temelja.

Zgrada je dovršena i useljena uglavnom prema prethodnim planovima, ljudi u njoj žive, a tamo se nalazi i veliki broj poslovnih subjekata među kojima i uredi Hrvatskog zavoda za zdravstveno osiguranje i Fine.

Isplatom odštete konačno bi se zaključio taj slučaj, ako se nekadašnji poslovni partneri dogovore oko pojedinačnih udjela u odšteti.
