Godine se nižu, sredinom studenoga bit će ih punih šest, a stečajnom postupku koji se vodi nad kaštelanskom tvrtkom "Adria čelik" ne nazire se kraj.

Umjesto rješenja koja bi konačno dovela do okončanja postupka, stižu ona Državnog inspektorata kojima naređuje uklanjanje ništa manje nego 683,8 tona otpada, i to ne bilo kakvog. Riječ je o elektrolučnoj filtarskoj prašini - krutom otpadu od obrade plinova koja sadrži - opasne tvari. Za bolje poznavatelje ove problematike ključni broj otpada je 10 02 07.

Obilazeći po službenoj dužnosti pogone bivše željezare, državni inspektori su na osnovi raspoložive dokumentacije utvrdili da je otpad tu još od prestanka proizvodnje krajem 2014. godine, što je, naravno, suprotno zakonu po kojemu se na toj lokaciji može skladištiti najduže godinu dana. Da stvar bude gora, još je i skladišten na način da nije spriječeno njegovo rasipanje.

Zapravo je uopće teško govoriti o skladištenju ako je otpad u džambo vrećama ostavljen na četiri lokacije unutar poslovnog kruga "Adria čelika", u tri slučaja na zemljanoj nenatkrivenoj površini, a samo u jednom slučaju na površini natkrivenoj nadstrešnicom.

Inspektori su u spomenutom rješenju od 16. kolovoza za uklanjanje otpada odredili rok od 180 dana. Tvrtka u stečaju, istina, ima pravo podnijeti žalbu što ne odgađa izvršenje naređenja.

Budući da zbrinjavanje opasnog otpada mogu obavljati tvrtke koje imaju odobrenje za taj posao, s konkretnim upitima obratili smo se nekima od njih. Prije određivanja cijene, koja nas je najviše zanimala, rečeno nam je, potrebno je provesti fizikalno-kemijsku analizu kako bi se utvrdilo opterećenje opasnim tvarima.

Sukladno tom nalazu i ostalim troškovima, cijena bi se mogla kretati od tri do pet kuna po toni otpada. Ne treba, naime, smetnuti s uma da se ovakav otpad "izvozi", najčešće u Austriju, što naravno poskupljuje njegovo zbrinjavanje. U Hrvatskoj, poznato je, nema tvrtki ovlaštenih za sanaciju na domaćem teritoriju.

Kada je riječ o izvozu, podrazumijeva se i suglasnost za prijevoz preko trećih zemalja, ako je Austrija krajnje odredište, u pitanju su Slovenija ili Mađarska, osiguranje tereta, prijevoz posebnim vozilima... Uglavnom, gruba računica pokazuje da bi "Adria čelik" za uklanjanje gotovo 684 tone opasne prašine morao platiti do 3,5 milijuna kuna.

– U stečajnoj masi ovoga trenutka nema novca da se postupi po rješenju Inspektorata – kratko je Zdravko Kuzmić, stečajni upravitelj tvrtke, odgovorio na naš upit o mogućnosti financiranja ovog zahvata.

U njegovu izvješću o tijeku stečajnog postupka od lipnja 2020. do kolovoza 2021. godine, objavljenom na e-Oglasnoj ploči Općinskog suda u Splitu, navodi se da su na kunskom računu "Adria čelika" zaprimljene redovne mjesečne uplate zakupoprimaca u ukupnom iznosu od 24.792 kune i da su sve bile ovršene, a po ostalim računima tvrtke nije bilo prometa.

"Adria čelik", dakle, nema odakle sam financirati zbrinjavanje otpada. Postoji mogućnost da to učine Grad Kaštela ili država pa da se kasnije naplate kad tvrtka unovči svoju imovinu.

Inače, dok strojevi u pogonima posrnule tvrtke u Kaštel Sućurcu miruju, a ovoga trenutka nema ni jednog zaposlenika, već šest godina odvija se niz pravnih postupaka na Trgovačkom i Općinskom sudu u Splitu.

"Adria čelik" pojavljuje se u svima, bilo kao tužitelj ili tuženik. Među ostalima, vode se i ovršni postupci u kojima su ovrhovitelji "HEP Opskrba" te C.I.O.S. i CE-ZA-R. Tvrtka C.I.O.S., u vlasništvu Petra Pripuza, podsjetimo, jedan je od osnivača tvrtke CE-ZA-R.

Podsjetimo i da je C.I.O.S. u dosadašnjem tijeku postupka nad "Adria čelikom" preuzeo nekretninu i pogone valjaonice te opremu valjaonice i trafostanice. Ovršni je postupak, recimo i to, pokrenut radi naplate tražbine osigurane hipotekom na navedenim objektima.

AKTIVIRANE HIPOTEKE Pripuz polako preuzima objekte i pogone

Dok strojevi u pogonima posrnule tvrtke u Kaštel Sućurcu miruju, ovoga trenutka nema ni jednog zaposlenika, već šest godina odvija se niz pravnih postupaka na Trgovačkom i Općinskom sudu u Splitu. ‘Adria čelik‘ pojavljuje se u svima, bilo kao tužitelj ili tuženik. Godine se nižu, sredinom studenoga bit će ih punih šest, a stečajnom postupku koji se vodi nad kaštelanskom tvrtkom "Adria čelik" ne nazire se kraj.

Umjesto rješenja koja bi konačno dovela do okončanja postupka, stižu ona Državnog inspektorata kojima naređuje uklanjanje ništa manje nego 683,8 tona otpada, i to ne bilo kakvog. Riječ je o elektrolučnoj filtarskoj prašini - krutom otpadu od obrade plinova koja sadrži - opasne tvari. Za bolje poznavatelje ove problematike ključni broj otpada je 10 02 07.

Obilazeći po službenoj dužnosti pogone bivše željezare, državni inspektori su na osnovi raspoložive dokumentacije utvrdili da je otpad tu još od prestanka proizvodnje krajem 2014. godine, što je, naravno, suprotno zakonu po kojemu se na toj lokaciji može skladištiti najduže godinu dana. Da stvar bude gora, još je i skladišten na način da nije spriječeno njegovo rasipanje.

Zapravo je uopće teško govoriti o skladištenju ako je otpad u džambo vrećama ostavljen na četiri lokacije unutar poslovnog kruga "Adria čelika", u tri slučaja na zemljanoj nenatkrivenoj površini, a samo u jednom slučaju na površini natkrivenoj nadstrešnicom.

Inspektori su u spomenutom rješenju od 16. kolovoza za uklanjanje otpada odredili rok od 180 dana. Tvrtka u stečaju, istina, ima pravo podnijeti žalbu što ne odgađa izvršenje naređenja.

Budući da zbrinjavanje opasnog otpada mogu obavljati tvrtke koje imaju odobrenje za taj posao, s konkretnim upitima obratili smo se nekima od njih. Prije određivanja cijene, koja nas je najviše zanimala, rečeno nam je, potrebno je provesti fizikalno-kemijsku analizu kako bi se utvrdilo opterećenje opasnim tvarima.

Sukladno tom nalazu i ostalim troškovima, cijena bi se mogla kretati od tri do pet kuna po toni otpada. Ne treba, naime, smetnuti s uma da se ovakav otpad "izvozi", najčešće u Austriju, što naravno poskupljuje njegovo zbrinjavanje. U Hrvatskoj, poznato je, nema tvrtki ovlaštenih za sanaciju na domaćem teritoriju.

Kada je riječ o izvozu, podrazumijeva se i suglasnost za prijevoz preko trećih zemalja, ako je Austrija krajnje odredište, u pitanju su Slovenija ili Mađarska, osiguranje tereta, prijevoz posebnim vozilima... Uglavnom, gruba računica pokazuje da bi "Adria čelik" za uklanjanje gotovo 684 tone opasne prašine morao platiti do 3,5 milijuna kuna.

– U stečajnoj masi ovoga trenutka nema novca da se postupi po rješenju Inspektorata – kratko je Zdravko Kuzmić, stečajni upravitelj tvrtke, odgovorio na naš upit o mogućnosti financiranja ovog zahvata.

U njegovu izvješću o tijeku stečajnog postupka od lipnja 2020. do kolovoza 2021. godine, objavljenom na e-Oglasnoj ploči Općinskog suda u Splitu, navodi se da su na kunskom računu "Adria čelika" zaprimljene redovne mjesečne uplate zakupoprimaca u ukupnom iznosu od 24.792 kune i da su sve bile ovršene, a po ostalim računima tvrtke nije bilo prometa.

"Adria čelik", dakle, nema odakle sam financirati zbrinjavanje otpada. Postoji mogućnost da to učine Grad Kaštela ili država pa da se kasnije naplate kad tvrtka unovči svoju imovinu.

Inače, dok strojevi u pogonima posrnule tvrtke u Kaštel Sućurcu miruju, a ovoga trenutka nema ni jednog zaposlenika, već šest godina odvija se niz pravnih postupaka na Trgovačkom i Općinskom sudu u Splitu.

"Adria čelik" pojavljuje se u svima, bilo kao tužitelj ili tuženik. Među ostalima, vode se i ovršni postupci u kojima su ovrhovitelji "HEP Opskrba" te C.I.O.S. i CE-ZA-R. Tvrtka C.I.O.S., u vlasništvu Petra Pripuza, podsjetimo, jedan je od osnivača tvrtke CE-ZA-R.

Podsjetimo i da je C.I.O.S. u dosadašnjem tijeku postupka nad "Adria čelikom" preuzeo nekretninu i pogone valjaonice te opremu valjaonice i trafostanice. Ovršni je postupak, recimo i to, pokrenut radi naplate tražbine osigurane hipotekom na navedenim objektima.
