Na svakom "kantunu" Lijepe naše svjedoci smo devastacije!
Bilo devastacije prostora, bilo prirode, a posebno pomorskog dobra ili kulturne baštine, odnosno da budemo do kraja iskreni – devastacije zdrave pameti budući da u Hrvatskoj rijetki poštuju baš sve propise. Za dio građana su zakoni, uredbe i pravilnici samo mrtva slova na papiru, jer kako pojasniti još jedan slučaj devastacije kulturne baštine, rekonstrukcije građevine bez ijednog potrebnog dokumenta?! Bez ishođene građevinske dozvole, bez odobrenja konzervatora, bez oznake gradilišta...
‘Nije istina da investitor za izvođenje radova ne raspolaže odobrenjem konzervatora, niti su se bespravni radovi obavljali u vrijeme objave teksta‘
I da teatar apsurda bude još veći - sve to radi nekadašnji sudac Općinskog kaznenog suda Zagreb i aktualni odvjetnik, te njegova supruga, koja je sutkinja ovršnog i izvanparničkog odjela Općinskog građanskog suda u Zagrebu, pa bi valjda oni kao predstavnici pravosudnog dijela trodiobe vlasti trebali znati da je za gradnju ili rekonstrukciju objekta potrebna dokumentacija koju očito nemaju pa im je građevinski inspektor zatvorio gradilište u Pučišćima na Braču. Unatoč tome, bespravni radovi se i dalje odvijaju...
No, krenimo redom: početkom ožujka su supružnici iz Zagreba Rafael Krešić i Iva Žutelija Krešić, vlasnici nekretnine u srcu tog mjesta na sjevernoj obali škoja (broj parcele poznat redakciji, op.a.), započeli rekonstruirati građevinu. To ne bi bilo sporno da se objekt ne nalazi unutar granica zaštićenog kulturnog kompleksa - Urbanističke cjeline naselja Pučišća, koja taj status baštini još od 13. prosinca 1972. godine.
Za graditi, dograđivati, rekonstruirati takve objekte, uz građevinske dozvole potrebna je i dozvola konzervatora. No, budući da Krešići nisu ishodili zakonom propisana odobrenja za radove, Konzervatorski odjel u Splitu, koji je dio Ministarstva kulture, donio je 27. travnja rješenje o privremenom obustavljanju bespravnih građevinskih radova.

No, na terenu, u Pučišćima, situacija ostaje ista, a projekt se nastavlja. Na teren je izišao i građevinski inspektor, koji je zaprimio prijavu zbog ilegalnih radova.
– Nadzorom je utvrđeno da je investitor započeo s radovima na rekonstrukciji postojeće stambene građevine bez ishođene građevinske dozvole. Slijedom navedenog, građevinski inspektor je obustavio izvođenje radova, te je zatvorio gradilište postavljanjem službenog znaka. Inspekcijski postupak je u tijeku – navodi se u odgovoru Državnog inspektorata.
No, uvijek ima i ono – to nije sve! Radovi se nastavljaju i nakon inspektorske zabrane, kao i općinske odluke o obustavljanju građevinskih zahvata tijekom ljetne sezone, pa su u Pučišća stigli i policajci koji su evidentirali stanje na terenu, ali tu je njihova nadležnost završila.
Radovi se nastavljaju, kazne se pišu i zatvaraju se gradilišta, ali brojni investitori ne mare za slovo zakona, jer smo svi svjedoci kako nam pravosuđe (ne)funkcionira. Zna se da im nitko na kraju i neće srušiti to što rade bez "papira", bez dozvola. Nitko im neće - kako inače zakon nalaže - niti naložiti niti provesti onu famoznu odredbu: povratak u prvobitno stanje.
Rekli bismo kao i puno puta do sada: psi laju, a karavane prolaze. Samo što se u ovom slučaju radi o nekadašnjem sucu i sadašnjem odvjetniku, te o aktualnoj sutkinji, osobama koje su prisegnule na pridržavanje i provođenje Ustava, te zakona Republike Hrvatske.

‘Provest ću vas (zatvorenim) gradilištem‘
Upit o cijeloj situaciji poslali smo i investitoru Krešiću koji nam je odgovorio da se nalazi u Pučišćima, te nas pozvao da dođemo na lice mjesta, ali bez preciziranja ima li dozvole za (do)gradnju ili ne.
– Prava je prilika da dođete kako biste i fotografski upotpunili priču. Mislim da biste shvatili i stvarne motive vašeg izvora i stvarnu situaciju kada biste vidjeli lokaciju i dokumente, kao i obavljaju li se radovi ili ne. U stvari, priča bi tek tada mogla postati zanimljiva. Ako odlučite doći, rado ću vas primiti i provesti (zatvorenim) gradilištem – navodi odvjetnik u svojem pisanom odgovoru, ali na naša pitanja zašto je počeo radove bez potrebne dokumentacije i zašto ih i dalje obavlja unatoč zabranama - nije odgovorio.

Na svakom "kantunu" Lijepe naše svjedoci smo devastacije!
Bilo devastacije prostora, bilo prirode, a posebno pomorskog dobra ili kulturne baštine, odnosno da budemo do kraja iskreni – devastacije zdrave pameti budući da u Hrvatskoj rijetki poštuju baš sve propise. Za dio građana su zakoni, uredbe i pravilnici samo mrtva slova na papiru, jer kako pojasniti još jedan slučaj devastacije kulturne baštine, rekonstrukcije građevine bez ijednog potrebnog dokumenta?! Bez ishođene građevinske dozvole, bez odobrenja konzervatora, bez oznake gradilišta...
‘Nije istina da investitor za izvođenje radova ne raspolaže odobrenjem konzervatora, niti su se bespravni radovi obavljali u vrijeme objave teksta‘
I da teatar apsurda bude još veći - sve to radi nekadašnji sudac Općinskog kaznenog suda Zagreb i aktualni odvjetnik, te njegova supruga, koja je sutkinja ovršnog i izvanparničkog odjela Općinskog građanskog suda u Zagrebu, pa bi valjda oni kao predstavnici pravosudnog dijela trodiobe vlasti trebali znati da je za gradnju ili rekonstrukciju objekta potrebna dokumentacija koju očito nemaju pa im je građevinski inspektor zatvorio gradilište u Pučišćima na Braču. Unatoč tome, bespravni radovi se i dalje odvijaju...
No, krenimo redom: početkom ožujka su supružnici iz Zagreba Rafael Krešić i Iva Žutelija Krešić, vlasnici nekretnine u srcu tog mjesta na sjevernoj obali škoja (broj parcele poznat redakciji, op.a.), započeli rekonstruirati građevinu. To ne bi bilo sporno da se objekt ne nalazi unutar granica zaštićenog kulturnog kompleksa - Urbanističke cjeline naselja Pučišća, koja taj status baštini još od 13. prosinca 1972. godine.
Za graditi, dograđivati, rekonstruirati takve objekte, uz građevinske dozvole potrebna je i dozvola konzervatora. No, budući da Krešići nisu ishodili zakonom propisana odobrenja za radove, Konzervatorski odjel u Splitu, koji je dio Ministarstva kulture, donio je 27. travnja rješenje o privremenom obustavljanju bespravnih građevinskih radova.

No, na terenu, u Pučišćima, situacija ostaje ista, a projekt se nastavlja. Na teren je izišao i građevinski inspektor, koji je zaprimio prijavu zbog ilegalnih radova.
– Nadzorom je utvrđeno da je investitor započeo s radovima na rekonstrukciji postojeće stambene građevine bez ishođene građevinske dozvole. Slijedom navedenog, građevinski inspektor je obustavio izvođenje radova, te je zatvorio gradilište postavljanjem službenog znaka. Inspekcijski postupak je u tijeku – navodi se u odgovoru Državnog inspektorata.
No, uvijek ima i ono – to nije sve! Radovi se nastavljaju i nakon inspektorske zabrane, kao i općinske odluke o obustavljanju građevinskih zahvata tijekom ljetne sezone, pa su u Pučišća stigli i policajci koji su evidentirali stanje na terenu, ali tu je njihova nadležnost završila.
Radovi se nastavljaju, kazne se pišu i zatvaraju se gradilišta, ali brojni investitori ne mare za slovo zakona, jer smo svi svjedoci kako nam pravosuđe (ne)funkcionira. Zna se da im nitko na kraju i neće srušiti to što rade bez "papira", bez dozvola. Nitko im neće - kako inače zakon nalaže - niti naložiti niti provesti onu famoznu odredbu: povratak u prvobitno stanje.
Rekli bismo kao i puno puta do sada: psi laju, a karavane prolaze. Samo što se u ovom slučaju radi o nekadašnjem sucu i sadašnjem odvjetniku, te o aktualnoj sutkinji, osobama koje su prisegnule na pridržavanje i provođenje Ustava, te zakona Republike Hrvatske.

‘Provest ću vas (zatvorenim) gradilištem‘
Upit o cijeloj situaciji poslali smo i investitoru Krešiću koji nam je odgovorio da se nalazi u Pučišćima, te nas pozvao da dođemo na lice mjesta, ali bez preciziranja ima li dozvole za (do)gradnju ili ne.
– Prava je prilika da dođete kako biste i fotografski upotpunili priču. Mislim da biste shvatili i stvarne motive vašeg izvora i stvarnu situaciju kada biste vidjeli lokaciju i dokumente, kao i obavljaju li se radovi ili ne. U stvari, priča bi tek tada mogla postati zanimljiva. Ako odlučite doći, rado ću vas primiti i provesti (zatvorenim) gradilištem – navodi odvjetnik u svojem pisanom odgovoru, ali na naša pitanja zašto je počeo radove bez potrebne dokumentacije i zašto ih i dalje obavlja unatoč zabranama - nije odgovorio.
