Punomoćnik Ive Žutelije Krešić i Rafaela Krešića iz Zagreba obratio se sa zahtjevom za ispravak informacija iznesenih u tekstu objavljenom 28. kolovoza 2020. godine u pisanom izdanju dnevnog lista Slobodna Dalmacija, na stranici 19, i istog dana u elektronskom izdanju na www.slobodnadalmacija.hr u članku pod naslovom „Odvjetnik i supruga mu sutkinja u srcu Pučišća grade – bespravno“, te nadnaslova “Konzervatori zabranili radove, inspektor zatvorio gradilište, ali i dalje se zida“.

Demantij objavljujemo u cijelosti:

"Kao oprema navedenom članku, priložene su fotografije koje datiraju iz veljače i ožujka 2020. godine i time neistinito sugeriraju da se usred ljeta i protivno zabranama nadležnih tijela obavljaju radovi gradnje krovišta i ostali grubi građevinski radovi.

Moje stranke, stoga, zahtijevaju objavu ispravka objavljenih netočnih informacija, u svrhu čega u skladu s člankom 42., stavak 1. Zakona o medijima, izričito navode i obrazlažu što se neistinito navodi u predmetnom članku.

Neistina je da je investitor/naručitelj građevinskih radova na objektu Iva Žutelija Krešić.

Naručitelj projektne dokumentacije i investitor radova na objektu je Rafael Krešić, a ne Iva Žutelija Krešić. Tko je investitor radova može se utvrditi iz projektne dokumentacije (prva stranica projekta), ali i provjerom kod nadležnih tijela. Autorica teksta izričito je e-mailom odbila poziv Rafaela Krešića za uvid u dokumentaciju i stanje na gradilištu, navodeći: „Ne mogu nigdje iz Splita zbog obveza, pa ako mi možete odgovoriti putem maila“. Dakle, autorica članka bez uvida u relevantnu dokumentaciju i bez da je na bilo koji način kontaktirala Ivu Žuteliju Krešić neistinito zaključuje o njoj kao investitoru bespravno izvedenih građevinskih radova.

Neistina je da investitor za izvođenje radova ne raspolaže odobrenjem konzervatora.

Investitor za obavljene radove raspolaže „odobrenjem konzervatora“, kako ga kolokvijalno naziva autorica, ili točnije Potvrdom Ministarstva kulture, Uprave za zaštitu kulturne baštine, Konzervatorskog odjela u Splitu, kojom se potvrđuje da je Glavni arhitektonski projekt predmetne stambene zgrade u skladu s Posebnim uvjetima zaštite kulturnog dobra, koje je izdao Konzervatorski odjel u Splitu 29. svibnja 2020. godine. Taj je dokument također dio projekta koji je investitor ponudio predočiti autorici, a isti je mogla zatražiti i od Konzervatorskog odjela u Splitu.

Neistina je da su se u vrijeme objave teksta bespravni radovi i dalje obavljali.

Tekst autorice zasnovan je na tvrdnji da – iako je gradnja investitoru zabranjena od Konzervatorskog odjela u Splitu, te Državnog inspektorata – moje stranke i dalje, u srcu sezone, „zidaju“. Ističem da se zabrana radova od strane Državnog inspektorata dogodila 7. kolovoza 2020. godine, što autorica, međutim, ne navodi. Nakon 7. kolovoza 2020., bez odobrenja nisu obavljani nikakvi radovi na objektu. Svi građevinski radovi, ili kako ih autorica teksta naziva – „zidanja“, bili su obavljeni tijekom veljače, ožujka i dijela travnja 2020. godine i jedino što je na objektu rađeno nakon toga, i to uza znanje Komunalnog redarstva Općine Pučišća, a do zabrane od strane građevinske inspekcije, bilo je postavljanje i bojanje prozora, što je inspektorica prilikom postupanja jedino i zatekla, i što se vidi i na jednoj od fotografija priloženih tekstu, jedinoj koja datira iz kolovoza 2020. godine. Autorica ne navodi da jedina fotografija koja bi trebala sugerirati „zidanje“, točnije gradnju krovišta kuće, datira iz veljače 2020, dakle puno prije ikakve zabrane.

Neistina je da su radovi na objektu devastacija kulturne baštine.

Konzervatorski odjel u Splitu, surotno tvrdnjama u članku, objekt izveden po odobrenom projektu – ne smatra devastacijom te je u cijelosti odobrio projekt obnove stare građevine. Kako bi bilo jasno o kakvoj je „devastaciji“ riječ, ovom obraćanju prilaže se fotografija stanja objekta prije radova, odnosno „prijašnjeg stanja“.

Neistina je da su na objektu obavljani radovi protivno odluci Općine o zabrani radova tijekom sezone.

Rafael Krešić, kao investitor, ni na koji način nije kršio nikakvu općinsku zabranu, dapače, radovi vršeni tijekom ljeta, a radilo se samo o postavljanju i bojanju prozora, obavljani su uz znanje i prethodnu obavijest Općini Pučišća, koja ih nije zabranila izvoditi."

Punomoćnik Ive Žutelije Krešić i Rafaela Krešića iz Zagreba obratio se sa zahtjevom za ispravak informacija iznesenih u tekstu objavljenom 28. kolovoza 2020. godine u pisanom izdanju dnevnog lista Slobodna Dalmacija, na stranici 19, i istog dana u elektronskom izdanju na www.slobodnadalmacija.hr u članku pod naslovom „Odvjetnik i supruga mu sutkinja u srcu Pučišća grade – bespravno“, te nadnaslova “Konzervatori zabranili radove, inspektor zatvorio gradilište, ali i dalje se zida“.

Demantij objavljujemo u cijelosti:

"Kao oprema navedenom članku, priložene su fotografije koje datiraju iz veljače i ožujka 2020. godine i time neistinito sugeriraju da se usred ljeta i protivno zabranama nadležnih tijela obavljaju radovi gradnje krovišta i ostali grubi građevinski radovi.

Moje stranke, stoga, zahtijevaju objavu ispravka objavljenih netočnih informacija, u svrhu čega u skladu s člankom 42., stavak 1. Zakona o medijima, izričito navode i obrazlažu što se neistinito navodi u predmetnom članku.

Neistina je da je investitor/naručitelj građevinskih radova na objektu Iva Žutelija Krešić.

Naručitelj projektne dokumentacije i investitor radova na objektu je Rafael Krešić, a ne Iva Žutelija Krešić. Tko je investitor radova može se utvrditi iz projektne dokumentacije (prva stranica projekta), ali i provjerom kod nadležnih tijela. Autorica teksta izričito je e-mailom odbila poziv Rafaela Krešića za uvid u dokumentaciju i stanje na gradilištu, navodeći: „Ne mogu nigdje iz Splita zbog obveza, pa ako mi možete odgovoriti putem maila“. Dakle, autorica članka bez uvida u relevantnu dokumentaciju i bez da je na bilo koji način kontaktirala Ivu Žuteliju Krešić neistinito zaključuje o njoj kao investitoru bespravno izvedenih građevinskih radova.

Neistina je da investitor za izvođenje radova ne raspolaže odobrenjem konzervatora.

Investitor za obavljene radove raspolaže „odobrenjem konzervatora“, kako ga kolokvijalno naziva autorica, ili točnije Potvrdom Ministarstva kulture, Uprave za zaštitu kulturne baštine, Konzervatorskog odjela u Splitu, kojom se potvrđuje da je Glavni arhitektonski projekt predmetne stambene zgrade u skladu s Posebnim uvjetima zaštite kulturnog dobra, koje je izdao Konzervatorski odjel u Splitu 29. svibnja 2020. godine. Taj je dokument također dio projekta koji je investitor ponudio predočiti autorici, a isti je mogla zatražiti i od Konzervatorskog odjela u Splitu.

Neistina je da su se u vrijeme objave teksta bespravni radovi i dalje obavljali.

Tekst autorice zasnovan je na tvrdnji da – iako je gradnja investitoru zabranjena od Konzervatorskog odjela u Splitu, te Državnog inspektorata – moje stranke i dalje, u srcu sezone, „zidaju“. Ističem da se zabrana radova od strane Državnog inspektorata dogodila 7. kolovoza 2020. godine, što autorica, međutim, ne navodi. Nakon 7. kolovoza 2020., bez odobrenja nisu obavljani nikakvi radovi na objektu. Svi građevinski radovi, ili kako ih autorica teksta naziva – „zidanja“, bili su obavljeni tijekom veljače, ožujka i dijela travnja 2020. godine i jedino što je na objektu rađeno nakon toga, i to uza znanje Komunalnog redarstva Općine Pučišća, a do zabrane od strane građevinske inspekcije, bilo je postavljanje i bojanje prozora, što je inspektorica prilikom postupanja jedino i zatekla, i što se vidi i na jednoj od fotografija priloženih tekstu, jedinoj koja datira iz kolovoza 2020. godine. Autorica ne navodi da jedina fotografija koja bi trebala sugerirati „zidanje“, točnije gradnju krovišta kuće, datira iz veljače 2020, dakle puno prije ikakve zabrane.

Neistina je da su radovi na objektu devastacija kulturne baštine.

Konzervatorski odjel u Splitu, surotno tvrdnjama u članku, objekt izveden po odobrenom projektu – ne smatra devastacijom te je u cijelosti odobrio projekt obnove stare građevine. Kako bi bilo jasno o kakvoj je „devastaciji“ riječ, ovom obraćanju prilaže se fotografija stanja objekta prije radova, odnosno „prijašnjeg stanja“.

Neistina je da su na objektu obavljani radovi protivno odluci Općine o zabrani radova tijekom sezone.

Rafael Krešić, kao investitor, ni na koji način nije kršio nikakvu općinsku zabranu, dapače, radovi vršeni tijekom ljeta, a radilo se samo o postavljanju i bojanju prozora, obavljani su uz znanje i prethodnu obavijest Općini Pučišća, koja ih nije zabranila izvoditi."

Punomoćnik Ive Žutelije Krešić i Rafaela Krešića iz Zagreba obratio se sa zahtjevom za ispravak informacija iznesenih u tekstu objavljenom 28. kolovoza 2020. godine u pisanom izdanju dnevnog lista Slobodna Dalmacija, na stranici 19, i istog dana u elektronskom izdanju na www.slobodnadalmacija.hr u članku pod naslovom „Odvjetnik i supruga mu sutkinja u srcu Pučišća grade – bespravno“, te nadnaslova “Konzervatori zabranili radove, inspektor zatvorio gradilište, ali i dalje se zida“.

Demantij objavljujemo u cijelosti:

"Kao oprema navedenom članku, priložene su fotografije koje datiraju iz veljače i ožujka 2020. godine i time neistinito sugeriraju da se usred ljeta i protivno zabranama nadležnih tijela obavljaju radovi gradnje krovišta i ostali grubi građevinski radovi...
