U tiskanom izdanju Slobodne Dalmacije i na portalu SD od 7. lipnja 2022., objavljen je tekst pod naslovom "Općina Sućuraj svjesno prepušta naše stoljetne posjede Norvežanima".

Lijepo molimo da, u ime naše stranke IANOS-a, i u cilju istinitog izvještavanja te u skladu s člancima 40. i 41. Zakona o medijima, objavite ovo reagiranje.

Pogrešni/neistiniti navodi u tekstu:

"Osim Općine, ni Norvežani ne mogu reći da nisu znali što se i čije ovršuje."

Ova je tvrdnja netočna budući da prilikom podnošenja prijedloga za ovrhu na nekretninama u vlasništvu Općine, 17. ožujka 2021., nije postojala niti jedna zabilježba kao ni prijedlog za upis zabilježbe (plomba) spora čiji bi ishod na bilo koji način mogao utjecati na uknjižbu ili opterećenje prava vlasništva koje Općina Sućuraj ima na predmetnim nekretninama. Treće osobe su parnicu radi utvrđivanja prava vlasništva na nekretninama koje su predmetom Ovršnog postupka pokrenule tek 27. studenog 2021. godine, dakle 7 mjeseci nakon pokretanja ovrhe. Napominjemo kako je ovršni postupak pokrenut na temelju pravomoćne presude Visokog trgovačkog suda Republike Hrvatske s ciljem namirenja dugovanja Općine prema IANOS-u, u ukupnom iznosu glavnice većem od 7 milijuna kuna.

"Objasnili ste mi na jasan način da je Općina Sućuraj na svojevrstan način ucijenjena od Norvežana da pristane na neposrednu pogodbu u ovršnom postupku, a sve kako bi im se predmet ovrhe prepustio u vlasništvo i na taj način prebio dug za koji nije odgovorna Općina Sućuraj."

Netočne su insinuacije o bilo kakvoj ucjeni, budući da je tekst nacrta neposredne pogodbe, u cilju transparentnosti i djelovanja u skladu sa zakonima RH, osim kroz nadležna tijela Općine, od strane iste upućen i na mišljenje nadležnom Državnom odvjetništvu. Sama odluka o prihvaćanju neposredne pogodbe je donijeta od strane Općinskog vijeća te se Ugovor o prodaji nekretnina neposrednom pogodbom sklapa pred nadležnim sudom. Netočna je i tvrdnja o predaji, odnosno prepuštanju vlasništva nekretnina IANOS-u. Točno je da će, ako se u Ovršnom postupku donese odluku o sklapanju neposredne pogodbe, IANOS kupiti predmetne nekretnine prijebojem kupoprodajne cijene s dugovanjem radi kojeg je Ovršni postupak i pokrenut.

"Norvežani, osim što će dobiti u vlasništvo dvije čestice u Vinogradinama u pola cijene, domoći će se besplatno još 30.758 kvadrata u uvali Perna. Treba primijeniti da je kupoprodajom 2012. dogovorena cijena od 65 eura po četvornome metru, da bi sada u ovršnom postupku suglasili kupoprodaju na iznos od 6.310.816,00 kn, dakle cijena ispada otprilike 28 eura po kvadratu u ovršnom postupku."

Cijela navedena tvrdnja je netočna i tendenciozna. Ovdje se miješa građevinsko i poljoprivredno zemljište, a uključuje se i zemljište na drugoj poziciji koje uopće nije predmet bilo kakvog dogovora vezanog za predmetni ovršni postupak. Time se stvara iluzija navodnog pogodovanja bez i jednoj istinitog argumenta. Cijena čestica koje bi trebale biti predmet neposredne pogodbe utvrđuje se temeljem od suda imenovanog neovisnog procjenitelja, na način da je njegova procjena uzeta kao temelj određivanja cijene u pogodbi.

"Za njegove, pak, klijente problem je što im sada Norvežani potražuju dvostruki iznos kapare, što je sa zateznim kamatama debelo premašilo 200 tisuća eura. Može se, znači, dogoditi da ostanu bez zemlje i natovare im se nemali dugovi."

Još jedna potpuna neistina. Klijenti odvjetnika kojeg se citira nisu u nikakvom odnosu sa IANOS-om niti PPK grupom. Iznos od "200 tisuća eura" koji bi "Norvežani" potraživali po osnovi dvostruke kapare je također izmišljen jer strankama spomenutog kolege odvjetnika nitko iz PPK grupe nije dao kaparu, nije s njima sklopio bilo kakav ugovor, niti bi prema njima bio usmjeren bilo kakav zahtjev za dvostruku kaparu od strane IANOS-a, odnosno "Norvežana" kako se naše stranke označavaju u spomenutom tekstu.

U tiskanom izdanju Slobodne Dalmacije i na portalu SD od 7. lipnja 2022., objavljen je tekst pod naslovom "Općina Sućuraj svjesno prepušta naše stoljetne posjede Norvežanima".

Lijepo molimo da, u ime naše stranke IANOS-a, i u cilju istinitog izvještavanja te u skladu s člancima 40. i 41. Zakona o medijima, objavite ovo reagiranje.

Pogrešni/neistiniti navodi u tekstu:

"Osim Općine, ni Norvežani ne mogu reći da nisu znali što se i čije ovršuje."

Ova je tvrdnja netočna budući da prilikom podnošenja prijedloga za ovrhu na nekretninama u vlasništvu Općine, 17. ožujka 2021., nije postojala niti jedna zabilježba kao ni prijedlog za upis zabilježbe (plomba) spora čiji bi ishod na bilo koji način mogao utjecati na uknjižbu ili opterećenje prava vlasništva koje Općina Sućuraj ima na predmetnim nekretninama. Treće osobe su parnicu radi utvrđivanja prava vlasništva na nekretninama koje su predmetom Ovršnog postupka pokrenule tek 27. studenog 2021. godine, dakle 7 mjeseci nakon pokretanja ovrhe. Napominjemo kako je ovršni postupak pokrenut na temelju pravomoćne presude Visokog trgovačkog suda Republike Hrvatske s ciljem namirenja dugovanja Općine prema IANOS-u, u ukupnom iznosu glavnice većem od 7 milijuna kuna.

"Objasnili ste mi na jasan način da je Općina Sućuraj na svojevrstan način ucijenjena od Norvežana da pristane na neposrednu pogodbu u ovršnom postupku, a sve kako bi im se predmet ovrhe prepustio u vlasništvo i na taj način prebio dug za koji nije odgovorna Općina Sućuraj."

Netočne su insinuacije o bilo kakvoj ucjeni, budući da je tekst nacrta neposredne pogodbe, u cilju transparentnosti i djelovanja u skladu sa zakonima RH, osim kroz nadležna tijela Općine, od strane iste upućen i na mišljenje nadležnom Državnom odvjetništvu. Sama odluka o prihvaćanju neposredne pogodbe je donijeta od strane Općinskog vijeća te se Ugovor o prodaji nekretnina neposrednom pogodbom sklapa pred nadležnim sudom. Netočna je i tvrdnja o predaji, odnosno prepuštanju vlasništva nekretnina IANOS-u. Točno je da će, ako se u Ovršnom postupku donese odluku o sklapanju neposredne pogodbe, IANOS kupiti predmetne nekretnine prijebojem kupoprodajne cijene s dugovanjem radi kojeg je Ovršni postupak i pokrenut.

"Norvežani, osim što će dobiti u vlasništvo dvije čestice u Vinogradinama u pola cijene, domoći će se besplatno još 30.758 kvadrata u uvali Perna. Treba primijeniti da je kupoprodajom 2012. dogovorena cijena od 65 eura po četvornome metru, da bi sada u ovršnom postupku suglasili kupoprodaju na iznos od 6.310.816,00 kn, dakle cijena ispada otprilike 28 eura po kvadratu u ovršnom postupku."

Cijela navedena tvrdnja je netočna i tendenciozna. Ovdje se miješa građevinsko i poljoprivredno zemljište, a uključuje se i zemljište na drugoj poziciji koje uopće nije predmet bilo kakvog dogovora vezanog za predmetni ovršni postupak. Time se stvara iluzija navodnog pogodovanja bez i jednoj istinitog argumenta. Cijena čestica koje bi trebale biti predmet neposredne pogodbe utvrđuje se temeljem od suda imenovanog neovisnog procjenitelja, na način da je njegova procjena uzeta kao temelj određivanja cijene u pogodbi.

"Za njegove, pak, klijente problem je što im sada Norvežani potražuju dvostruki iznos kapare, što je sa zateznim kamatama debelo premašilo 200 tisuća eura. Može se, znači, dogoditi da ostanu bez zemlje i natovare im se nemali dugovi."

Još jedna potpuna neistina. Klijenti odvjetnika kojeg se citira nisu u nikakvom odnosu sa IANOS-om niti PPK grupom. Iznos od "200 tisuća eura" koji bi "Norvežani" potraživali po osnovi dvostruke kapare je također izmišljen jer strankama spomenutog kolege odvjetnika nitko iz PPK grupe nije dao kaparu, nije s njima sklopio bilo kakav ugovor, niti bi prema njima bio usmjeren bilo kakav zahtjev za dvostruku kaparu od strane IANOS-a, odnosno "Norvežana" kako se naše stranke označavaju u spomenutom tekstu.

Norveški investitori: ‘Sve radimo transparentno i u skladu sa zakonima RH‘

U tiskanom izdanju Slobodne Dalmacije i na portalu SD od 7. lipnja 2022., objavljen je tekst pod naslovom "Općina Sućuraj svjesno prepušta naše stoljetne posjede Norvežanima".

Lijepo molimo da, u ime naše stranke IANOS-a, i u cilju istinitog izvještavanja te u skladu s člancima 40. i 41. Zakona o medijima, objavite ovo reagiranje.

Pogrešni/neistiniti navodi u tekstu:

"Osim Općine, ni Norvežani ne mogu reći da nisu znali što se i čije ovršuje."

Ova je tvrdnja netočna budući da prilikom podnošenja prijedloga za ovrhu na nekretninama u vlasništvu Općine, 17. ožujka 2021., nije postojala niti jedna zabilježba kao ni prijedlog za upis zabilježbe (plomba) spora čiji bi ishod na bilo koji način mogao utjecati na uknjižbu ili opterećenje prava vlasništva koje Općina Sućuraj ima na pr...
