Pokušaji da se vozači spase od kazni pisanjem raznoraznih prigovora nisu nikakva novost, no praksa pokazuje da se taj potez isplati isključivo kad postoji opravdan razlog, odnosno uporište u zakonu. U suprotnom, samo slijede dodatni sudski troškovi...
Takav scenarij, primjerice, izgledan je kad se dobivena prometna kazna nastoji osporiti zbog "problematičnog" mjesta na kojemu je policijski službenik zaustavio vozilo prilikom nadzora prometa. Zašto? Zato što pogled u Zakon o sigurnosti prometa na cestama, pa i u temeljem njega donesen Pravilnik o načinu postupanja policijskih službenika u obavljanju poslova nadzora i upravljanja prometom na cestama, otkriva da takva "problematična mjesta" zapravo ne postoje.
Ili su, barem, dobro skrivena i predstavljaju sklizak teren za podnositelje prigovora jer se u konačnici sve svodi na sigurnosnu procjenu policajca. U članku 17. spomenutog Pravilnika, primjerice, stoji da su policijski službenici prilikom nadzora prometa " dužni zaustavljanje obavljati na dijelu ceste uz desni rub kolnika u pravcu kretanja, tako da ostali sudionici u prometu mogu pravovremeno uočiti zaustavljena vozila, vodeći pri tome računa da ne ometaju promet ili ugrožavaju vlastitu sigurnost ili sigurnost drugih sudionika u prometu".
Iz ovoga se može iščitati da je u praksi gotovo svako mjesto pogodno za zaustavljanje, osim valjda mračnog tunela i zavoja, sve dok se zaustavljanje obavlja uz desni rub kolnika. No, potom se saznaje da niti taj desni rub kolnika nije uvjet. Već u sljedećoj rečenici, naime, piše da se "zaustavljanje može obaviti i sa suprotne strane ceste, ako to zahtijevaju razlozi sigurnosti".
Koji sigurnosni razlozi? To nije navedeno, tako da je sve prepušteno procjeni policijskog službenika, koji po vlastitom nahođenju može vozilo zaustaviti uz desni rub kolnika ili na "suprotnoj strani ceste".
Potom, na užas svakoga tko bi želio napisati prigovor, slijedi jednako sklizak teren. Nakon što se saznalo da se vozilo, zapravo, može zaustaviti na obje strane ceste, saznaje se i da se "zaustavljanje vozila u pravilu obavlja na mjestima gdje se vozilo cijelom svojom površinom može ukloniti s kolnika". Dakle, samo "u pravilu". Upravo stoga, ispada da policija nadzor prometa u skladu s propisima može obavljati i tamo gdje nema baš nikakvih uvjeta da zaustavljeno vozilo u konačnici makne s ceste.
Tu se, međutim, otvara i jedina prava šansa za prigovor – u Pravilniku, naime, stoji da u slučaju svakog zaustavljanja na kolniku "na policijskom vozilu mora biti upaljeno plavo rotacijsko svjetlo, a policijsko vozilo mora se nalaziti iza vozila koje je zaustavljeno". Ovdje, dakle, nije korištena konstrukcija "u pravilu", nego riječ "mora", pa u slučaju da policijski službenici zanemare ovu obavezu postoji dobar temelj za prigovor.
Pritom treba znati da se po Zakonu o sigurnosti prometa na cestama kolnikom ne smatraju autobusna stanica, benzinska postaja, parkiralište, poljski i šumski putovi...
S druge strane, kolnikom se smatra zaustavna traka na autocesti, pa je i tu propisano da u slučaju zaustavljanja – koje se na autocesti u pravilu obavlja na "za to prikladnom mjestu", ali "u osobito opravdanim slučajevima" može biti obavljeno i u zaustavnoj traci - na policijskom vozilu moraju biti uključeni svjetlosni znakovi, a policijsko vozilo mora se nalaziti iza zaustavljenog vozila, piše Jutarnji list.

Pokušaji da se vozači spase od kazni pisanjem raznoraznih prigovora nisu nikakva novost, no praksa pokazuje da se taj potez isplati isključivo kad postoji opravdan razlog, odnosno uporište u zakonu. U suprotnom, samo slijede dodatni sudski troškovi...
Takav scenarij, primjerice, izgledan je kad se dobivena prometna kazna nastoji osporiti zbog "problematičnog" mjesta na kojemu je policijski službenik zaustavio vozilo prilikom nadzora prometa. Zašto? Zato što pogled u Zakon o sigurnosti prometa na cestama, pa i u temeljem njega donesen Pravilnik o načinu postupanja policijskih službenika u obavljanju poslova nadzora i upravljanja prometom na cestama, otkriva da takva "problematična mjesta" zapravo ne postoje.
Ili su, barem, dobro skrivena i predstavljaju sklizak teren za podnositelje prigovora jer se u konačnici sve svodi na sigurnosnu procjenu policajca. U članku 17. spomenutog Pravilnika, primjerice, stoji da su policijski službenici prilikom nadzora prometa " dužni zaustavljanje obavljati na dijelu ceste uz desni rub kolnika u pravcu kretanja, tako da ostali sudionici u prometu mogu pravovremeno uočiti zaustavljena vozila, vodeći pri tome računa da ne ometaju promet ili ugrožavaju vlastitu sigurnost ili sigurnost drugih sudionika u prometu".
Iz ovoga se može iščitati da je u praksi gotovo svako mjesto pogodno za zaustavljanje, osim valjda mračnog tunela i zavoja, sve dok se zaustavljanje obavlja uz desni rub kolnika. No, potom se saznaje da niti taj desni rub kolnika nije uvjet. Već u sljedećoj rečenici, naime, piše da se "zaustavljanje može obaviti i sa suprotne strane ceste, ako to zahtijevaju razlozi sigurnosti".
Koji sigurnosni razlozi? To nije navedeno, tako da je sve prepušteno procjeni policijskog službenika, koji po vlastitom nahođenju može vozilo zaustaviti uz desni rub kolnika ili na "suprotnoj strani ceste".
Potom, na užas svakoga tko bi želio napisati prigovor, slijedi jednako sklizak teren. Nakon što se saznalo da se vozilo, zapravo, može zaustaviti na obje strane ceste, saznaje se i da se "zaustavljanje vozila u pravilu obavlja na mjestima gdje se vozilo cijelom svojom površinom može ukloniti s kolnika". Dakle, samo "u pravilu". Upravo stoga, ispada da policija nadzor prometa u skladu s propisima može obavljati i tamo gdje nema baš nikakvih uvjeta da zaustavljeno vozilo u konačnici makne s ceste.
Tu se, međutim, otvara i jedina prava šansa za prigovor – u Pravilniku, naime, stoji da u slučaju svakog zaustavljanja na kolniku "na policijskom vozilu mora biti upaljeno plavo rotacijsko svjetlo, a policijsko vozilo mora se nalaziti iza vozila koje je zaustavljeno". Ovdje, dakle, nije korištena konstrukcija "u pravilu", nego riječ "mora", pa u slučaju da policijski službenici zanemare ovu obavezu postoji dobar temelj za prigovor.
Pritom treba znati da se po Zakonu o sigurnosti prometa na cestama kolnikom ne smatraju autobusna stanica, benzinska postaja, parkiralište, poljski i šumski putovi...
S druge strane, kolnikom se smatra zaustavna traka na autocesti, pa je i tu propisano da u slučaju zaustavljanja – koje se na autocesti u pravilu obavlja na "za to prikladnom mjestu", ali "u osobito opravdanim slučajevima" može biti obavljeno i u zaustavnoj traci - na policijskom vozilu moraju biti uključeni svjetlosni znakovi, a policijsko vozilo mora se nalaziti iza zaustavljenog vozila, piše Jutarnji list.
