Frederick Ward je oporukom odlučio ostaviti svo svoje bogatstvo, koje je uključivalo gotovinu od 500.000 funti i stan vrijedan 450.000 funti, svoje dvoje djece. Oporuku je sastavio 2018., umro je 2020. godine.

Iz oporuke je isključio svojih pet unuka, koje su bile kćeri njegovog tada već preminulog sina, Fredericka Warda mlađeg.

Oporuku je objasnio riječima da je bio pogođen i uvrijeđen što ga unuke nisu posjećivale dok je bio hospitaliziran zbog bolesti pluća.

Ali nakon što su saznale da su razbaštinjene, Frederickovih pet unuka - Carol Gowing, Angela St Marseille, Amanda Higginbotham, Christine Ward i Janet Pett su podnijele tužbu i tvrdile da imaju pravo na trećinu novca svog pokojnog djeda.

Sudac Visokog suda, James Brightwell, sada je presudio da je oporuka Fredericka Warda Starijeg, sastavljena 2018. "posve razumna i  racionalna", dodajući da su unuke imale "minimalan kontakt" sa svojim "razočaranim djedom".

Odbacujući njihov slučaj, sudac Brightwell je rekao: "Neki bi mogli zauzeti gledište da bi, u slučaju kad je oporučiteljevo dijete umrlo prije njega, on općenito trebao ostaviti jednak udio svog nasljedstva svima, pa i nasljednicima svoga djeteta.

Odluka da se to ne učini iz osobnih razloga, međutim, odluka je za koju je teško reći da je nijedan razuman ostavitelj ne bi mogao donijeti."

Unuke pokojnika na sudu su tvrdile da je oporuka iz 2018. "nevažeća", te da su njihov ujak Terry Ward i teta Susan Wiltshire utjecali na svog oca da promijeni svoju oporuku.

Ali sudac Brightwell rekao je da ga "nisu ni blizu uvjerili dokazima" da je Terry "prisilio" svog oca ili da ga je Susan "kontrolirala".

Pokojnik Frederick Ward Stariji u svojoj prvoj napisanoj oporuci svoj je imetak podijelio između sve troje svoje djece.

No njegov sin, Fred Mlađi, umro je prije svog oca, 2015. godine, nakon čega se obitelj posvađala i gospodin Ward stariji nije viđao obitelj svoga pokojnog sina.

Po završetku sudske presude, ujak Terry Ward je ispunio želju izrečenu u oporuci svoga oca, te je svakoj od pet unuka pokojnika uručio po omotnicu. U njoj je stajalo po 50 funti, izvijestio je MailOnline.

Frederick Ward je oporukom odlučio ostaviti svo svoje bogatstvo, koje je uključivalo gotovinu od 500.000 funti i stan vrijedan 450.000 funti, svoje dvoje djece. Oporuku je sastavio 2018., umro je 2020. godine.

Iz oporuke je isključio svojih pet unuka, koje su bile kćeri njegovog tada već preminulog sina, Fredericka Warda mlađeg.

Oporuku je objasnio riječima da je bio pogođen i uvrijeđen što ga unuke nisu posjećivale dok je bio hospitaliziran zbog bolesti pluća.

Ali nakon što su saznale da su razbaštinjene, Frederickovih pet unuka - Carol Gowing, Angela St Marseille, Amanda Higginbotham, Christine Ward i Janet Pett su podnijele tužbu i tvrdile da imaju pravo na trećinu novca svog pokojnog djeda.

Sudac Visokog suda, James Brightwell, sada je presudio da je oporuka Fredericka Warda Starijeg, sastavljena 2018. "posve razumna i  racionalna", dodajući da su unuke imale "minimalan kontakt" sa svojim "razočaranim djedom".

Odbacujući njihov slučaj, sudac Brightwell je rekao: "Neki bi mogli zauzeti gledište da bi, u slučaju kad je oporučiteljevo dijete umrlo prije njega, on općenito trebao ostaviti jednak udio svog nasljedstva svima, pa i nasljednicima svoga djeteta.

Odluka da se to ne učini iz osobnih razloga, međutim, odluka je za koju je teško reći da je nijedan razuman ostavitelj ne bi mogao donijeti."

Unuke pokojnika na sudu su tvrdile da je oporuka iz 2018. "nevažeća", te da su njihov ujak Terry Ward i teta Susan Wiltshire utjecali na svog oca da promijeni svoju oporuku.

Ali sudac Brightwell rekao je da ga "nisu ni blizu uvjerili dokazima" da je Terry "prisilio" svog oca ili da ga je Susan "kontrolirala".

Pokojnik Frederick Ward Stariji u svojoj prvoj napisanoj oporuci svoj je imetak podijelio između sve troje svoje djece.

No njegov sin, Fred Mlađi, umro je prije svog oca, 2015. godine, nakon čega se obitelj posvađala i gospodin Ward stariji nije viđao obitelj svoga pokojnog sina.

Po završetku sudske presude, ujak Terry Ward je ispunio želju izrečenu u oporuci svoga oca, te je svakoj od pet unuka pokojnika uručio po omotnicu. U njoj je stajalo po 50 funti, izvijestio je MailOnline.

Frederick Ward je oporukom odlučio ostaviti svo svoje bogatstvo, koje je uključivalo gotovinu od 500.000 funti i stan vrijedan 450.000 funti, svoje dvoje djece. Oporuku je sastavio 2018., umro je 2020. godine.

Iz oporuke je isključio svojih pet unuka, koje su bile kćeri njegovog tada već preminulog sina, Fredericka Warda mlađeg.
