Direktor "Splitske obale" Dražen Delić poslao je očitovanje na tekst objavljen u Slobodnoj Dalmaciji  "SDP-ova i HDZ-ova vlast žmirile su na činjenicu da Zapadna obala nije luka, a HGS ih je zato podupirao u Vijeću i uhljebljivao kadrove u ‘Splitskoj obali‘, u kojem je navedena kronologija događanja oko Zapadne obale koja su rezultirala višemilijunskom kaznom koju je dobila spomenuta gradska tvrtka. 

Njegovo očitovanje prenosimo u cijelosti.

"U tekstu autora Saše Ljubičića pod naslovom: „SDP-ova i HDZ-ova vlast žmirile su na činjenicu da Zapadna obala nije luka, a HGS ih je zato podupirao u Vijeću i uhljebivao kadrove u „Splitskoj obali“„ iznesen je niz neistina, ali ćemo se osvrnuti na dio koji je od najvećeg značaja za građane Grada Splita, tj. porezne obveznike.

Jedan od sugovornika u tekstu dao je izjavu: „da se poštivao Zakon o pomorskom dobru i morskim lukama, i da je Gradu dodijeljena koncesija na Zapadnoj obali, prihodi bi se dijelili u omjeru 30 posto Gradu, Županiji i državi“. Naime, Zakon ne dozvoljava ovakvo nešto. Grad Split ne može vršiti komercijalnu djelatnost i upravo iz tog razloga je i osnovana tvrtka Splitska obala d.o.o., kako bi gradska tvrtka mogla sudjelovati na natječaju za koncesiju. Nadalje, ne dijeli se ukupni prihod, već stalni i promjenjivi dio koncesijske naknade koji iznosi 3 posto od ostvarenih prihoda od te djelatnosti. Isti sugovornik navodi da će kaznu platiti građani grada Splita, što je neistina, jer ukoliko Upravni sud donese odluku da se odbija tužba Splitske obale d.o.o., dio novca koji je uprihodovan od te djelatnosti Splitska obala će morati uplatiti u državni proračun. Dakle, da se nije obavljala djelatnost, taj novac ne bi ni postojao. Taj novac nije uprihodovan od građana Grada Splita, već od stranaca/jahtaša, te će od istog u slučaju naplate carinske kazne, korist imati upravo građani ove države, jer se isti uplaćuje u državni proračun. Prema tome, ništa nije dalje od istine kao što su izrečene tvrdnje daleko od činjeničnog stanja.

Ovdje se zapravo i ne radi o carinskoj kazni već se radi o razlici koncesijske naknade koju je Splitska obala d.o.o. uplaćivala u proračun SDŽ u kontroliranom razdoblju i pune koncesijske naknade koju je carinsko tijelo obračunalo Splitskoj obali kao da je obavljala djelatnost priveza bez koncesije na cijelom kopnenom i morskom dijelu obuhvata koncesije. Također, radi se i o oduzimanju ostvarenih prihoda od obavljanja ove djelatnosti navodno izvan djelatnosti koje su navedene u Ugovoru o koncesiji između Splitske obale i SDŽ, a koju je Splitska obala uprihodovala u navedenom razdoblju, umanjenoj za troškove vezane za obavljanje djelatnosti. Iz navedenog je razvidno da je iznos koji bi Splitska obala u slučaju odbijanja tužbe trebala uplatiti u državni proračun ne može biti veći od iznosa koji je uprihodovan isključivo od te djelatnosti. Za Grad Split, a posljedično ni za građane, odnosno porezne obveznike, ne može proizići nikakva obveza jer je člankom 10. stavkom 2. ZTD-a definirano da članovi d.o.o..-a (u ovom konkretnom slučaju to je Grad Split u odnosu na Splitsku obalu) u pravilu ne odgovaraju za obveze društva."

Direktor "Splitske obale" Dražen Delić poslao je očitovanje na tekst objavljen u Slobodnoj Dalmaciji  "SDP-ova i HDZ-ova vlast žmirile su na činjenicu da Zapadna obala nije luka, a HGS ih je zato podupirao u Vijeću i uhljebljivao kadrove u ‘Splitskoj obali‘, u kojem je navedena kronologija događanja oko Zapadne obale koja su rezultirala višemilijunskom kaznom koju je dobila spomenuta gradska tvrtka. 

Njegovo očitovanje prenosimo u cijelosti.

"U tekstu autora Saše Ljubičića pod naslovom: „SDP-ova i HDZ-ova vlast žmirile su na činjenicu da Zapadna obala nije luka, a HGS ih je zato podupirao u Vijeću i uhljebivao kadrove u „Splitskoj obali“„ iznesen je niz neistina, ali ćemo se osvrnuti na dio koji je od najvećeg značaja za građane Grada Splita, tj. porezne obveznike.

Jedan od sugovornika u tekstu dao je izjavu: „da se poštivao Zakon o pomorskom dobru i morskim lukama, i da je Gradu dodijeljena koncesija na Zapadnoj obali, prihodi bi se dijelili u omjeru 30 posto Gradu, Županiji i državi“. Naime, Zakon ne dozvoljava ovakvo nešto. Grad Split ne može vršiti komercijalnu djelatnost i upravo iz tog razloga je i osnovana tvrtka Splitska obala d.o.o., kako bi gradska tvrtka mogla sudjelovati na natječaju za koncesiju. Nadalje, ne dijeli se ukupni prihod, već stalni i promjenjivi dio koncesijske naknade koji iznosi 3 posto od ostvarenih prihoda od te djelatnosti. Isti sugovornik navodi da će kaznu platiti građani grada Splita, što je neistina, jer ukoliko Upravni sud donese odluku da se odbija tužba Splitske obale d.o.o., dio novca koji je uprihodovan od te djelatnosti Splitska obala će morati uplatiti u državni proračun. Dakle, da se nije obavljala djelatnost, taj novac ne bi ni postojao. Taj novac nije uprihodovan od građana Grada Splita, već od stranaca/jahtaša, te će od istog u slučaju naplate carinske kazne, korist imati upravo građani ove države, jer se isti uplaćuje u državni proračun. Prema tome, ništa nije dalje od istine kao što su izrečene tvrdnje daleko od činjeničnog stanja.

Ovdje se zapravo i ne radi o carinskoj kazni već se radi o razlici koncesijske naknade koju je Splitska obala d.o.o. uplaćivala u proračun SDŽ u kontroliranom razdoblju i pune koncesijske naknade koju je carinsko tijelo obračunalo Splitskoj obali kao da je obavljala djelatnost priveza bez koncesije na cijelom kopnenom i morskom dijelu obuhvata koncesije. Također, radi se i o oduzimanju ostvarenih prihoda od obavljanja ove djelatnosti navodno izvan djelatnosti koje su navedene u Ugovoru o koncesiji između Splitske obale i SDŽ, a koju je Splitska obala uprihodovala u navedenom razdoblju, umanjenoj za troškove vezane za obavljanje djelatnosti. Iz navedenog je razvidno da je iznos koji bi Splitska obala u slučaju odbijanja tužbe trebala uplatiti u državni proračun ne može biti veći od iznosa koji je uprihodovan isključivo od te djelatnosti. Za Grad Split, a posljedično ni za građane, odnosno porezne obveznike, ne može proizići nikakva obveza jer je člankom 10. stavkom 2. ZTD-a definirano da članovi d.o.o..-a (u ovom konkretnom slučaju to je Grad Split u odnosu na Splitsku obalu) u pravilu ne odgovaraju za obveze društva."

Direktor "Splitske obale" Dražen Delić poslao je očitovanje na tekst objavljen u Slobodnoj Dalmaciji  "SDP-ova i HDZ-ova vlast žmirile su na činjenicu da Zapadna obala nije luka, a HGS ih je zato podupirao u Vijeću i uhljebljivao kadrove u ‘Splitskoj obali‘, u kojem je navedena kronologija događanja oko Zapadne obale koja su rezultirala višemilijunskom kaznom koju je dobila spomenuta gradska tvrtka. 

Njegovo očitovanje prenosimo u cijelosti.
