[fulltext] => Uoči tematske sjednice GV-a o GUP-u, "Društo Marjan" je reagiralo priopćenjem na prijedlog legalizacije bespravnih građevina u Park šumi Marjan.
"Društvo Marjan smatra da legalizacija u Park šumi Marjan nije moguća te predlaže da se provede sanacija, odnosno uklapanje kuća u okoliš, bez mogućnosti ozakonjenja.
Legalizacijom bi se proširilo građevinsko područje što nije moguće temeljem Zakona o prostornom uređenju i Prostornog plana Splitsko - dalmatinske županije s obzirom da je građevinsko područje Grada Splita izgrađeno manje od 80%. Nadalje, u području Kulturnog krajolika nije moguće osnivanje novih građevinskih parcela i područja te bi i s te strane legalizacija bila nezakonit postupak.
Gradnja na zaštićenim područjima je kazneno djelo, a u Katalogu nezakonitih zgrada na području Park šume Marjan evidentirano je čak 75 nezakonitih zgrada ukupne površine 17.730 m² što, nažalost, nije konačan broj, jer su neke nezakonite zgrade iz nepoznatih razloga izostavljene s popisa, a čak 39% divljih graditelja nije niti zatražilo ozakonjenje.
Nakon legalizacije ukupna vrijednost nezakonitih kvadrata dosegla bi vrtoglave vrijednosti od gotovo pola gradskog proračuna i gradski vijećnici bi trebali dobro razmisliti treba li one koji su nepovratno betonizirali marjanske zelene površine još i nagraditi ozakonjenjem.
Postavlja se pitanje i odgovornosti Javne ustanove koja je imala pravo i obvezu sankcionirati nezakonite gradnje, ali je propustila podizati prekršajne i kaznene prijave te je takvim postupanjem zapravo poticala bespravnu gradnju. Jednaka odgovornost je i na gradskoj upravi koja godinama ne poduzima ništa na sprječavanju i sankcioniranju nezakonitosti u svojim službama i ustanovama.
Posebno skrećemo pozornost svim gradskim vijećnicima i nadležnim gradskim službama da je zahtjev Društva Marjan br. 342. za ukidanjem građevinskih područja u Park šumi Marjan, koje su na krajnje sumnjiv način ubačene u GUP 2005., uvršten u zahtjeve koji traže prenamjenu u stambenu namjenu radi legalizacije i gradnje objekata. Bez obzira radi li se o grešci ili namjeri, pokazatelj je skandaloznog načina rada nadležnih gradskih službi te zahtijevamo hitan ispravak uz obrazloženje.
Ujedno podsjećamo gradonačelnika Ivu Baldasara, da je potpisivanjem točke 1. Kodeksa za Marjan zajamčio ukidanje građevinskih područja u Park šumi Marjan.

[text] => {OCMSplitter}Uoči tematske sjednice GV-a o GUP-u, "Društo Marjan" je reagiralo priopćenjem na prijedlog legalizacije bespravnih građevina u Park šumi Marjan.
"Društvo Marjan smatra da legalizacija u Park šumi Marjan nije moguća te predlaže da se provede sanacija, odnosno uklapanje kuća u okoliš, bez mogućnosti ozakonjenja.
Legalizacijom bi se proširilo građevinsko područje što nije moguće temeljem Zakona o prostornom uređenju i Prostornog plana Splitsko - dalmatinske županije s obzirom da je građevinsko područje Grada Splita izgrađeno manje od 80%. Nadalje, u području Kulturnog krajolika nije moguće osnivanje novih građevinskih parcela i područja te bi i s te strane legalizacija bila nezakonit postupak.
Gradnja na zaštićenim područjima je kazneno djelo, a u Katalogu nezakonitih zgrada na području Park šume Marjan evidentirano je čak 75 nezakonitih zgrada ukupne površine 17.730 m² što, nažalost, nije konačan broj, jer su neke nezakonite zgrade iz nepoznatih razloga izostavljene s popisa, a čak 39% divljih graditelja nije niti zatražilo ozakonjenje.
Nakon legalizacije ukupna vrijednost nezakonitih kvadrata dosegla bi vrtoglave vrijednosti od gotovo pola gradskog proračuna i gradski vijećnici bi trebali dobro razmisliti treba li one koji su nepovratno betonizirali marjanske zelene površine još i nagraditi ozakonjenjem.
Postavlja se pitanje i odgovornosti Javne ustanove koja je imala pravo i obvezu sankcionirati nezakonite gradnje, ali je propustila podizati prekršajne i kaznene prijave te je takvim postupanjem zapravo poticala bespravnu gradnju. Jednaka odgovornost je i na gradskoj upravi koja godinama ne poduzima ništa na sprječavanju i sankcioniranju nezakonitosti u svojim službama i ustanovama.
Posebno skrećemo pozornost svim gradskim vijećnicima i nadležnim gradskim službama da je zahtjev Društva Marjan br. 342. za ukidanjem građevinskih područja u Park šumi Marjan, koje su na krajnje sumnjiv način ubačene u GUP 2005., uvršten u zahtjeve koji traže prenamjenu u stambenu namjenu radi legalizacije i gradnje objekata. Bez obzira radi li se o grešci ili namjeri, pokazatelj je skandaloznog načina rada nadležnih gradskih službi te zahtijevamo hitan ispravak uz obrazloženje.
Ujedno podsjećamo gradonačelnika Ivu Baldasara, da je potpisivanjem točke 1. Kodeksa za Marjan zajamčio ukidanje građevinskih područja u Park šumi Marjan.
