Općinsko državno odvjetništvo je pred Uredom državne uprave u Splitsko-dalmatinskoj županiji 2009. godine zatražilo pokretanje postupka da se utvrdi da je država vlasnik hotela “Bellevue”, kao i poslovnih prostora i stanova na adresi Bana Jelačića 4, a zbog čega je u srijedu održano prvo ročište.

Odvjetništvo se poziva na članak Zakona o naknadi za imovinu oduzetu za vrijeme jugoslavenske komunističke vladavine, koji govori da država stječe pravo vlasništva nad oduzetom imovinom za koju bivši vlasnici nisu podnijeli zahtjev za povrat.

Protiv države i naroda

Hotel i druge nekretnine bile su u vlasništvu dioničkog društva “Prve pučke dalmatinske banke”, čiji je direktor Ljubomir Mirković na Okružnom sudu u Splitu proglašen krivim za djelo protiv države i naroda zbog poslovnih veza s talijanskim bankarskim institucijama.

Prema presudi, za vrijeme rata, 1941. godine, uspostavio je poslovnu suradnju s neprijateljem, s Talijanskim novčarskim zavodom. Presuda iz studenog 1945. godine glasila je: “konfiskacija cjelokupne imovine ‘Pučke štedionice’”.

Tako su hotel “Bellevue”, dionice “Jadranske plovidbe” i jugoslavenskog “Lloyda”, mesnice, stanovi i računi “Pučke dalmatinske banke” postali općenarodna imovina.

Narodni odbor Grada Splita 1951. godine donio je rješenje o osnutku Gradskog hotelskog poduzeća “Hotel Bellevue”, te se od tada pravnim slijedom prenosilo na Grad.

Hotel je ušao u elaborat o privatizaciji “Laurusa”, zbog čega je ta tvrtka koja se nalazi u stečaju zbog utvrđivanja prava vlasništva tužila Grad, a parnica se već godinama vodi na Trgovačkom sudu.

No, nedavno je Grad dao mig državi da bi se ona trebala uključiti u parnicu jer je riječ o konfisciranoj imovini. Tada je država reagirala pokrenuvši postupak pred Uredom državne uprave.

Kada Grad u roku od 15 dana dostavi svu dokumentaciju vezanu uz oduzetu imovinu, jer su stanove na adresi Bana Jelačića otkupile fizičke osobe, pravnica koja vodi predmet izići će na očevid da bi utvrdila koja je sve imovina predmet spora.

Općinsko državno odvjetništvo je pred Uredom državne uprave u Splitsko-dalmatinskoj županiji 2009. godine zatražilo pokretanje postupka da se utvrdi da je država vlasnik hotela “Bellevue”, kao i poslovnih prostora i stanova na adresi Bana Jelačića 4, a zbog čega je u srijedu održano prvo ročište.

Odvjetništvo se poziva na članak Zakona o naknadi za imovinu oduzetu za vrijeme jugoslavenske komunističke vladavine, koji govori da država stječe pravo vlasništva nad oduzetom imovinom za koju bivši vlasnici nisu podnijeli zahtjev za povrat.

Protiv države i naroda

Hotel i druge nekretnine bile su u vlasništvu dioničkog društva “Prve pučke dalmatinske banke”, čiji je direktor Ljubomir Mirković na Okružnom sudu u Splitu proglašen krivim za djelo protiv države i naroda zbog poslovnih veza s talijanskim bankarskim institucijama.

Prema presudi, za vrijeme rata, 1941. godine, uspostavio je poslovnu suradnju s neprijateljem, s Talijanskim novčarskim zavodom. Presuda iz studenog 1945. godine glasila je: “konfiskacija cjelokupne imovine ‘Pučke štedionice’”.

Tako su hotel “Bellevue”, dionice “Jadranske plovidbe” i jugoslavenskog “Lloyda”, mesnice, stanovi i računi “Pučke dalmatinske banke” postali općenarodna imovina.

Narodni odbor Grada Splita 1951. godine donio je rješenje o osnutku Gradskog hotelskog poduzeća “Hotel Bellevue”, te se od tada pravnim slijedom prenosilo na Grad.

Hotel je ušao u elaborat o privatizaciji “Laurusa”, zbog čega je ta tvrtka koja se nalazi u stečaju zbog utvrđivanja prava vlasništva tužila Grad, a parnica se već godinama vodi na Trgovačkom sudu.

No, nedavno je Grad dao mig državi da bi se ona trebala uključiti u parnicu jer je riječ o konfisciranoj imovini. Tada je država reagirala pokrenuvši postupak pred Uredom državne uprave.

Kada Grad u roku od 15 dana dostavi svu dokumentaciju vezanu uz oduzetu imovinu, jer su stanove na adresi Bana Jelačića otkupile fizičke osobe, pravnica koja vodi predmet izići će na očevid da bi utvrdila koja je sve imovina predmet spora.
