Država je krenula u rješavanje upisa pomorskog dobra na Prvoj vodi na Marjanu. 

Tužila je, naime, Grad Split koji se tamo vodi kao vlasnik 2445 kvadrata i 31. kolovoza 2021. godine država je dobila nepravomoćnu presudu u svoju, odnosno u javnu korist.

Republika Hrvatska je također, u srpnju ove godine, tužila i (ugašenu) tvrtku "Latebra", koju je osnovala Fani Kerum, supruga Željka Keruma, radi brisanja njezina prava vlasništva na 1346 kvadrata na Prvoj vodi.

– Pomorsko dobro ne može i ne smije biti ničije vlasništvo – napisala je u obrazloženju presude protiv Grada Ivana Madunić, sutkinja Trgovačkog suda u Splitu.

U obrazloženju presude također navodi:

– Zakonom je propisano da Republika Hrvatska može poduzimati sve radnje radi zaštite pomorskog dobra, kao i podnositi tužbe radi utvrđivanja pomorskog dobra, naknade štete ili stjecanja bez osnove protiv osoba koje gospodarski koriste ili su koristile pomorsko dobro bez koncesije ili koncesijskog odobrenja i time ostvarivale određenu korist ili svojim radnjama uzrokovale štetu.

Sutkinja Madunić također se u predmetu protiv Grada osvrnula na to da se u praksi često nailazi na veliki broj upisa prava vlasništva na česticama uz more i blizu mora u korist općina i gradova. Razlog tomu je što su se pravni sljednici, navela je dalje, pozivom na propise po kojima se provela pretvorba i dioba bivših općina i gradova, upisivali kao vlasnici na nespornom pomorskom dobu.

Grad Split borio se protiv upisa pomorskog dobra na svojih 2445 kvadrata i žalio se na apsolutnu nenadležnost Trgovačkog suda u tom predmetu.

Upis pomorskog dobra na 1346 kvadrata koje se vode kao vlasništvo "Latebre" neće tako lako pustiti ni stečajni upravitelj Damir Vrca, koji vodi stečajni postupak nad imovinom na Marjanu koja je u zemljišnim knjigama upisana na tvrtku "Latebra", koja je zbog višegodišnjeg nepodnošenja financijskih izvještaja izbrisana iz sudskog registra.

Da objasnimo, tvrtka "Latebra" više ne postoji, pa se stečaj, radi naplate potraživanja "B2 Kapitala", provodi nad njezinom imovinom.

Stečajni upravitelj Vrca je u svom odgovoru na tužbu, među ostalim, naveo:

– Jasno je da nadležna tijela nisu izvršila potrebne radnje u vezi evidencije pomorskog dobra (ako se u ovom slučaju uopće i radi o pomorskom dobru), iako je Vladina uredba kojom im se to nalaže stara 14 godina!

– Rezultat je da do danas pomorsko dobro nije upisano, ili barem zabilježeno, u vlasničke knjige, da je narušeno povjerenje u javne knjige, a što je u izravnoj suprotnosti s pozitivnim zakonima Republike Hrvatske i u suprotnosti s pravnom stečevinom EU-a!

U tom kontekstu napomenimo da je predmetne kvadrate Željko Kerum kupio kao privatno vlasništvo, a ne kao javno dobro. Upitno je bi li se tu moglo govoriti o tome da je bivši poteštat time oštećen, s obzirom na to da je to zemljište uspio založiti za dobivanje kredita, koji onda nije otplatio.

Država je ranije pokušala upisati pomorsko dobro temeljem Uredbe Vlade RH, ali je zemljišnik Općinskog suda u Splitu to odbio provesti.

Preostali dio "Latebrinih" kvadrata koji ne spadaju u pomorsko dobro prodat će se sudskim putem kako bi se namirilo 14,2 milijuna kuna teško potraživanje "B2 Kapitala".

Tužila je, naime, Grad Split koji se tamo vodi kao vlasnik 2445 kvadrata i 31. kolovoza 2021. godine država je dobila nepravomoćnu presudu u svoju, odnosno u javnu korist.

Republika Hrvatska je također, u srpnju ove godine, tužila i (ugašenu) tvrtku "Latebra", koju je osnovala Fani Kerum, supruga Željka Keruma, radi brisanja njezina prava vlasništva na 1346 kvadrata na Prvoj vodi.

– Pomorsko dobro ne može i ne smije biti ničije vlasništvo – napisala je u obrazloženju presude protiv Grada Ivana Madunić, sutkinja Trgovačkog suda u Splitu.

U obrazloženju presude također navodi:

– Zakonom je propisano da Republika Hrvatska može poduzimati sve radnje radi zaštite pomorskog dobra, kao i podnositi tužbe radi utvrđivanja pomorskog dobra, naknade štete ili stjecanja bez osnove protiv osoba koje gospodarski koriste ili su koristile pomorsko dobro bez koncesije ili koncesijskog odobrenja i time ostvarivale određenu korist ili svojim radnjama uzrokovale štetu.

Sutkinja Madunić također se u predmetu protiv Grada osvrnula na to da se u praksi često nailazi na veliki broj upisa prava vlasništva na česticama uz more i blizu mora u korist općina i gradova. Razlog tomu je što su se pravni sljednici, navela je dalje, pozivom na propise po kojima se provela pretvorba i dioba bivših općina i gradova, upisivali kao vlasnici na nespornom pomorskom dobu.

Grad Split borio se protiv upisa pomorskog dobra na svojih 2445 kvadrata i žalio se na apsolutnu nenadležnost Trgovačkog suda u tom predmetu.

Upis pomorskog dobra na 1346 kvadrata koje se vode kao vlasništvo "Latebre" neće tako lako pustiti ni stečajni upravitelj Damir Vrca, koji vodi stečajni postupak nad imovinom na Marjanu koja je u zemljišnim knjigama upisana na tvrtku "Latebra", koja je zbog višegodišnjeg nepodnošenja financijskih izvještaja izbrisana iz sudskog registra.

Da objasnimo, tvrtka "Latebra" više ne postoji, pa se stečaj, radi naplate potraživanja "B2 Kapitala", provodi nad njezinom imovinom.

Stečajni upravitelj Vrca je u svom odgovoru na tužbu, među ostalim, naveo:

– Jasno je da nadležna tijela nisu izvršila potrebne radnje u vezi evidencije pomorskog dobra (ako se u ovom slučaju uopće i radi o pomorskom dobru), iako je Vladina uredba kojom im se to nalaže stara 14 godina!

– Rezultat je da do danas pomorsko dobro nije upisano, ili barem zabilježeno, u vlasničke knjige, da je narušeno povjerenje u javne knjige, a što je u izravnoj suprotnosti s pozitivnim zakonima Republike Hrvatske i u suprotnosti s pravnom stečevinom EU-a!

U tom kontekstu napomenimo da je predmetne kvadrate Željko Kerum kupio kao privatno vlasništvo, a ne kao javno dobro. Upitno je bi li se tu moglo govoriti o tome da je bivši poteštat time oštećen, s obzirom na to da je to zemljište uspio založiti za dobivanje kredita, koji onda nije otplatio.

Država je ranije pokušala upisati pomorsko dobro temeljem Uredbe Vlade RH, ali je zemljišnik Općinskog suda u Splitu to odbio provesti.

Preostali dio "Latebrinih" kvadrata koji ne spadaju u pomorsko dobro prodat će se sudskim putem kako bi se namirilo 14,2 milijuna kuna teško potraživanje "B2 Kapitala".
