Grad Split pravomoćno je dobio još jedan spor protiv tvrtke "Elanija" u kojem je ova tvrtka tražila nadoknadu štete u iznosu od 25.160.000,00 kuna sa zateznom kamatom koja na taj iznos teče od 1. studenoga 2017. do isplate radi izmakle koristi zbog nemogućnosti realizacije građevinskih projekata na području Žnjana (oznake M13-1 i M13-2).

Prema navodima tužitelja šteta je nastala jer je Grad Split suprotno preuzetim obvezama iz sporazuma kojeg su stranke zaključile 26. svibnja 2009. i Programa izgradnje komunalne infrastrukture odustao od zahtjeva za izvlaštenje objekta koji ulazi u obuhvat Vrsarske ulice u Splitu.

U postupku pred Trgovačkim sudom, Grad Split je dokazao kako je u cijelosti ispunio obveze koje je preuzeo sporazumom od 26. svibnja 2009. te je utvrđeno kako nije bilo protupravnog postupanja Grada Splita, posebno jer je Grad Split ispunio preuzete obveze u odnosu na Vrsarsku ulicu, koja se odnosi na tužiteljev projekt oznake M13-2.

Isto tako, u postupku je utvrđeno kako tužitelj nije dokazao svoju aktivnu legitimaciju, odnosno da bi bio investitor i za građevinu oznake M13-1 kako je naveo u svojoj tužbi od 21. svibnja 2019.

Ova presuda Trgovačkog suda je od 8. ožujka 2021., a postala je pravomoćna 17. ožujka 2021.

Podsjetimo, Grad Split je nedavno pravomoćno dobio još jedan spor protiv "Elanije" u predmetu Vila Rosina, kada je Vrhovni sud Republike Hrvatske odbacio zahtjev ove tvrtke za revizijom protiv presude Visokog trgovačkog suda iz lipnja prošle godine, u kojoj je preinačena prvostupanjska presuda Trgovačkog suda u Splitu i odbijen tužbeni zahtjev "Elanije" za iznos od 24.250.000,00 kn sa zakonskom zateznom kamatom od 2016. godine na štetu Grada Splita.

Grad Split pravomoćno je dobio još jedan spor protiv tvrtke "Elanija" u kojem je ova tvrtka tražila nadoknadu štete u iznosu od 25.160.000,00 kuna sa zateznom kamatom koja na taj iznos teče od 1. studenoga 2017. do isplate radi izmakle koristi zbog nemogućnosti realizacije građevinskih projekata na području Žnjana (oznake M13-1 i M13-2).

Prema navodima tužitelja šteta je nastala jer je Grad Split suprotno preuzetim obvezama iz sporazuma kojeg su stranke zaključile 26. svibnja 2009. i Programa izgradnje komunalne infrastrukture odustao od zahtjeva za izvlaštenje objekta koji ulazi u obuhvat Vrsarske ulice u Splitu.

U postupku pred Trgovačkim sudom, Grad Split je dokazao kako je u cijelosti ispunio obveze koje je preuzeo sporazumom od 26. svibnja 2009. te je utvrđeno kako nije bilo protupravnog postupanja Grada Splita, posebno jer je Grad Split ispunio preuzete obveze u odnosu na Vrsarsku ulicu, koja se odnosi na tužiteljev projekt oznake M13-2.

Isto tako, u postupku je utvrđeno kako tužitelj nije dokazao svoju aktivnu legitimaciju, odnosno da bi bio investitor i za građevinu oznake M13-1 kako je naveo u svojoj tužbi od 21. svibnja 2019.

Ova presuda Trgovačkog suda je od 8. ožujka 2021., a postala je pravomoćna 17. ožujka 2021.

Podsjetimo, Grad Split je nedavno pravomoćno dobio još jedan spor protiv "Elanije" u predmetu Vila Rosina, kada je Vrhovni sud Republike Hrvatske odbacio zahtjev ove tvrtke za revizijom protiv presude Visokog trgovačkog suda iz lipnja prošle godine, u kojoj je preinačena prvostupanjska presuda Trgovačkog suda u Splitu i odbijen tužbeni zahtjev "Elanije" za iznos od 24.250.000,00 kn sa zakonskom zateznom kamatom od 2016. godine na štetu Grada Splita.
