Nekadašnja direktorica Autobusnog kolodvora Split toj firmi mora vratiti više od pola milijuna kuna. Nepravomoćno je tako presudio Trgovački sud u Splitu dva dana prije Božića.

Ako presuda postane pravomoćna, nekadašnja prva žena kolodvora morat će, konkretno, platiti glavnicu od 543.599 kuna, ali i zakonske zatezne kamate koje teku od 2003. godine pa do isplate.

Autobusni kolodvor je tražio još veći iznos, ali nije uspio dokazati sve što joj je htio staviti na teret.

U tužbi koju je podnio u ožujku 2005. godine, navodi da je tužena bila jedini član njegove Uprave od siječnja 1996. do siječnja 2002., te je od veljače 1997. godine imala menadžerski ugovor koji joj je definirao plaću od 4.500 DEM u kunskoj protuvrijednosti i pravo na naknadu korištenja privatnog automobila u službene svrhe.

No, tvrtka tvrdi da si je direktorica isplaćivala plaću veću od ugovorene, te da si je neosnovano isplaćivala stimulaciju.

Svoje tvrdnje argumentira time da je revizija poslovanja tvrtke za razdoblje od 1999. do 2001. godine pokazala da si je direktorica za plaće neosnovano isplatila 152.072 kune, te da si je na teret novčanih sredstava tvrtke neosnovano uplatila 58.200 kuna za premiju životnog osiguranja.

Autobusni kolodvor je također htio da mu bivša direktorica plati što je državi priznala tužbu da su veliki dio nekretnina na kojima je ta tvrtka bila nositelj prava korištenja, a koje su nekretnine u pretvorbi te tvrtke uvrštene u vrijednost društvenog kapitala, zapravo pomorsko dobro.

Naime, Općinski sud u Splitu je 1997. godine donio presudu temeljenu na njenom priznanju da su predmetne nekretnine, među kojima i upravna zgrada kolodvora sa zemljištem, pomorsko dobro. S obzirom na takvu presudu, tadašnji Hrvatski fond za privatizaciju je po službenoj dužnosti proveo obnovu postupka pretvorbe ranijeg Društvenog poduzeća Autobusni kolodvor tako da je iz vrijednosti društvenog kapitala tvrtke isključio navedene nekretnine, te je vrijednost društvenog kapitala smanjena za 773.400 DEM.

Autobusni kolodvor je tvrdio da je zbog toga trpio štetu i time što navedene nekretnine nisu njegovo vlasništvo, pa ne može izvršiti adaptaciju prostora, te uvesti popratne sadržaje kao što je ambulanta, sve kako bi ishodio višu kategoriju autobusnog kolodvora.

Zatim je, tvrdi Autobusni kolodvor u tužbi, bez zakonskih valjanih razloga i pored izričitog protivljenja radničkog vijeća, dala otkaze nekolicini zaposlenika, nakon čega su oni sudski pobili odluke o otkazu ugovora o radu, te im je tvrtka iz osnova naknade plaće zbog nezakonitih otkaza isplatila 2,1 milijun kuna.

Protiv nekadašnje direktorice 2006. godine je Županijsko državno odvjetništvo podiglo optužnicu da je pribavila nepripadajuću korist na štetu Autobusnog kolodvora kada je računovodstvu naložila da joj isplate stimulaciju bez prethodno odobrenih kriterija kojima bi se utvrdio njen uspjeh u radu i bez odobrenja Nadzornog odbora.

Županijski sud u Split je potom donio oslobađajuću presudu, koja je postala pravomoćna u srpnju 2009. godine, jer je utvrđeno da si nekadašnja direktorica ipak nije pribavila nepripadajuću imovinsku korist.

Na zadnjem ročištu na Trgovačkom sudu Autobusni kolodvor je povukao dio tužbenog zahtjeva za naknadu štete koja se odnosila na priznavanje tužbe države da je njegova imovina pomorsko dobro. Također, u zastara je otišlo potraživanje naknade štete koju je tvrtka isplatila za dvoje nezakonito otpuštenih radnika.

Na kraju je protiv nekadašnje direktorice Trgovački sud donio presudu da Autobusnom kolodvoru mora isplatiti naknadu štetu koja je nastala zbog isplate po presudama u korist jednog od otpuštenih radnika.

Nekadašnja direktorica Autobusnog kolodvora Split toj firmi mora vratiti više od pola milijuna kuna. Nepravomoćno je tako presudio Trgovački sud u Splitu dva dana prije Božića.

Ako presuda postane pravomoćna, nekadašnja prva žena kolodvora morat će, konkretno, platiti glavnicu od 543.599 kuna, ali i zakonske zatezne kamate koje teku od 2003. godine pa do isplate.

Autobusni kolodvor je tražio još veći iznos, ali nije uspio dokazati sve što joj je htio staviti na teret.

U tužbi koju je podnio u ožujku 2005. godine, navodi da je tužena bila jedini član njegove Uprave od siječnja 1996. do siječnja 2002., te je od veljače 1997. godine imala menadžerski ugovor koji joj je definirao plaću od 4.500 DEM u kunskoj protuvrijednosti i pravo na naknadu korištenja privatnog automobila u službene svrhe.

No, tvrtka tvrdi da si je direktorica isplaćivala plaću veću od ugovorene, te da si je neosnovano isplaćivala stimulaciju.

Svoje tvrdnje argumentira time da je revizija poslovanja tvrtke za razdoblje od 1999. do 2001. godine pokazala da si je direktorica za plaće neosnovano isplatila 152.072 kune, te da si je na teret novčanih sredstava tvrtke neosnovano uplatila 58.200 kuna za premiju životnog osiguranja.

Autobusni kolodvor je također htio da mu bivša direktorica plati što je državi priznala tužbu da su veliki dio nekretnina na kojima je ta tvrtka bila nositelj prava korištenja, a koje su nekretnine u pretvorbi te tvrtke uvrštene u vrijednost društvenog kapitala, zapravo pomorsko dobro.

Naime, Općinski sud u Splitu je 1997. godine donio presudu temeljenu na njenom priznanju da su predmetne nekretnine, među kojima i upravna zgrada kolodvora sa zemljištem, pomorsko dobro. S obzirom na takvu presudu, tadašnji Hrvatski fond za privatizaciju je po službenoj dužnosti proveo obnovu postupka pretvorbe ranijeg Društvenog poduzeća Autobusni kolodvor tako da je iz vrijednosti društvenog kapitala tvrtke isključio navedene nekretnine, te je vrijednost društvenog kapitala smanjena za 773.400 DEM.

Autobusni kolodvor je tvrdio da je zbog toga trpio štetu i time što navedene nekretnine nisu njegovo vlasništvo, pa ne može izvršiti adaptaciju prostora, te uvesti popratne sadržaje kao što je ambulanta, sve kako bi ishodio višu kategoriju autobusnog kolodvora.

Zatim je, tvrdi Autobusni kolodvor u tužbi, bez zakonskih valjanih razloga i pored izričitog protivljenja radničkog vijeća, dala otkaze nekolicini zaposlenika, nakon čega su oni sudski pobili odluke o otkazu ugovora o radu, te im je tvrtka iz osnova naknade plaće zbog nezakonitih otkaza isplatila 2,1 milijun kuna.

Protiv nekadašnje direktorice 2006. godine je Županijsko državno odvjetništvo podiglo optužnicu da je pribavila nepripadajuću korist na štetu Autobusnog kolodvora kada je računovodstvu naložila da joj isplate stimulaciju bez prethodno odobrenih kriterija kojima bi se utvrdio njen uspjeh u radu i bez odobrenja Nadzornog odbora.

Županijski sud u Split je potom donio oslobađajuću presudu, koja je postala pravomoćna u srpnju 2009. godine, jer je utvrđeno da si nekadašnja direktorica ipak nije pribavila nepripadajuću imovinsku korist.

Na zadnjem ročištu na Trgovačkom sudu Autobusni kolodvor je povukao dio tužbenog zahtjeva za naknadu štete koja se odnosila na priznavanje tužbe države da je njegova imovina pomorsko dobro. Također, u zastara je otišlo potraživanje naknade štete koju je tvrtka isplatila za dvoje nezakonito otpuštenih radnika.

Na kraju je protiv nekadašnje direktorice Trgovački sud donio presudu da Autobusnom kolodvoru mora isplatiti naknadu štetu koja je nastala zbog isplate po presudama u korist jednog od otpuštenih radnika.
