Čudnovat slučaj građanina Vladimira Matijanića, koji je za rezultat imao građaninovu smrt o kojoj nacija već danima ne prestaje razglabati, otvorio je brojna pitanja.

Jedno od važnijih, ako dopustimo mogućnost da nakon ičije smrti išta više (p)ostaje važno, jest do koje mjere u javnost smiju izlaziti podaci o samome slučaju. Odnosno, što javnost smije znati, a što ne smije. Gdje je granica, i postoji li uopće, kada su u pitanju podaci o nečijem zdravstvenom kartonu, o načinu njegova liječenja i osobama koje ga liječe. Bez obzira na razinu savjesnosti kojom to čine.

Zakon brine da detalji o nečijem privatnom životu ne iziđu u javnost. Ili bi tako barem trebalo biti. Pa tako i građanin Vladimir Matijanić ima pravo umrijeti, a da nitko o tome nema pojma. Da nitko, na primjer, ne zna kada je prvi put došao na Hitnu, tko ga je primio, kako ga je pregledao, što mu je rekao, kada je opet zvao Hitnu, tko mu se javio, tko mu nije došao, kada je opet zvao Hitnu, tko mu je došao, što mu je dao, što mu nije dao, zašto je otišao, kada je opet zvao Hitnu, tko je došao, što je učinio, kako ga je oživljavao, koliko dugo, tko ga je mrtvog u stanu ostavio...

Za sve to građaninu Vladimiru Matijaniću zajamčena je šutnja. Paragrafirana omerta. Štoviše, i njemu samome zajamčena je anonimnost. Da nitko nikad ne sazna tko je, zašto, kako, kada i gdje zauzdan u daljnjem življenju. I javnost se, da se razumijemo, nema tu što miješati. Građaninova prava i u smrti se moraju poštivati.

Liječnici bi, recimo, vrlo rado otkrili tko je, zašto, kako, kada i gdje zauzdavao građanina Vladimira Matijanića, ali ne smiju. Zakon im ne dopušta. Ni domaći, a bogme ni onaj europski kroz famoznu opću uredbu o zaštiti podataka, poznatiju kao GDPR (General Data Protection Regulation).

Problem je tek ako građanin ima obitelj ili životnog partnera koji želi da se sve to sazna. A građanin Vladimir Matijanić ima. Njih šutnja ne obavezuje. Dapače.

Ako pak pacijent ne preživi liječenje, kao što ga nije preživio pacijent Vladimir Matijanić, onda to pravo prelazi na njegovu obitelj i životnoga partnera. A kad oni u javnost iziđu s podacima koji su do jučer smatrani osobnom i liječničkom tajnom, onda ih i javnost ima pravo koristiti. Odnosno propitkivati.

Čudnovat slučaj građanina Vladimira Matijanića, koji je za rezultat imao građaninovu smrt o kojoj nacija već danima ne prestaje razglabati, otvorio je brojna pitanja.

Jedno od važnijih, ako dopustimo mogućnost da nakon ičije smrti išta više (p)ostaje važno, jest do koje mjere u javnost smiju izlaziti podaci o samome slučaju. Odnosno, što javnost smije znati, a što ne smije. Gdje je granica, i postoji li uopće, kada su u pitanju podaci o nečijem zdravstvenom kartonu, o načinu njegova liječenja i osobama koje ga liječe. Bez obzira na razinu savjesnosti kojom to čine.

Zakon brine da detalji o nečijem privatnom životu ne iziđu u javnost. Ili bi tako barem trebalo biti. Pa tako i građanin Vladimir Matijanić ima pravo umrijeti, a da nitko o tome nema pojma. Da nitko, na primjer, ne zna kada je prvi put došao na Hitnu, tko ga je primio, kako ga je pregledao, što mu je rekao, kada je opet zvao Hitnu, tko mu se javio, tko mu nije došao, kada je opet zvao Hitnu, tko mu je došao, što mu je dao, što mu nije dao, zašto je otišao, kada je opet zvao Hitnu, tko je došao, što je učinio, kako ga je oživljavao, koliko dugo, tko ga je mrtvog u stanu ostavio...

Za sve to građaninu Vladimiru Matijaniću zajamčena je šutnja. Paragrafirana omerta. Štoviše, i njemu samome zajamčena je anonimnost. Da nitko nikad ne sazna tko je, zašto, kako, kada i gdje zauzdan u daljnjem življenju. I javnost se, da se razumijemo, nema tu što miješati. Građaninova prava i u smrti se moraju poštivati.

Liječnici bi, recimo, vrlo rado otkrili tko je, zašto, kako, kada i gdje zauzdavao građanina Vladimira Matijanića, ali ne smiju. Zakon im ne dopušta. Ni domaći, a bogme ni onaj europski kroz famoznu opću uredbu o zaštiti podataka, poznatiju kao GDPR (General Data Protection Regulation).

Čudnovat slučaj građanina Vladimira Matijanića, koji je za rezultat imao građaninovu smrt o kojoj nacija već danima ne prestaje razglabati, otvorio je brojna pitanja.

Jedno od važnijih, ako dopustimo mogućnost da nakon ičije smrti išta više (p)ostaje važno, jest do koje mjere u javnost smiju izlaziti podaci o samome slučaju. Odnosno, što javnost smije znati, a što ne smije. Gdje je granica, i postoji li uopće, kada su u pitanju podaci o nečijem zdravstvenom kartonu, o načinu njegova liječenja i osobama koje ga liječe. Bez obzira na razinu savjesnosti kojom to čine.

Zakon brine da detalji o nečijem privatnom životu ne iziđu u javnost. Ili bi tako barem trebalo biti. Pa tako i građanin Vladimir Matijanić ima pravo umrijeti, a da nitko o tome nema pojma. Da nitko, na pri...
