Grad Split uspio je u sudskom sporu i Visoki trgovački sud Republike Hrvatske kao drugostupanjski sud preinačio je prvostupanjsku presudu Trgovačkog suda u Splitu te odbio tužbeni zahtjev Elanije d.o.o. za iznos od 24.250.000,00 kn sa zakonskom zateznom kamatom od 2016. godine.

Priopćili su to iz Ureda Grada Splita, a iza tvrtke Elanija stoji poduzetnica Marina Wallner.

Podsjećaju da je u srpnju 2017. godine Grad Split je prvostupanjskom presudom izgubio spor vrijedan više od 25 milijuna kuna kada je tvrtka Elanija d.o.o tužila Grad radi izgubljene dobiti zbog ukidanja dijela građevinske dozvole 2015. godine, čime je onemogućeno etažiranje objekta Vile Rosina (Vila Matić).

Grad Split potom je izjavio žalbu, pozivajući se kako je dokazni postupak nepotpun te da su svi dokazi predloženi od Grada Splita odbijeni, a da nikakvom radnjom Grada nije nastala stvarna šteta niti Elaniji d.o.o koja je tužitelj, ni tvrtki Vila Rosina d.o.o koja je samostalna pravna osoba i investitor, niti tvrtki Tommy d.o.o koja je 2016. godine otkupila potraživanja banke i postala vlasnikom objekta.

- Grad Split u svojoj je žalbi naveo kako je, donošenje izmijenjenog djelomičnog rješenja kojim se ispravljala pogreška iz ranijeg djelomičnog rješenja o dopustivost etažiranja hotelskog objekta Vila Rosini, sud pogrešno interpretirao kao privatni interes Grada, koji ga kao javno-pravno tijelo nema.

Djelomičnim rješenjem o gradnji iz 2010. ispravljala se pogreška donesena ranijim djelomičnim rješenjem budući je ono suprotno Generalnom urbanističkom planu omogućavalo investitoru  etažiranje i apartmanizaciju hotelskog objekta na toj lokaciji. Štoviše, kada je uočena pogreška u djelomičnom rješenju, Grad Split ju je bio dužan ispraviti, što je i učinio poništavanje djelomičnog upravnog rješenja koje je u suprotnosti s materijalnim zakonom, kako je to i propisano Zakonom o općem upravnom postupku - javljaju iz Banovine.

Tužitelj, tvrtka Elanija d.o.o. kao profesionalni graditelj znao je da je etažiranje hotela u tom području zabranjeno, a što im je potvrđeno i mišljenjem Ministarstva graditeljstva u kojem je navedeno da na predmetnoj lokaciji nije moguće etažiranje turističkih apartmana na hotelskom objektu.

Slijedom svega toga, zapreka za realizaciju projekta nije bilo jer je investitor od 2010. godine, za cijelo vrijeme trajanja upravnog postupka, a potom i upravnog spora, posjedovao pravomoćnu građevinsku dozvolu kojom mu se sukladno Zakonu o gradnji omogućavala sama izgradnja, točnije rekonstrukcija, dogradnja sklopa Hotela Vile Rosina.

Naknadne izmjene radi kojih je tekao upravni postupak, kasnije i spor ne odnose se na izmjenu kojom se dovodi u pitanje sama gradnja, već (ne)dopustivosti etažiranja apartmana u sklopu Hotela Vile Rosini. Dakle bez obzira na pitanje etažiranja postojale su zakonske pretpostavke za gradnju kojoj samoinicijativno investitor nije pristupio jer nije bio solventan.

Visoki trgovački sud Republike Hrvatske tako je kao drugostupanjski sud preinačio odluku, odnosno sam odlučio o predmetu spora jer je prvostupanjski pogrešno presudio. Odbio je tužbeni zahtjev u cijelosti budući da je utvrdio kako je Grad svojim radnjama kroz prethodni upravni postupak legitimno postupao, a ne “nezakonito“ kako je to protivna stranka u postupku prikazivala i što je prvostupanjski pogrešno prihvatio.

Tužitelju, Elaniji d.o.o., drugostupanjskom presudom naložena je nadoknada sudskih pristojbi Gradu Splitu u iznosu od 15 tisuća kuna.

Grad Split uspio je u sudskom sporu i Visoki trgovački sud Republike Hrvatske kao drugostupanjski sud preinačio je prvostupanjsku presudu Trgovačkog suda u Splitu te odbio tužbeni zahtjev Elanije d.o.o. za iznos od 24.250.000,00 kn sa zakonskom zateznom kamatom od 2016. godine.

Priopćili su to iz Ureda Grada Splita, a iza tvrtke Elanija stoji poduzetnica Marina Wallner.

Podsjećaju da je u srpnju 2017. godine Grad Split je prvostupanjskom presudom izgubio spor vrijedan više od 25 milijuna kuna kada je tvrtka Elanija d.o.o tužila Grad radi izgubljene dobiti zbog ukidanja dijela građevinske dozvole 2015. godine, čime je onemogućeno etažiranje objekta Vile Rosina (Vila Matić).

Grad Split potom je izjavio žalbu, pozivajući se kako je dokazni postupak nepotpun te da su svi dokazi predloženi od Grada Splita odbijeni, a da nikakvom radnjom Grada nije nastala stvarna šteta niti Elaniji d.o.o koja je tužitelj, ni tvrtki Vila Rosina d.o.o koja je samostalna pravna osoba i investitor, niti tvrtki Tommy d.o.o koja je 2016. godine otkupila potraživanja banke i postala vlasnikom objekta.

- Grad Split u svojoj je žalbi naveo kako je, donošenje izmijenjenog djelomičnog rješenja kojim se ispravljala pogreška iz ranijeg djelomičnog rješenja o dopustivost etažiranja hotelskog objekta Vila Rosini, sud pogrešno interpretirao kao privatni interes Grada, koji ga kao javno-pravno tijelo nema.

Djelomičnim rješenjem o gradnji iz 2010. ispravljala se pogreška donesena ranijim djelomičnim rješenjem budući je ono suprotno Generalnom urbanističkom planu omogućavalo investitoru  etažiranje i apartmanizaciju hotelskog objekta na toj lokaciji. Štoviše, kada je uočena pogreška u djelomičnom rješenju, Grad Split ju je bio dužan ispraviti, što je i učinio poništavanje djelomičnog upravnog rješenja koje je u suprotnosti s materijalnim zakonom, kako je to i propisano Zakonom o općem upravnom postupku - javljaju iz Banovine.

Tužitelj, tvrtka Elanija d.o.o. kao profesionalni graditelj znao je da je etažiranje hotela u tom području zabranjeno, a što im je potvrđeno i mišljenjem Ministarstva graditeljstva u kojem je navedeno da na predmetnoj lokaciji nije moguće etažiranje turističkih apartmana na hotelskom objektu.

Slijedom svega toga, zapreka za realizaciju projekta nije bilo jer je investitor od 2010. godine, za cijelo vrijeme trajanja upravnog postupka, a potom i upravnog spora, posjedovao pravomoćnu građevinsku dozvolu kojom mu se sukladno Zakonu o gradnji omogućavala sama izgradnja, točnije rekonstrukcija, dogradnja sklopa Hotela Vile Rosina.

Naknadne izmjene radi kojih je tekao upravni postupak, kasnije i spor ne odnose se na izmjenu kojom se dovodi u pitanje sama gradnja, već (ne)dopustivosti etažiranja apartmana u sklopu Hotela Vile Rosini. Dakle bez obzira na pitanje etažiranja postojale su zakonske pretpostavke za gradnju kojoj samoinicijativno investitor nije pristupio jer nije bio solventan.

Visoki trgovački sud Republike Hrvatske tako je kao drugostupanjski sud preinačio odluku, odnosno sam odlučio o predmetu spora jer je prvostupanjski pogrešno presudio. Odbio je tužbeni zahtjev u cijelosti budući da je utvrdio kako je Grad svojim radnjama kroz prethodni upravni postupak legitimno postupao, a ne “nezakonito“ kako je to protivna stranka u postupku prikazivala i što je prvostupanjski pogrešno prihvatio.

Tužitelju, Elaniji d.o.o., drugostupanjskom presudom naložena je nadoknada sudskih pristojbi Gradu Splitu u iznosu od 15 tisuća kuna.
