Prijepori oko tehničke vladavine za vrijeme dok se Split bude pripremao za izbore - rašireni su i razbuktani, trakavica traje i dalje - a još uvijek nitko nije dao ostavku. Na papiru. S potpisom. I pečatom. U cijelom ovom politički uzbudljivom danu i ministar pravosuđa i uprave Ivan Malenica je želio nešto reći oko splitske političke drame.

- Stručne službe Ministarstva pravosuđa dale su svoje mišljenje o ovoj situaciji, koja je jasna ukoliko do ostavki uopće dođe. Tada će Vlada imenovati povjerenika gradu. Ali već sedam dana imamo najave ostavki, pa premišljanja, pa nagađanja s vjećnicima. Građani su taoci Puljkovog promišljanja, rekao je među ostalim Malenica i naglasio:

- Ovakva se situacija u praksi nije dogodila!

- Ako gradonačelnik i zamjenik daju ostavke, Vlada imenuje povjerenika. U slučaju kad gradonačelnik i zamjenik daju ostavke, tad Vlada u roku od 90 dana raspisuje izbore koji se u tom roku trebaju održati. Uloga i ovlasti povjerenika su propisani zakonom – on od imenovanja do izbora gradonačelnika tehnički vodi grad, ima određeni djelokrug djelovanja. Ministarstvo je izradilo mišljenje o tome uzevši u obzir zakon-  rekao je Ivan Malenica, a prenio N1.

Potom je odgovarao i na pitanje zašto umjesto povjerenika drugi zamjenik ne može preuzeti vlast:

- Stručne službe Ministarstva su dale tumačenje Zakona o lokalnoj upravi, sve je jasno u obrazloženju o tome. Naš stav će biti jednak daju li oba ili jedan zamjenik ostavke. Nije moguće da drugi zamjenik mijenja gradonačelnika. Postoji odredba kad prestane mandat zamjeniku, Vlada imenuje povjerenika”, pojasnio je.

Na upit da stručnjaci kažu da je ovo presedan, Malenica je rekao: “Ovakve situacije u praksi još nije bilo. Naši stručnjaci su tumačili odredbe Zakona i pri tom mišljenju ostajemo.”

Prijepori oko tehničke vladavine za vrijeme dok se Split bude pripremao za izbore - rašireni su i razbuktani, trakavica traje i dalje - a još uvijek nitko nije dao ostavku. Na papiru. S potpisom. I pečatom. U cijelom ovom politički uzbudljivom danu i ministar pravosuđa i uprave Ivan Malenica je želio nešto reći oko splitske političke drame.

- Stručne službe Ministarstva pravosuđa dale su svoje mišljenje o ovoj situaciji, koja je jasna ukoliko do ostavki uopće dođe. Tada će Vlada imenovati povjerenika gradu. Ali već sedam dana imamo najave ostavki, pa premišljanja, pa nagađanja s vjećnicima. Građani su taoci Puljkovog promišljanja, rekao je među ostalim Malenica i naglasio:

- Ovakva se situacija u praksi nije dogodila!

- Ako gradonačelnik i zamjenik daju ostavke, Vlada imenuje povjerenika. U slučaju kad gradonačelnik i zamjenik daju ostavke, tad Vlada u roku od 90 dana raspisuje izbore koji se u tom roku trebaju održati. Uloga i ovlasti povjerenika su propisani zakonom – on od imenovanja do izbora gradonačelnika tehnički vodi grad, ima određeni djelokrug djelovanja. Ministarstvo je izradilo mišljenje o tome uzevši u obzir zakon-  rekao je Ivan Malenica, a prenio N1.

Potom je odgovarao i na pitanje zašto umjesto povjerenika drugi zamjenik ne može preuzeti vlast:

- Stručne službe Ministarstva su dale tumačenje Zakona o lokalnoj upravi, sve je jasno u obrazloženju o tome. Naš stav će biti jednak daju li oba ili jedan zamjenik ostavke. Nije moguće da drugi zamjenik mijenja gradonačelnika. Postoji odredba kad prestane mandat zamjeniku, Vlada imenuje povjerenika”, pojasnio je.

Na upit da stručnjaci kažu da je ovo presedan, Malenica je rekao: “Ovakve situacije u praksi još nije bilo. Naši stručnjaci su tumačili odredbe Zakona i pri tom mišljenju ostajemo.”
