Niti mjesec dana od postavljanja betonskih blokova na ulaz u Šumicu, stigao je prvi pravni odgovor na takvu odluku gradske vlasti.

Splitski Općinski sud je na prijedlog vlasnika ugostiteljskog objekta "Biberon Maestra" naložio Gradu ili vlasniku uklanjanje betonskih blokova do okončanja postupka.

- Nalaže se protivniku osiguranja Gradu Splitu da odmah ukloni ogradu i betonske blokove položene na nekretnini i to baš ogradu koja je označena slovima A-B, te betonske blokove koji su označeni slovima C-D, E-F i G-H, u Skici mjerenja ‘u Splitu, 4. listopada 2022.‘, koja je sastavni dio nalaza i mišljenja vještaka geodetske struke na zahtjev stranke broj, izrađenog od stalnog sudskog vještaka Ante Bošnjaka, inženjera geodezije - navedeno je u privremenoj mjeri.

U Šumici nema više parkiranja, od danas je to pješačka zona! Grad Split je postavio rampu na nizbrdicu, vlasnik zemljišta ide u pravnu bitku: ‘Ne mogu to samo tako zabraniti‘

Iz "Biberona" tvrde da im je bez ikakvog upravnog akta ili ikakve odluke bilo kojeg tijela s javnim ovlastima onemogućen pristup nekretninama nakon što je instalirana željezna prepreka.

Također, objasnili su i kako su se poslužili  “institutom samopomoći” kako bi otvorili željeznu ogradu i omogućili pristup restoranu, ali je nakon takvog postupka Grad reagirao tako što je stavio betonske blokove.

- Predlagatelj ("Biberon Maestro") ističe i da je u tom prostoru obavljao ugostiteljsku djelatnost temeljem važećih minimalnih tehničkih uvjeta i da je takvim postupanjem stvorena izravna i neposredna ugroženost zaposlenika restorana Maestro jer isti ne može obavljati djelatnost budući da je onemogućen pristup dostave hrane, odvoza smeća, pražnjenje jame i sl. radi postavljenih blokova i radi čega će i zaposlenici tog restorana morati dobiti otkaz ugovora o radu, te stoga da je stvoreno stanje neposredne ugroženosti zagađenjem prostora fekalnim smećem iz septičke jame - jedan je od argumenata vlasnika restorana koji je istaknut u privremenoj mjeri na koju će se Grad žaliti.

Između ostalog, vlasnik Biberona smatra da je betonirani put na koji je stavljena rampa nerazvrstana cesta, ali su iz Grada još prije mjesec dana obrazložili kako na tom mjestu može biti samo pješačka staza jer se radi o zaštićenoj zelenoj površini po GUP-u.

- Na području Šumice postoji isključivo legalan put za pješake, sve ostalo na terenu je ilegalno i bit će uklonjeno. Dakle, ondje nema legalnog ni dopuštenog pristupa za vozila niti jedne namjene - stajalište je Banovine koja će se žaliti na takvu odluku Općinskog suda u Splitu.

Podsjećamo, prije mjesec dana danima se odvijala drama oko blokiranja pristupa vozilima Šumici. Nakon što je taj prostor postalo parkiralište za goste restorana, Grad je reagirao i postavio metalnu ogradu s katancem kako bi samo "Parkovi i nasadi" i žurne službe imale pristup toj parceli, međutim, vlasnik restorana je otključao rampu na što je Banovina reagirala postavljanjem betonskih blokova.

Niti mjesec dana od postavljanja betonskih blokova na ulaz u Šumicu, stigao je prvi pravni odgovor na takvu odluku gradske vlasti.

Splitski Općinski sud je na prijedlog vlasnika ugostiteljskog objekta "Biberon Maestra" naložio Gradu ili vlasniku uklanjanje betonskih blokova do okončanja postupka.

- Nalaže se protivniku osiguranja Gradu Splitu da odmah ukloni ogradu i betonske blokove položene na nekretnini i to baš ogradu koja je označena slovima A-B, te betonske blokove koji su označeni slovima C-D, E-F i G-H, u Skici mjerenja ‘u Splitu, 4. listopada 2022.‘, koja je sastavni dio nalaza i mišljenja vještaka geodetske struke na zahtjev stranke broj, izrađenog od stalnog sudskog vještaka Ante Bošnjaka, inženjera geodezije - navedeno je u privremenoj mjeri.

U Šumici nema više parkiranja, od danas je to pješačka zona! Grad Split je postavio rampu na nizbrdicu, vlasnik zemljišta ide u pravnu bitku: ‘Ne mogu to samo tako zabraniti‘

Iz "Biberona" tvrde da im je bez ikakvog upravnog akta ili ikakve odluke bilo kojeg tijela s javnim ovlastima onemogućen pristup nekretninama nakon što je instalirana željezna prepreka.

Također, objasnili su i kako su se poslužili  “institutom samopomoći” kako bi otvorili željeznu ogradu i omogućili pristup restoranu, ali je nakon takvog postupka Grad reagirao tako što je stavio betonske blokove.

- Predlagatelj ("Biberon Maestro") ističe i da je u tom prostoru obavljao ugostiteljsku djelatnost temeljem važećih minimalnih tehničkih uvjeta i da je takvim postupanjem stvorena izravna i neposredna ugroženost zaposlenika restorana Maestro jer isti ne može obavljati djelatnost budući da je onemogućen pristup dostave hrane, odvoza smeća, pražnjenje jame i sl. radi postavljenih blokova i radi čega će i zaposlenici tog restorana morati dobiti otkaz ugovora o radu, te stoga da je stvoreno stanje neposredne ugroženosti zagađenjem prostora fekalnim smećem iz septičke jame - jedan je od argumenata vlasnika restorana koji je istaknut u privremenoj mjeri na koju će se Grad žaliti.

Između ostalog, vlasnik Biberona smatra da je betonirani put na koji je stavljena rampa nerazvrstana cesta, ali su iz Grada još prije mjesec dana obrazložili kako na tom mjestu može biti samo pješačka staza jer se radi o zaštićenoj zelenoj površini po GUP-u.

- Na području Šumice postoji isključivo legalan put za pješake, sve ostalo na terenu je ilegalno i bit će uklonjeno. Dakle, ondje nema legalnog ni dopuštenog pristupa za vozila niti jedne namjene - stajalište je Banovine koja će se žaliti na takvu odluku Općinskog suda u Splitu.

Podsjećamo, prije mjesec dana danima se odvijala drama oko blokiranja pristupa vozilima Šumici. Nakon što je taj prostor postalo parkiralište za goste restorana, Grad je reagirao i postavio metalnu ogradu s katancem kako bi samo "Parkovi i nasadi" i žurne službe imale pristup toj parceli, međutim, vlasnik restorana je otključao rampu na što je Banovina reagirala postavljanjem betonskih blokova.
