Splitski odvjetnik Davor Radić neupitno je najveći nogometni pravni autoritet u državi. Radić je u svoje vrijeme igrao profesionalni nogomet, bio je junior Hajduka, a prvoligaške nastupe upisao je kao igrač Slaven Belupa. Nakon što je zbog teške ozljede rano i naprasno prekinuo karijeru, okrenuo se odvjetništvu te zahvaljujući predanosti, stručnosti i velikom radu danas ima iznimne odvjetničke veze po cijeloj Europi, posebno među onima koji se bave nogometnim pitanjima, pišu Sportske novosti.

Radić se vrlo iscrpno osvrnuo na pandemiju koja je doslovno paralizirala svijet, pa tako i nogomet.

- Kao prvo i osnovno, promatrano u pogledu sportskog nogometnog prava, moram reći da Covid-19 (koronavirus) kao poremećaj u nogometu predstavlja slučaj “više sile” za igrače i klubove. Pravni pojam više sile široko je i međunarodno prihvaćen te vrijedi i primjenjiv je sukladno sudskoj praksi Arbitražnog suda za sport (CAS) na sve ugovorne odnose igrača i klubova. Naime, u okviru sudske prakse CAS-a viša sila podrazumijeva objektivnu prepreku koja je izvan kontrole stranaka, a zbog koje izvršavanje obveze postaje nemoguće.

FIFA je potvrdila da je ovo situacija u nogometu bez presedana. Što to znači za same klubove i igrače?

- To prije svega znači da nisu točni navodi mnogih kada kažu da činjenica što igrač ima ugovor sama po sebi znači da ga klub mora u cijelosti izvršiti te da igrači mogu preko CAS-a dobiti raskid ugovora ako im klubovi ne plaćaju u ovom razdoblju više sile. To nije točno! Jer o kakvoj ugovornoj stabilnosti pravnog odnosa između igrača i klubova govorimo kada nijedna strana ne izvršava međusobni ugovor?! To onda nije stabilnost, već nestabilnost! U Hrvatskoj su, po mom saznanju, klubovi ponudili igračima i više nego korektne i izdašne ponude, koje su i mnogo veće u usporedbi s klubovima iz zemalja poput Hrvatske.

Smatram da su igrači ti koji bi morali u ovim teškim trenucima izaći klubovima u susret i reducirati svoje ugovore po traženju klubova. Igrači koji razmišljaju dugoročno to će napraviti i pristat će na smanjenje svojih ugovora jer će svaki igrač u budućnosti ovisiti o tom istom klubu na ovaj ili onaj način. Ne reduciraju klubovi danas u svijetu svoje troškove da bi sebi uzeli novce iz igračevih ugovora, već zato što, s obzirom na ovu izvanrednu i novonastalu situaciju, mnogi klubovi neće moći u budućnosti ispunjavati svoje obveze iz tih ugovora, a to znači da igrači onda neće dobiti nikakav novac. Nije pravno, životno, logično a ni pravedno da klub u cijelosti plaća igrača za vrijeme ove epidemije u Hrvatskoj dok igrač ne igra, ne radi i ne ispunjava svoj dio obveza iz ugovora o profesionalnom igranju.

Što je s igračima kojima ugovorne obveze s klubom prestaju 30. lipnja? Moraju li oni, ako prvenstvo još traje, igrati za svoj klub i nakon tog roka?

- Prije svega treba vidjeti hoće li FIFA donijeti obvezno cirkularno pismo nacionalnim savezima s jasnom uputom o postupanju u pogledu tih ugovora koji istječu 30. lipnja 2020. U protivnom, tj. ako FIFA ne donese nikakvu odluku, a ni preporuku po kojoj bi onda nacionalni savez donio odluku, onda smatram da ugovor igrača prestaje istekom ugovorenog vremena. Ukratko, prvo treba pričekati i vidjeti hoće li FIFA donijeti odluku ili preporuke, a tek onda dalje postupati.

Splitski odvjetnik Davor Radić neupitno je najveći nogometni pravni autoritet u državi. Radić je u svoje vrijeme igrao profesionalni nogomet, bio je junior Hajduka, a prvoligaške nastupe upisao je kao igrač Slaven Belupa. Nakon što je zbog teške ozljede rano i naprasno prekinuo karijeru, okrenuo se odvjetništvu te zahvaljujući predanosti, stručnosti i velikom radu danas ima iznimne odvjetničke veze po cijeloj Europi, posebno među onima koji se bave nogometnim pitanjima, pišu Sportske novosti.

Radić se vrlo iscrpno osvrnuo na pandemiju koja je doslovno paralizirala svijet, pa tako i nogomet.

- Kao prvo i osnovno, promatrano u pogledu sportskog nogometnog prava, moram reći da Covid-19 (koronavirus) kao poremećaj u nogometu predstavlja slučaj “više sile” za igrače i klubove. Pravni pojam više sile široko je i međunarodno prihvaćen te vrijedi i primjenjiv je sukladno sudskoj praksi Arbitražnog suda za sport (CAS) na sve ugovorne odnose igrača i klubova. Naime, u okviru sudske prakse CAS-a viša sila podrazumijeva objektivnu prepreku koja je izvan kontrole stranaka, a zbog koje izvršavanje obveze postaje nemoguće.

FIFA je potvrdila da je ovo situacija u nogometu bez presedana. Što to znači za same klubove i igrače?

- To prije svega znači da nisu točni navodi mnogih kada kažu da činjenica što igrač ima ugovor sama po sebi znači da ga klub mora u cijelosti izvršiti te da igrači mogu preko CAS-a dobiti raskid ugovora ako im klubovi ne plaćaju u ovom razdoblju više sile. To nije točno! Jer o kakvoj ugovornoj stabilnosti pravnog odnosa između igrača i klubova govorimo kada nijedna strana ne izvršava međusobni ugovor?! To onda nije stabilnost, već nestabilnost! U Hrvatskoj su, po mom saznanju, klubovi ponudili igračima i više nego korektne i izdašne ponude, koje su i mnogo veće u usporedbi s klubovima iz zemalja poput Hrvatske.

Smatram da su igrači ti koji bi morali u ovim teškim trenucima izaći klubovima u susret i reducirati svoje ugovore po traženju klubova. Igrači koji razmišljaju dugoročno to će napraviti i pristat će na smanjenje svojih ugovora jer će svaki igrač u budućnosti ovisiti o tom istom klubu na ovaj ili onaj način. Ne reduciraju klubovi danas u svijetu svoje troškove da bi sebi uzeli novce iz igračevih ugovora, već zato što, s obzirom na ovu izvanrednu i novonastalu situaciju, mnogi klubovi neće moći u budućnosti ispunjavati svoje obveze iz tih ugovora, a to znači da igrači onda neće dobiti nikakav novac. Nije pravno, životno, logično a ni pravedno da klub u cijelosti plaća igrača za vrijeme ove epidemije u Hrvatskoj dok igrač ne igra, ne radi i ne ispunjava svoj dio obveza iz ugovora o profesionalnom igranju.

Što je s igračima kojima ugovorne obveze s klubom prestaju 30. lipnja? Moraju li oni, ako prvenstvo još traje, igrati za svoj klub i nakon tog roka?

- Prije svega treba vidjeti hoće li FIFA donijeti obvezno cirkularno pismo nacionalnim savezima s jasnom uputom o postupanju u pogledu tih ugovora koji istječu 30. lipnja 2020. U protivnom, tj. ako FIFA ne donese nikakvu odluku, a ni preporuku po kojoj bi onda nacionalni savez donio odluku, onda smatram da ugovor igrača prestaje istekom ugovorenog vremena. Ukratko, prvo treba pričekati i vidjeti hoće li FIFA donijeti odluku ili preporuke, a tek onda dalje postupati.

Splitski odvjetnik Davor Radić neupitno je najveći nogometni pravni autoritet u državi. Radić je u svoje vrijeme igrao profesionalni nogomet, bio je junior Hajduka, a prvoligaške nastupe upisao je kao igrač Slaven Belupa. Nakon što je zbog teške ozljede rano i naprasno prekinuo karijeru, okrenuo se odvjetništvu te zahvaljujući predanosti, stručnosti i velikom radu danas ima iznimne odvjetničke veze po cijeloj Europi, posebno među onima koji se bave nogometnim pitanjima, pišu Sportske novosti.

Radić se vrlo iscrpno osvrnuo na pandemiju koja je doslovno paralizirala svijet, pa tako i nogomet.

- Kao prvo i osnovno, promatrano u pogledu sportskog nogometnog prava, moram reći da Covid-19 (koronavirus) kao poremećaj u nogometu predstavlja slučaj “više sile” za igrače i klubove....
