Nakon što je obrana izvijestila Županijski sud u Osijeku da je Visokom kaznenom sudu podnijela prijedlog za prenošenje mjesne nadležnosti na neki drugi sud koji bi u drugom postupku sudio Zdravku Mamiću i suokrivljenicima za izvlačenje 144 milijuna kuna iz GNK Dinamo, Jutarnji list doznaje kakvo će biti daljnje postupanje po tom zahtjevu.

Postavilo se pitanje je li taj zahtjev trebao biti podnesen putem osječkoga Županijskog suda, a na što je ukazao i Ivan Turudić, predsjednik Visokog kaznenog suda.

- To je zakonom propisana procedura i to je jasno određeno Zakonom o kaznenom postupku. Nedvojbeno je da je prema članku 28. ZKP-a propisano da zajednički neposredno viši sud može za vođenje postupka ili za provođenje određenih radnji u postupku odrediti drugi stvarno nadležni sud na svom području ako je očito da će se tako lakše provesti postupak ili za to postoje neki drugi važni razlozi - citirao nam je zakonsku odredbu Damir Kos, sudac Vrhovnog suda, i rekao kako je za to nadležan Visoki kazneni sud.

Podsjećamo, suđenje je sa zagrebačkoga Županijskog suda preseljeno u Osijek i zbog toga što je nekoliko sudaca tog suda bilo vezano uz nogomet i Mamića te je pitanje bi li bilo oportuno postupak vratiti u Zagreb. Sigurno je, kazalo nam je više pravosudnih dužnosnika, da će se morati uvažiti novonastale okolnosti zbog odnosa Zdravka Mamića s osječkim sucima te je upitno hoće li se suđenje nastaviti u Osijeku.

Ako Visoki kazneni sud prihvati zahtjev za delegaciju predmeta, najvjerojatnije će otpasti zagrebački Županijski sud, a jedino moguće rješenje su preostala dva "uskočka" suda u Splitu i Rijeci. Na splitskom sudu svaki uskočki sudac ima oko 50 predmeta pa je upitno bi li i zbog toga te troškova i sigurnosnih razloga, suđenje bilo oportuno premjestiti u Split, pa tako ostaje Županijski sud u Rijeci kao jedino rješenje.

Nakon što je obrana izvijestila Županijski sud u Osijeku da je Visokom kaznenom sudu podnijela prijedlog za prenošenje mjesne nadležnosti na neki drugi sud koji bi u drugom postupku sudio Zdravku Mamiću i suokrivljenicima za izvlačenje 144 milijuna kuna iz GNK Dinamo, Jutarnji list doznaje kakvo će biti daljnje postupanje po tom zahtjevu.

Postavilo se pitanje je li taj zahtjev trebao biti podnesen putem osječkoga Županijskog suda, a na što je ukazao i Ivan Turudić, predsjednik Visokog kaznenog suda.

- To je zakonom propisana procedura i to je jasno određeno Zakonom o kaznenom postupku. Nedvojbeno je da je prema članku 28. ZKP-a propisano da zajednički neposredno viši sud može za vođenje postupka ili za provođenje određenih radnji u postupku odrediti drugi stvarno nadležni sud na svom području ako je očito da će se tako lakše provesti postupak ili za to postoje neki drugi važni razlozi - citirao nam je zakonsku odredbu Damir Kos, sudac Vrhovnog suda, i rekao kako je za to nadležan Visoki kazneni sud.

Podsjećamo, suđenje je sa zagrebačkoga Županijskog suda preseljeno u Osijek i zbog toga što je nekoliko sudaca tog suda bilo vezano uz nogomet i Mamića te je pitanje bi li bilo oportuno postupak vratiti u Zagreb. Sigurno je, kazalo nam je više pravosudnih dužnosnika, da će se morati uvažiti novonastale okolnosti zbog odnosa Zdravka Mamića s osječkim sucima te je upitno hoće li se suđenje nastaviti u Osijeku.

Ako Visoki kazneni sud prihvati zahtjev za delegaciju predmeta, najvjerojatnije će otpasti zagrebački Županijski sud, a jedino moguće rješenje su preostala dva "uskočka" suda u Splitu i Rijeci. Na splitskom sudu svaki uskočki sudac ima oko 50 predmeta pa je upitno bi li i zbog toga te troškova i sigurnosnih razloga, suđenje bilo oportuno premjestiti u Split, pa tako ostaje Županijski sud u Rijeci kao jedino rješenje.

Gdje bi se moglo premjestiti drugo suđenje Mamićima? Sud u Splitu vjerojatno otpada iz više razloga, stoga se nameće jedino rješenje

Nakon što je obrana izvijestila Županijski sud u Osijeku da je Visokom kaznenom sudu podnijela prijedlog za prenošenje mjesne nadležnosti na neki drugi sud koji bi u drugom postupku sudio Zdravku Mamiću i suokrivljenicima za izvlačenje 144 milijuna kuna iz GNK Dinamo, Jutarnji list doznaje kakvo će biti daljnje postupanje po tom zahtjevu.

Postavilo se pitanje je li taj zahtjev trebao biti podnesen putem osječkoga Županijskog suda, a na što je ukazao i Ivan Turudić, predsjednik Visokog kaznenog suda.
