- S visokim postotkom sigurnosti možemo reći da bi pokojni Ante Jakir preživio ovu ozljedu da se nije izgubilo na vremenu i da je na vrijeme stogao u ustanovu gdje bi mu bila pružena adekvatna pomoć. Da je to bilo tako, a obzirom da se radi o mladoj osobi, realno je za očekivati da bi preživio ovaj gubitak krvi. U medicini je visoki stupanj sigurnosti iznad 95 posto - kazao je u ponedjeljak na splitskom sudu sudski vještak dr. Antonio Alujević svjedočeći u postupku koji se vodi protiv 28-godišnjeg Josipa Kristića iz Brela zbog izazivanja prometne nesreće koja je za posljedicu imala smrt njegovog najboljeg prijatelja Ante Jakira.

Za to mu djelo, ako bude proglašen krivim, prijeti kazna od tri do 15 godina zatvora.

Podsjetimo, mladića se tereti jer je 21. studenoga 2020. godine, oko 2.55, u Brelima vozio automobil marke Mazda 323 brzinom od 70 kilometara na sat kroz naseljeno mjesto, a u krvi je imao najmanje 1,19 promila alkohola u krvi. Danas pokojni Jakir je bio suvozač.

Bio je, po optužnici, svjestan da može ugroziti druge sudionike u prometu, a to se i dogodilo kada je ulaskom u zavoj izgubio kontrolu nad vozilom, koje je izletjelo s ceste i zabilo se u betonski stup. Kristić je u nesreći ozlijedio nogu, a tada 23-godišnji Jakir zadobio je, uz oguljotine, tešku i za život opasnu ozljedu u vidu duboke rezne rane vrata, koja je, po optužnom aktu, "dovela do iskrvarenja i uslijed koje ozljede je Ante Jakir tijekom prijevoza u kolima Hitne medicinske pomoći u Podstrani umro tog dana oko 4.50 sati".

U postupku je obrana, kao ključnu činjenicu, isticala da je mladić umro zbog krivnje dr. Mate Kasala koji je te noći bio dežuran u Hitnoj pomoći u Makarskoj i kojem se na Općinskom sudu u Splitu sudi, po optužnici ODO-a, zbog nesavjesnog liječenja, sprječavanja dokazivanja i krivotvorenja isprava. Ukratko, terete ga da je, nakon što nije išao s kolima Hitne pomoći s mladićem u splitsku bolnicu zbog čega je ovaj iskrvario jer nije imao adekvatnu brigu, poslije falsificirao liječničke dokumente kako bi spriječio da se dokaže njegova pogreška.

Alujević je zajedno s dr. Koljom Poljakom napravio kombinirano vještvo, a na pitanje Kristićevog odvjetnika Borisa Majića bi li mladić preživio nesreću da se prilikom udara aktivirao zračni jastuk, vještak je kazao da bi u tom slučaj "bio živ jer njegov vrat ne bi došao u kontakt s razbijenim vjetrobranskim staklom".

Naveo je, na pitanje Snježane Žarković, zamjenice ŽDO-a, da je potrebno svega dvije do tri minute od trenutka prijema pacijenta do postavljanja dijagnoze te da bi, ako se ne pristupi kirurškom zbrinjavanju takve rane i nadoknađivanju krvi, došlo do iskrvarenja i smrti u roku od sat do sat i pol vremena.

Na upit sutkinje Ivane Kanaet Samardžić kazao je da je liječnik trebao, osim stavljanja gaze ili tampona u ranu, rukom čvrsto i trajno držati cijelo vrijeme stisnutu ranu odnosno vršiti pritisak na arterije, a da bi omotavanje zavojem cijelog vrata značilo davljenje.

Okrivljeni mladić je u ponedjeljak u svojoj obrani još jednom kazao da bi više volio da njega nema, a da je njegov prijatelj živ te da zbog svega ima trajne psihičke posljedice. Naveo je i da svakodnevno radi s ocem žrtve na građevini, da se pokušavaju držati skupa i podupirati se.

U završnim govorima i tužiteljstvo i obrana ostali su na svojim pozicijama, prvi traže bezuvjetni zatvor jer je mladić vozio prebrzo i to pijan i svjestan, a drugi najviše uvjetnu kaznu. Zanimljiv je bio i govor odvjetnika oštećene obitelji Mije Jeličića koji je doslovno, u ime svojih klijenata, molio sud da Kristića ne pošalje iza rešetaka.

- Nemojte počiniti grešku koja može dovesti do težih posljedica kako za oštećene tako i za okrivljenog. Oštećeni imaju dvije nezacijeljene rane - prva je nepopravljiva posljedica smrti njihovog djeteta, unuka, brata, nećaka, zaručnika...Druga je Josipovo stanje, a ova je rana živa, trajna i nezacjeljiva.

Ako Josipa osudite na bezuvjetni zatvor nanijet ćete još jednu ranu oštećenoj obitelji i postoji bojazan da to neće dobro završiti te bi teret te posljedice mogao dodatno otežati ovu tragičnu situaciju. Oštećeni primjećuju da se ova tragična situacija mogla i trebala izbjeći da je liječnik poduzeo ono što bi svaki razuman laik učinio (pritisnuo ranu i držao je do dolaska u bolnicu kako je to opisao vještak Alujević - op.a.) - rekao je odvjetnik obitelji pokojnog mladića.

Presuda se očekuje krajem tjedna.

- S visokim postotkom sigurnosti možemo reći da bi pokojni Ante Jakir preživio ovu ozljedu da se nije izgubilo na vremenu i da je na vrijeme stogao u ustanovu gdje bi mu bila pružena adekvatna pomoć. Da je to bilo tako, a obzirom da se radi o mladoj osobi, realno je za očekivati da bi preživio ovaj gubitak krvi. U medicini je visoki stupanj sigurnosti iznad 95 posto - kazao je u ponedjeljak na splitskom sudu sudski vještak dr. Antonio Alujević svjedočeći u postupku koji se vodi protiv 28-godišnjeg Josipa Kristića iz Brela zbog izazivanja prometne nesreće koja je za posljedicu imala smrt njegovog najboljeg prijatelja Ante Jakira.

Za to mu djelo, ako bude proglašen krivim, prijeti kazna od tri do 15 godina zatvora.

Podsjetimo, mladića se tereti jer je 21. studenoga 2020. godine, oko 2.55, u Brelima vozio automobil marke Mazda 323 brzinom od 70 kilometara na sat kroz naseljeno mjesto, a u krvi je imao najmanje 1,19 promila alkohola u krvi. Danas pokojni Jakir je bio suvozač.

Bio je, po optužnici, svjestan da može ugroziti druge sudionike u prometu, a to se i dogodilo kada je ulaskom u zavoj izgubio kontrolu nad vozilom, koje je izletjelo s ceste i zabilo se u betonski stup. Kristić je u nesreći ozlijedio nogu, a tada 23-godišnji Jakir zadobio je, uz oguljotine, tešku i za život opasnu ozljedu u vidu duboke rezne rane vrata, koja je, po optužnom aktu, "dovela do iskrvarenja i uslijed koje ozljede je Ante Jakir tijekom prijevoza u kolima Hitne medicinske pomoći u Podstrani umro tog dana oko 4.50 sati".

U postupku je obrana, kao ključnu činjenicu, isticala da je mladić umro zbog krivnje dr. Mate Kasala koji je te noći bio dežuran u Hitnoj pomoći u Makarskoj i kojem se na Općinskom sudu u Splitu sudi, po optužnici ODO-a, zbog nesavjesnog liječenja, sprječavanja dokazivanja i krivotvorenja isprava. Ukratko, terete ga da je, nakon što nije išao s kolima Hitne pomoći s mladićem u splitsku bolnicu zbog čega je ovaj iskrvario jer nije imao adekvatnu brigu, poslije falsificirao liječničke dokumente kako bi spriječio da se dokaže njegova pogreška.

Alujević je zajedno s dr. Koljom Poljakom napravio kombinirano vještvo, a na pitanje Kristićevog odvjetnika Borisa Majića bi li mladić preživio nesreću da se prilikom udara aktivirao zračni jastuk, vještak je kazao da bi u tom slučaj "bio živ jer njegov vrat ne bi došao u kontakt s razbijenim vjetrobranskim staklom".

Naveo je, na pitanje Snježane Žarković, zamjenice ŽDO-a, da je potrebno svega dvije do tri minute od trenutka prijema pacijenta do postavljanja dijagnoze te da bi, ako se ne pristupi kirurškom zbrinjavanju takve rane i nadoknađivanju krvi, došlo do iskrvarenja i smrti u roku od sat do sat i pol vremena.

Na upit sutkinje Ivane Kanaet Samardžić kazao je da je liječnik trebao, osim stavljanja gaze ili tampona u ranu, rukom čvrsto i trajno držati cijelo vrijeme stisnutu ranu odnosno vršiti pritisak na arterije, a da bi omotavanje zavojem cijelog vrata značilo davljenje.

Okrivljeni mladić je u ponedjeljak u svojoj obrani još jednom kazao da bi više volio da njega nema, a da je njegov prijatelj živ te da zbog svega ima trajne psihičke posljedice. Naveo je i da svakodnevno radi s ocem žrtve na građevini, da se pokušavaju držati skupa i podupirati se.

U završnim govorima i tužiteljstvo i obrana ostali su na svojim pozicijama, prvi traže bezuvjetni zatvor jer je mladić vozio prebrzo i to pijan i svjestan, a drugi najviše uvjetnu kaznu. Zanimljiv je bio i govor odvjetnika oštećene obitelji Mije Jeličića koji je doslovno, u ime svojih klijenata, molio sud da Kristića ne pošalje iza rešetaka.

- Nemojte počiniti grešku koja može dovesti do težih posljedica kako za oštećene tako i za okrivljenog. Oštećeni imaju dvije nezacijeljene rane - prva je nepopravljiva posljedica smrti njihovog djeteta, unuka, brata, nećaka, zaručnika...Druga je Josipovo stanje, a ova je rana živa, trajna i nezacjeljiva.

Ako Josipa osudite na bezuvjetni zatvor nanijet ćete još jednu ranu oštećenoj obitelji i postoji bojazan da to neće dobro završiti te bi teret te posljedice mogao dodatno otežati ovu tragičnu situaciju. Oštećeni primjećuju da se ova tragična situacija mogla i trebala izbjeći da je liječnik poduzeo ono što bi svaki razuman laik učinio (pritisnuo ranu i držao je do dolaska u bolnicu kako je to opisao vještak Alujević - op.a.) - rekao je odvjetnik obitelji pokojnog mladića.

Presuda se očekuje krajem tjedna.
