Na splitskom Županijskom sudu pomalo se primiče kraju suđenje Liridonu Berishi (28) iz Stobreča okrivljenom za teško ubojstvo Ante Prnjaka (34) iz Kljaka na splitskom TTTS-u u kolovozu 2018. godine kojeg je s 14 metaka izrešetao iz automatske puške kalibra 7,62 mm.

Berisha je pred Sudsko vijeće kojim predsjeda sutkinja Višnja Strinić doveden iz zatvora u Zadru, a u nastavku suđenja svjedočila je stalna sudska vještakinja za sudsku medicinu Marija Definis Gojanović koja je rekla da mora proučiti cjelokupni spis kako bi mogla odgovarati na pitanja.

No, pojasnila je da žrtva nakon ispaljenja pet hitaca, pod uvjetom da se radilo o rafalnoj paljbi, gubi svijest odmah i da u takvom slučaju smrt nastupa praktično odmah.

Branitelj Berishe, odvjetnik Željko Gulišija pitao ju je kad žrtva gubi svijest i kad nastupa smrt kad se radi o hicima u tijelo žrtve, vještakinja je odgovorila da je isti način kao i kod hitaca u glavu.

Na pitanje zamjenice ŽDO-a Julijana Stipišić vještakinja je rekla da bi smrt nastupila u trenutku kad bi metak pogodio vitalne organe žrtve, a da bi sa samo strijelnim ozljedama udova, žrtva vjerojatno ostala živa.

- Ne mogu odgovoriti je li postojala jedna ili više rafalnih paljbi jer je to stvar balističara, a ne sudske medicine. Kalašnjikov, a ovdje se radi o tom oružju ako se ne varam, izaziva iznimna opsežna oštećenja jer se radi o projektilima velike brzine. Što je i na koji način u konkretnom slučaju upotrijebljeno ne znam jer nisam imala uvid u cijeli spis - kazala je vještakinja.

Sud je naložio da izradi pismeno vještvo, a na iduću će se raspravu, zakazanu za kraj lipnja, pozvati i sudski vještak za balistiku Sunčica Kuzmić.

Očekuje se da bi Berisha tada trebao iznijeti obranu i da će suđenje završiti.

Podsjetimo, Berisha se, stoji u optužnici, 21. kolovoza 2018. godine oko 22.40 dovezao na splitski TTTS s Antom Prnjakom u Prnjakovu osobnom automobilu BMW šibenskih registracijskih oznaka. Kada su stigli na napušteno i mračno mjesto na predjelu Kamena, zatražio je od Prnjaka da klekne ispred njega na koljena držeći ga tako u strahu. Zatim je u njega iz neposredne blizine ispalio najmanje četrnaest hitaca iz automatske puške kalibra 7,62 mm.

Obdukcijom je utvrđeno da je Prnjak pogođen s dva metka u zatiljak i četiri u desnu sljepoočnicu. Još četiri metka pogodila su ga u leđa i prsa, a ostali su izrešetali jednu i drugu ruku te natkoljenicu. Berisha se dan poslije dovezao BMW-om u Srinjine te benzinom polio automobil i zapalio ga kako bi uništio tragove.

Tijekom istrage Berisha je izjavio kako ga je Prnjak maltretirao više od dvije godine zbog kokaina u vrijednosti oko dvije tisuće eura koju mu nije odmah platio. Dug se popeo na 50.000 eura zbog lihvarskih kamata što on nije mogao redovito plaćati.

Izjavio je i da ga je zbog toga Prnjak maltretirao i ponižavao pred članovima obitelji. Na dan ubojstva su zajedno šmrkali kokain te je u jednom trenutku Prnjak iz automobila izvadio automatsku pušku kalibra i zatražio od njega da likvidira jednog muškarca za oprost duga. No, on je uzeo pušku i usmrtio Prnjaka.

Obrana cijelo vrijeme tvrdi da se radi o kaznenom djelu usmrćenja ili ubojstva na mah, a nikako ne teškom ubojstvu. No, za koje će (ne)djelo naposljetku Berisha biti osuđen, znat će se za nešto više od mjesec dana.

Na splitskom Županijskom sudu pomalo se primiče kraju suđenje Liridonu Berishi (28) iz Stobreča okrivljenom za teško ubojstvo Ante Prnjaka (34) iz Kljaka na splitskom TTTS-u u kolovozu 2018. godine kojeg je s 14 metaka izrešetao iz automatske puške kalibra 7,62 mm.

Berisha je pred Sudsko vijeće kojim predsjeda sutkinja Višnja Strinić doveden iz zatvora u Zadru, a u nastavku suđenja svjedočila je stalna sudska vještakinja za sudsku medicinu Marija Definis Gojanović koja je rekla da mora proučiti cjelokupni spis kako bi mogla odgovarati na pitanja.

No, pojasnila je da žrtva nakon ispaljenja pet hitaca, pod uvjetom da se radilo o rafalnoj paljbi, gubi svijest odmah i da u takvom slučaju smrt nastupa praktično odmah.

Branitelj Berishe, odvjetnik Željko Gulišija pitao ju je kad žrtva gubi svijest i kad nastupa smrt kad se radi o hicima u tijelo žrtve, vještakinja je odgovorila da je isti način kao i kod hitaca u glavu.

Na pitanje zamjenice ŽDO-a Julijana Stipišić vještakinja je rekla da bi smrt nastupila u trenutku kad bi metak pogodio vitalne organe žrtve, a da bi sa samo strijelnim ozljedama udova, žrtva vjerojatno ostala živa.

- Ne mogu odgovoriti je li postojala jedna ili više rafalnih paljbi jer je to stvar balističara, a ne sudske medicine. Kalašnjikov, a ovdje se radi o tom oružju ako se ne varam, izaziva iznimna opsežna oštećenja jer se radi o projektilima velike brzine. Što je i na koji način u konkretnom slučaju upotrijebljeno ne znam jer nisam imala uvid u cijeli spis - kazala je vještakinja.

Sud je naložio da izradi pismeno vještvo, a na iduću će se raspravu, zakazanu za kraj lipnja, pozvati i sudski vještak za balistiku Sunčica Kuzmić.

Očekuje se da bi Berisha tada trebao iznijeti obranu i da će suđenje završiti.

Podsjetimo, Berisha se, stoji u optužnici, 21. kolovoza 2018. godine oko 22.40 dovezao na splitski TTTS s Antom Prnjakom u Prnjakovu osobnom automobilu BMW šibenskih registracijskih oznaka. Kada su stigli na napušteno i mračno mjesto na predjelu Kamena, zatražio je od Prnjaka da klekne ispred njega na koljena držeći ga tako u strahu. Zatim je u njega iz neposredne blizine ispalio najmanje četrnaest hitaca iz automatske puške kalibra 7,62 mm.

Obdukcijom je utvrđeno da je Prnjak pogođen s dva metka u zatiljak i četiri u desnu sljepoočnicu. Još četiri metka pogodila su ga u leđa i prsa, a ostali su izrešetali jednu i drugu ruku te natkoljenicu. Berisha se dan poslije dovezao BMW-om u Srinjine te benzinom polio automobil i zapalio ga kako bi uništio tragove.

Tijekom istrage Berisha je izjavio kako ga je Prnjak maltretirao više od dvije godine zbog kokaina u vrijednosti oko dvije tisuće eura koju mu nije odmah platio. Dug se popeo na 50.000 eura zbog lihvarskih kamata što on nije mogao redovito plaćati.

Izjavio je i da ga je zbog toga Prnjak maltretirao i ponižavao pred članovima obitelji. Na dan ubojstva su zajedno šmrkali kokain te je u jednom trenutku Prnjak iz automobila izvadio automatsku pušku kalibra i zatražio od njega da likvidira jednog muškarca za oprost duga. No, on je uzeo pušku i usmrtio Prnjaka.

Obrana cijelo vrijeme tvrdi da se radi o kaznenom djelu usmrćenja ili ubojstva na mah, a nikako ne teškom ubojstvu. No, za koje će (ne)djelo naposljetku Berisha biti osuđen, znat će se za nešto više od mjesec dana.

Na splitskom Županijskom sudu pomalo se primiče kraju suđenje Liridonu Berishi (28) iz Stobreča okrivljenom za teško ubojstvo Ante Prnjaka (34) iz Kljaka na splitskom TTTS-u u kolovozu 2018. godine kojeg je s 14 metaka izrešetao iz automatske puške kalibra 7,62 mm.

Berisha je pred Sudsko vijeće kojim predsjeda sutkinja Višnja Strinić doveden iz zatvora u Zadru, a u nastavku suđenja svjedočila je stalna sudska vještakinja za sudsku medicinu Marija Definis Gojanović koja je rekla da mora proučiti cjelokupni spis kako bi mogla odgovarati na pitanja.

No, pojasnila je da žrtva nakon ispaljenja pet hitaca, pod uvjetom da se radilo o rafalnoj paljbi, gubi svijest odmah i da u takvom slučaju smrt nastupa praktično odmah.
