Devetnaest dana nakon što su završili iza rešetaka istražnog zatvora na Bilicama, sudac istrage splitskog Županijskog suda ukinuo je istražni zatvor za 13 uhićenih navijača koje je policija prijavila da su 3. travnja nakon završetka nogometne utakmice između Hajduka i Dinama na Poljudu na sjevernoj tribini i okolnim ulicama s ciljem izazivanja nereda sudjelovali u mnoštvu koje je nasiljem prema drugim osobama ugrožavalo javni red te da su poticali na nasilje prema većem broju osoba i uporabom opasnog oruđa doveli u opasnost život ili tijelo druge osobe.

ODO Split ih sumnjiči da su počinili osam kaznenih djela prisile prema službenoj osobi te kazneno djelo izazivanja nereda.

No, sudac istrage odredio im je mjere opreza i to zabranu posjećivanja svih sportskih natjecanja na području države, dakle ne samo nogometnih nego i svih drugih sportskih događaja te obvezu redovitog javljanja policiji dva puta mjesečno. Ukoliko se ne budu pridržavali mjera, upozoreni su da će sud najkasnije u roku 24 sata zamijeniti mjeru opreza istražnim zatvorom i da će biti uhićeni.

Nakon što su prvotno poslani "na hlađenje" iza rešetaka istražnog zatvora, sudsko je vijeće odlučujući po žalbama okrivljenih ukinulo rješenje navodeći da sudac istrage nije utvrdio postojanje osnovane sumnje u odnosu na svakog pojedinog okrivljenika te je naloženo da se osnovana sumnja jasno obrazloži i utvrdi jesu li, obzirom na vrijeme uhićenja, mogli sudjelovati u svim djelima za koje ih se tereti. Nakon toga je sudac istrage ponovno odlučivao o prijedlogu ODO-a te je utvrdio da se i mjerama opreza može ostvariti svrha.

Sudac je utvrdio da postoji osnovana sumnja da je njih 13, zajedno s tri maloljetnika, sudjelovalo u izazivanju nereda u mnoštvu koje je trgalo plastične stolice sa sjeverne tribine i bacalo ih prema policajcima kao i dijelove metalne konstrukcije, drvene palete, metalne pivske bačve, zapaljene baklje, upaljače, kovanice, elektronske cigarete... Oni su, po utvrđenju suda, kao dio mnoštva vikali "Udri pandure", "Zgazi smeća", "Ajmo, je... im majku..." te su utrčali na teren.

Jedanaest navijača i to K.Z. (25), J.B.(22), F.D. (19), P.E. (27), J.B. (31), A.E. (29), A.B. (21), A.Š. (38), K.B. (29), A.O. (19) i A.P. (18) uhićeni su nakon upada na teren poljudskog stadiona o čemu postoje policijske bilješke.

Kad se pojavila policija i potisnula masu na tribinu, jedan od osumnjičenih, S.M. (44) ih je sa tribina vrijeđao, naguravao i gađao raznim predmetima dok je drugi uhićeni navijač, R.A. (37) van stadiona na policijski kordon bacio dva i pol metra dugu granu koja je pogodila jednog policajca u nogu. On je, pak, naveo da je bacio granu, ali da nikog nije pogodio. U neredima je ozlijeđeno osam policajaca.

Sudac je, uz ostalo, naveo da u zadnje vrijeme na splitskom području dolazi do sve veće eskalacije nasilja pa i s tragičnim posljedicama što je izazvalo veliku uznemirenost javnosti i opravdanu reakciju u obliku javnih prosvjeda protiv takvih pojava.

No, samo nekoliko dana nakon javnog protesta ispred zgrade suda, okrivljenici su sudjelovali u neredima u kojima je manifestirana velika agresija i brutalnost pri čemu se uništavao gradski inventar, stadion, parkirani automobili, palili kontejneri te brutalno napadali i ozlijeđivali policajci kojima je zadaća štititi društvo od takvih ponašanja.

Prema sudu, sve je ovo pokazatelj da niti jedan od okrivljenih nije svjestan pogibeljnosti ovakvih nedjela koji su mogli završiti s puno tragičnijim posljedicama i sve to upućuje na to da bi mogli ponovno počiniti slična ili ista kaznena djela.

No, sud je smatrao da ih je 19 dana provedenih iza rešetaka dovoljno "opametilo" i urazumilo da se više ne upuštaju u slične rabote. Također, vodilo se računa da nitko od njih do sad, osim jednog, nije kazneno osuđivan. Zbog svega toga, pušteni su da se u nastavku postupka brane sa slobode.

Devetnaest dana nakon što su završili iza rešetaka istražnog zatvora na Bilicama, sudac istrage splitskog Županijskog suda ukinuo je istražni zatvor za 13 uhićenih navijača koje je policija prijavila da su 3. travnja nakon završetka nogometne utakmice između Hajduka i Dinama na Poljudu na sjevernoj tribini i okolnim ulicama s ciljem izazivanja nereda sudjelovali u mnoštvu koje je nasiljem prema drugim osobama ugrožavalo javni red te da su poticali na nasilje prema većem broju osoba i uporabom opasnog oruđa doveli u opasnost život ili tijelo druge osobe.

No, sudac istrage odredio im je mjere opreza i to zabranu posjećivanja svih sportskih natjecanja na području države, dakle ne samo nogometnih nego i svih drugih sportskih događaja te obvezu redovitog javljanja policiji dva puta mjesečno. Ukoliko se ne budu pridržavali mjera, upozoreni su da će sud najkasnije u roku 24 sata zamijeniti mjeru opreza istražnim zatvorom i da će biti uhićeni.

Nakon što su prvotno poslani "na hlađenje" iza rešetaka istražnog zatvora, sudsko je vijeće odlučujući po žalbama okrivljenih ukinulo rješenje navodeći da sudac istrage nije utvrdio postojanje osnovane sumnje u odnosu na svakog pojedinog okrivljenika te je naloženo da se osnovana sumnja jasno obrazloži i utvrdi jesu li, obzirom na vrijeme uhićenja, mogli sudjelovati u svim djelima za koje ih se tereti. Nakon toga je sudac istrage ponovno odlučivao o prijedlogu ODO-a te je utvrdio da se i mjerama opreza može ostvariti svrha.

Sudac je utvrdio da postoji osnovana sumnja da je njih 13, zajedno s tri maloljetnika, sudjelovalo u izazivanju nereda u mnoštvu koje je trgalo plastične stolice sa sjeverne tribine i bacalo ih prema policajcima kao i dijelove metalne konstrukcije, drvene palete, metalne pivske bačve, zapaljene baklje, upaljače, kovanice, elektronske cigarete... Oni su, po utvrđenju suda, kao dio mnoštva vikali "Udri pandure", "Zgazi smeća", "Ajmo, je... im majku..." te su utrčali na teren.

Jedanaest navijača i to K.Z. (25), J.B.(22), F.D. (19), P.E. (27), J.B. (31), A.E. (29), A.B. (21), A.Š. (38), K.B. (29), A.O. (19) i A.P. (18) uhićeni su nakon upada na teren poljudskog stadiona o čemu postoje policijske bilješke.

Kad se pojavila policija i potisnula masu na tribinu, jedan od osumnjičenih, S.M. (44) ih je sa tribina vrijeđao, naguravao i gađao raznim predmetima dok je drugi uhićeni navijač, R.A. (37) van stadiona na policijski kordon bacio dva i pol metra dugu granu koja je pogodila jednog policajca u nogu. On je, pak, naveo da je bacio granu, ali da nikog nije pogodio. U neredima je ozlijeđeno osam policajaca.

Sudac je, uz ostalo, naveo da u zadnje vrijeme na splitskom području dolazi do sve veće eskalacije nasilja pa i s tragičnim posljedicama što je izazvalo veliku uznemirenost javnosti i opravdanu reakciju u obliku javnih prosvjeda protiv takvih pojava.

No, samo nekoliko dana nakon javnog protesta ispred zgrade suda, okrivljenici su sudjelovali u neredima u kojima je manifestirana velika agresija i brutalnost pri čemu se uništavao gradski inventar, stadion, parkirani automobili, palili kontejneri te brutalno napadali i ozlijeđivali policajci kojima je zadaća štititi društvo od takvih ponašanja.

Prema sudu, sve je ovo pokazatelj da niti jedan od okrivljenih nije svjestan pogibeljnosti ovakvih nedjela koji su mogli završiti s puno tragičnijim posljedicama i sve to upućuje na to da bi mogli ponovno počiniti slična ili ista kaznena djela.

No, sud je smatrao da ih je 19 dana provedenih iza rešetaka dovoljno "opametilo" i urazumilo da se više ne upuštaju u slične rabote. Također, vodilo se računa da nitko od njih do sad, osim jednog, nije kazneno osuđivan. Zbog svega toga, pušteni su da se u nastavku postupka brane sa slobode.
