Visoki prekršajni sud Republike Hrvatske ukinuo je presudu kojom su dvije osobe bile proglašene krivima zbog napada na Hajdukove igrače Marka Futacsa i Ahmeda Saida Saida, javlja Dalmatinski portal.

Podsjetimo, incident se dogodio ispred Kluba navijača Torcida u centru Splita 23. travnja 2018. godine. Dan ranije Hajduk je poražen u derbiju protiv Dinama na Poljudu rezultatom 2:1.

Odvjetnik Damir Gruić je u tom predmetu zastupa okrivljenike. Evo što je izjavio za Dalmatinski portal:

- Točno je da je žalba okrivljenika u ovom predmetu usvojena. Iz obrazloženja drugostupanjske odluke jasno je kako okrivljenici u ovom predmetu nisu imali pravično suđenje i kako je povrijeđeno njihovo pravo na obranu. Ukratko, stav je drugostupanjskog suda da su svi zapisnici o prepoznavanju okrivljenika napravljeni od strane policije nezakoniti dokazi, jer je cijela radnja prepoznavanja provedena na nepravilan način i protivno odredbama Zakona o kaznenom postupku.

- Isto tako drugostupanjski sud smatra neprihvatljivim da se tijekom cijelog postupka kao svjedoci saslušavaju osobe koje ne govore hrvatskim jezikom, ali se pri tome ne koristi sudski tumač, već je kod prepoznavanja u policiji ulogu prevoditelja igračima Hajduka obavljao policijski službenik i jedan od igrača Hajduka, a na sudu je to radila Hajdukova djelatnica, što je moralo utjecati na pravilnost i zakonitost prvostupanjske odluke - rekao je Gruić.

- Meni kao branitelju tijekom postupka je uskraćeno pravo na uvid u sam predmet i pregled dokaza i isprava u spisu uz obrazloženje da se to radi zbog zaštite interesa policije, što je, naravno, od strane drugostupanjskog suda ocijenjeno kao nepravilnim i predstavlja povredu prava na obranu okrivljenika. Da bude jasnije, spis ima i više od 100 stranica, a osim optužnog prijedloga niti ja niti okrivljenici nismo smjeli vidjeti ostatak predmeta jer nam je to bilo zabranjeno. Branite se, a ne znate tko vas i za što tereti.

- Nadalje, sud je utvrdio da se na iskazima policijskih službenika ne može temeljiti odluka o krivnji, jer oni uopće nisu bili neposredni očevici tog događaja. Isto tako drugostupanjski sud utvrđuje da u konkretnom slučaju nije uopće razvidno da bi ponašanjem osoba koje su sudjelovale u tom incidentu bilo povrijeđeno dostojanstvo oštećenika - igrača Hajduka, pa je izreka presude nerazumljiva i Prekršajni zakon je nepravilno primijenjen. Ovo su samo glavni propusti, najviše žalbene osnove, koji su bili dovoljni da sud ukine cijelu presudu, ne ulazeći dalje u ocjenu ostalih žalbenih navoda - izjavio je za Dalmatinski portal Gruić, inače bivši glasnogovornik Torcice.

- Iako se radi o neprihvatljivom napadu na Hajdukove igrače u samom centru Splita, ova presuda i njeno obrazloženje mogu javnosti možda približiti zbog čega su pripadnici navijačke supkulture nezadovoljni postojećim Zakonom o sprječavanju nereda na športskim natjecanjima kao i predloženim izmjenama (iako se ovdje ne radi o toj vrsti prekršaja) - zaključio je Gruić.

Visoki prekršajni sud Republike Hrvatske ukinuo je presudu kojom su dvije osobe bile proglašene krivima zbog napada na Hajdukove igrače Marka Futacsa i Ahmeda Saida Saida, javlja Dalmatinski portal.

Podsjetimo, incident se dogodio ispred Kluba navijača Torcida u centru Splita 23. travnja 2018. godine. Dan ranije Hajduk je poražen u derbiju protiv Dinama na Poljudu rezultatom 2:1.

Odvjetnik Damir Gruić je u tom predmetu zastupa okrivljenike. Evo što je izjavio za Dalmatinski portal:

- Točno je da je žalba okrivljenika u ovom predmetu usvojena. Iz obrazloženja drugostupanjske odluke jasno je kako okrivljenici u ovom predmetu nisu imali pravično suđenje i kako je povrijeđeno njihovo pravo na obranu. Ukratko, stav je drugostupanjskog suda da su svi zapisnici o prepoznavanju okrivljenika napravljeni od strane policije nezakoniti dokazi, jer je cijela radnja prepoznavanja provedena na nepravilan način i protivno odredbama Zakona o kaznenom postupku.

- Isto tako drugostupanjski sud smatra neprihvatljivim da se tijekom cijelog postupka kao svjedoci saslušavaju osobe koje ne govore hrvatskim jezikom, ali se pri tome ne koristi sudski tumač, već je kod prepoznavanja u policiji ulogu prevoditelja igračima Hajduka obavljao policijski službenik i jedan od igrača Hajduka, a na sudu je to radila Hajdukova djelatnica, što je moralo utjecati na pravilnost i zakonitost prvostupanjske odluke - rekao je Gruić.

- Meni kao branitelju tijekom postupka je uskraćeno pravo na uvid u sam predmet i pregled dokaza i isprava u spisu uz obrazloženje da se to radi zbog zaštite interesa policije, što je, naravno, od strane drugostupanjskog suda ocijenjeno kao nepravilnim i predstavlja povredu prava na obranu okrivljenika. Da bude jasnije, spis ima i više od 100 stranica, a osim optužnog prijedloga niti ja niti okrivljenici nismo smjeli vidjeti ostatak predmeta jer nam je to bilo zabranjeno. Branite se, a ne znate tko vas i za što tereti.

- Nadalje, sud je utvrdio da se na iskazima policijskih službenika ne može temeljiti odluka o krivnji, jer oni uopće nisu bili neposredni očevici tog događaja. Isto tako drugostupanjski sud utvrđuje da u konkretnom slučaju nije uopće razvidno da bi ponašanjem osoba koje su sudjelovale u tom incidentu bilo povrijeđeno dostojanstvo oštećenika - igrača Hajduka, pa je izreka presude nerazumljiva i Prekršajni zakon je nepravilno primijenjen. Ovo su samo glavni propusti, najviše žalbene osnove, koji su bili dovoljni da sud ukine cijelu presudu, ne ulazeći dalje u ocjenu ostalih žalbenih navoda - izjavio je za Dalmatinski portal Gruić, inače bivši glasnogovornik Torcice.

- Iako se radi o neprihvatljivom napadu na Hajdukove igrače u samom centru Splita, ova presuda i njeno obrazloženje mogu javnosti možda približiti zbog čega su pripadnici navijačke supkulture nezadovoljni postojećim Zakonom o sprječavanju nereda na športskim natjecanjima kao i predloženim izmjenama (iako se ovdje ne radi o toj vrsti prekršaja) - zaključio je Gruić.

Visoki prekršajni sud Republike Hrvatske ukinuo je presudu kojom su dvije osobe bile proglašene krivima zbog napada na Hajdukove igrače Marka Futacsa i Ahmeda Saida Saida, javlja Dalmatinski portal.

Podsjetimo, incident se dogodio ispred Kluba navijača Torcida u centru Splita 23. travnja 2018. godine. Dan ranije Hajduk je poražen u derbiju protiv Dinama na Poljudu rezultatom 2:1.

Odvjetnik Damir Gruić je u tom predmetu zastupa okrivljenike. Evo što je izjavio za Dalmatinski portal:

- Točno je da je žalba okrivljenika u ovom predmetu usvojena. Iz obrazloženja drugostupanjske odluke jasno je kako okrivljenici u ovom predmetu nisu imali pravično suđenje i kako je povrijeđeno njihovo pravo na obranu. Ukratko, stav je drugostupanjskog suda da su svi zapisnici o prepoznavanju okriv...
