Prije dva dana veliku buru u javnosti izazvala je vijesti da je pedofilu, koji je više od godinu dana spolno zlostavljao sedmogodišnju pokćerku, sud smanjio kaznu s 14 na 11 godina zatvora. Kao olakotnu okolnost uzeli su njegovo sudjelovanje u Domovinskom ratu pa su mnogi postavili pitanje zašto bi pedofilu to trebalo ići u prilog i smanjiti kaznu.

S Visokog kaznenog suda objašnjavaju kako to nije bilo odlučujuće za presudu, piše Jutarnji list.

- Uzima se u obzir prijašnji život tog optuženika pa tako često uzmemo u obzir ako je netko u prijašnjem životu doista bio sudionik Domovinskog rata. To nije nešto što bi trebalo zanemariti, rekla je Ivana Bilušić, zamjenica glasnogovornika Visokog kaznenog suda, prenosi Dnevnik.hr.

Olakotna okolnost mu je bila i što prije nije bio osuđivan, priznao je većinu optužbi, pokajao se i izrazio žaljenje. Osuđen je za teži oblik djela pa je propisana i teža sankcija, do 20 godina zatvora, navodi Sud.

- Prilikom odmjeravanja kazne, sud se mora voditi svim onim okolnostima koje zakon propisuje koje čine neku kaznu da bude teža ili blaža u okviru zakonskog minimuma ili maksimuma, rekla je Bilušić.

'sudjelovanje u Domovinskom ratu sigurno je pozitivno'

Međutim, postavlja se pitanje kakve veze sudjelovanje u Domovinskom ratu ima s činom pedofilije.

- Ta okolnost je sama po sebi sasvim sigurno pozitivna jer govori donekle o osobnosti, o ličnosti počinitelja, ali naravno da u većini slučajeva ta konkretna okolnost nema veze sa samim počinjenjem djela. Dakle, ona će se nominalno možda pojaviti kao olakotna, ali neće biti sigurno od presudnog značaja kod odmjeravanja kazne, rekao je Rafael Krešić, odvjetnik i bivši sudac.

Kaznu, dodaje Krešić, suci odmjeravaju prema zakonu i vlastitom nahođenju, samostalno, uzimajući u obzir sve okolnosti.

- Kazneni zakon samo za potrebe primjera navodi one osnovne kategorije okolnosti koje će doći u obzir kao olakotne. Zakon ne nabraja koje to okolnosti jesu. Naravno da je praksa kroz godine suđenja kristalizirala neke okolnosti koje se tipično pojavljuju kao olakotne, rekao je.

O presudi pedofilu s Visokog kaznenog suda poručuju da se okolnosti ne smiju dvostruko vrednovati, kroz kaznu i kroz ocjenu otegotnih okolnosti, te da izrečena kazna dovoljno moralno i društveno osuđuje za zlo koje je počinio, piše Jutarnji list.

Kao olakotnu okolnost uzeli su njegovo sudjelovanje u Domovinskom ratu pa su mnogi postavili pitanje zašto bi pedofilu to trebalo ići u prilog i smanjiti kaznu.

S Visokog kaznenog suda objašnjavaju kako to nije bilo odlučujuće za presudu, piše Jutarnji list.

- Uzima se u obzir prijašnji život tog optuženika pa tako često uzmemo u obzir ako je netko u prijašnjem životu doista bio sudionik Domovinskog rata. To nije nešto što bi trebalo zanemariti, rekla je Ivana Bilušić, zamjenica glasnogovornika Visokog kaznenog suda, prenosi Dnevnik.hr.

Olakotna okolnost mu je bila i što prije nije bio osuđivan, priznao je većinu optužbi, pokajao se i izrazio žaljenje. Osuđen je za teži oblik djela pa je propisana i teža sankcija, do 20 godina zatvora, navodi Sud.

- Prilikom odmjeravanja kazne, sud se mora voditi svim onim okolnostima koje zakon propisuje koje čine neku kaznu da bude teža ili blaža u okviru zakonskog minimuma ili maksimuma, rekla je Bilušić.

'sudjelovanje u Domovinskom ratu sigurno je pozitivno'

Međutim, postavlja se pitanje kakve veze sudjelovanje u Domovinskom ratu ima s činom pedofilije.

- Ta okolnost je sama po sebi sasvim sigurno pozitivna jer govori donekle o osobnosti, o ličnosti počinitelja, ali naravno da u većini slučajeva ta konkretna okolnost nema veze sa samim počinjenjem djela. Dakle, ona će se nominalno možda pojaviti kao olakotna, ali neće biti sigurno od presudnog značaja kod odmjeravanja kazne, rekao je Rafael Krešić, odvjetnik i bivši sudac.

Kaznu, dodaje Krešić, suci odmjeravaju prema zakonu i vlastitom nahođenju, samostalno, uzimajući u obzir sve okolnosti.

- Kazneni zakon samo za potrebe primjera navodi one osnovne kategorije okolnosti koje će doći u obzir kao olakotne. Zakon ne nabraja koje to okolnosti jesu. Naravno da je praksa kroz godine suđenja kristalizirala neke okolnosti koje se tipično pojavljuju kao olakotne, rekao je.

O presudi pedofilu s Visokog kaznenog suda poručuju da se okolnosti ne smiju dvostruko vrednovati, kroz kaznu i kroz ocjenu otegotnih okolnosti, te da izrečena kazna dovoljno moralno i društveno osuđuje za zlo koje je počinio, piše Jutarnji list.

Prije dva dana veliku buru u javnosti izazvala je vijesti da je pedofilu, koji je više od godinu dana spolno zlostavljao sedmogodišnju pokćerku, sud smanjio kaznu s 14 na 11 godina zatvora. Kao olakotnu okolnost uzeli su njegovo sudjelovanje u Domovinskom ratu pa su mnogi postavili pitanje zašto bi pedofilu to trebalo ići u prilog i smanjiti kaznu.
