Vrhovni sud odbio je zahtjev Darka Kovačevića zvanog Daruvarac za izvanredno preispitivanje pravomoćne presude kojom je osuđen na četiri godine zatvora zbog prijetnje i premlaćivanja 18-godišnjakinje.

Najviši sud je pojasnio da je riječ o izvanrednom pravnom lijeku koji je Kovačević podnio tvrdeći kako je presudom povrijeđen zakon na njegovu štetu, da je uskraćen u svojim pravima te da mu je povrijeđeno pravo na pravično suđenje i pravo na privatnost, a što je, kako tvrdi, utjecalo na pravomoćnu presudu.

Vrhovni sud je ocijenio da presuda Kovačeviću nije utemeljena na nezakonitim dokazima. Sud je precizirao da se to odnosi na snimku videonadzora iz kafića, medicinsku dokumentaciju koju je žrtva predala u spis te naloga za pretragu doma i drugih prostorija.

Sud: Nije bilo kršenja Kovačevićevih prava

Dodao je da u kaznenom postupku nije bilo kršenja temeljnih prava osuđenika niti povrede prava na obranu na raspravi. Zakon nije povrijeđen ni u žalbenom postupku jer je drugostupanjski sud razmotrio i ocijenio sve Kovačevićeve žalbene navode i ispitao prvostupanjsku presudu, nadodao je sud.

Najviši sud smatra da su javni istupi pojedinih državnih dužnosnika, pored intenziviranog publiciteta koje je suđenje imalo u javnosti, doista bili neprimjereni i u suprotnosti s pretpostavkom nedužnosti.

Međutim, ističe sud, to nije utjecalo na tijek kaznenog postupka u kojem je utvrđena Kovačevićeva krivnja, niti na njegovo pravo na pravično suđenje.

''Pravomoćnu presudu donijeli su suci profesionalci na temelju savjesno ocijenjenih dokaza. Suci profesionalci u procesu suđenja imaju odgovarajuće iskustvo i obuku koji im omogućavaju da se odupru vanjskom utjecaju'', naglasio je sud.

Vrhovni sud je pojasnio da se u okviru ovog izvanrednog pravnog lijeka ne razmatra pravilnost činjeničnog stanja utvrđenog osuđujućom presudom niti je li došlo do pogrešne primjene ili neprimjene zakona. Uz to, ne razmatra se ni odluka o primjeni mjere istražnog zatvora ili mjere opreza kao zamjene za istražni zatvor te trajanja tih mjera, kao niti pravilnost i potpuna okolnost o kojima ovisi vrsta i mjera kazne.

''Opširni i konfuzni zahtjev osuđenika upire na mnogobrojne povrede, a očito u nastojanju da se ishodi odluka u trećem stupnju. To je suprotno uvjetima predviđenima u zakonu'', zaključio je Vrhovni sud.

Smanjena kazna s pet na četiri godine

Kovačević, za kojeg najviši sud navodi samo inicijale, proglašen je krivim u siječnju 2019. na Općinskom sudu u Zadru za prijetnje i brutalno premlaćivanje 18-godišnje djevojke 13. lipnja 2018. u Zadru.

Iako je tužiteljstvo tražilo da se Kovačeviću odredi kazna od 5,5 godina zatvora, sutkinja Mitra Meštrović izrekla je nepravomoćnu presudu na pet godina bezuvjetnog zatvora. Kovačević je osuđen na četiri godine i šest mjeseci za tešku tjelesnu ozljedu, a deset mjeseci dobio je zbog prijetnje.

Početkom lipnja izvanraspravno vijeće Županijskog suda u Splitu smanjilo mu je kaznu s pet na četiri godine zatvora. Jednako kao i u prvom stupnju, okolnosti djela su poznate, krivnja je priznata, ali su odbijene sve žalbe, prigovori, primjedbe. Kao olakotna okolnost uzeto je priznanje krivnje i tvrdnja da će žrtva biti obeštećena.

Vrhovni sud odbio je zahtjev Darka Kovačevića zvanog Daruvarac za izvanredno preispitivanje pravomoćne presude kojom je osuđen na četiri godine zatvora zbog prijetnje i premlaćivanja 18-godišnjakinje.

Najviši sud je pojasnio da je riječ o izvanrednom pravnom lijeku koji je Kovačević podnio tvrdeći kako je presudom povrijeđen zakon na njegovu štetu, da je uskraćen u svojim pravima te da mu je povrijeđeno pravo na pravično suđenje i pravo na privatnost, a što je, kako tvrdi, utjecalo na pravomoćnu presudu.

Vrhovni sud je ocijenio da presuda Kovačeviću nije utemeljena na nezakonitim dokazima. Sud je precizirao da se to odnosi na snimku videonadzora iz kafića, medicinsku dokumentaciju koju je žrtva predala u spis te naloga za pretragu doma i drugih prostorija.

Sud: Nije bilo kršenja Kovačevićevih prava

Dodao je da u kaznenom postupku nije bilo kršenja temeljnih prava osuđenika niti povrede prava na obranu na raspravi. Zakon nije povrijeđen ni u žalbenom postupku jer je drugostupanjski sud razmotrio i ocijenio sve Kovačevićeve žalbene navode i ispitao prvostupanjsku presudu, nadodao je sud.

Najviši sud smatra da su javni istupi pojedinih državnih dužnosnika, pored intenziviranog publiciteta koje je suđenje imalo u javnosti, doista bili neprimjereni i u suprotnosti s pretpostavkom nedužnosti.

Međutim, ističe sud, to nije utjecalo na tijek kaznenog postupka u kojem je utvrđena Kovačevićeva krivnja, niti na njegovo pravo na pravično suđenje.

''Pravomoćnu presudu donijeli su suci profesionalci na temelju savjesno ocijenjenih dokaza. Suci profesionalci u procesu suđenja imaju odgovarajuće iskustvo i obuku koji im omogućavaju da se odupru vanjskom utjecaju'', naglasio je sud.

Vrhovni sud je pojasnio da se u okviru ovog izvanrednog pravnog lijeka ne razmatra pravilnost činjeničnog stanja utvrđenog osuđujućom presudom niti je li došlo do pogrešne primjene ili neprimjene zakona. Uz to, ne razmatra se ni odluka o primjeni mjere istražnog zatvora ili mjere opreza kao zamjene za istražni zatvor te trajanja tih mjera, kao niti pravilnost i potpuna okolnost o kojima ovisi vrsta i mjera kazne.

''Opširni i konfuzni zahtjev osuđenika upire na mnogobrojne povrede, a očito u nastojanju da se ishodi odluka u trećem stupnju. To je suprotno uvjetima predviđenima u zakonu'', zaključio je Vrhovni sud.

Smanjena kazna s pet na četiri godine

Kovačević, za kojeg najviši sud navodi samo inicijale, proglašen je krivim u siječnju 2019. na Općinskom sudu u Zadru za prijetnje i brutalno premlaćivanje 18-godišnje djevojke 13. lipnja 2018. u Zadru.

Iako je tužiteljstvo tražilo da se Kovačeviću odredi kazna od 5,5 godina zatvora, sutkinja Mitra Meštrović izrekla je nepravomoćnu presudu na pet godina bezuvjetnog zatvora. Kovačević je osuđen na četiri godine i šest mjeseci za tešku tjelesnu ozljedu, a deset mjeseci dobio je zbog prijetnje.

Početkom lipnja izvanraspravno vijeće Županijskog suda u Splitu smanjilo mu je kaznu s pet na četiri godine zatvora. Jednako kao i u prvom stupnju, okolnosti djela su poznate, krivnja je priznata, ali su odbijene sve žalbe, prigovori, primjedbe. Kao olakotna okolnost uzeto je priznanje krivnje i tvrdnja da će žrtva biti obeštećena.

Vrhovni sud odbio je zahtjev Darka Kovačevića zvanog Daruvarac za izvanredno preispitivanje pravomoćne presude kojom je osuđen na četiri godine zatvora zbog prijetnje i premlaćivanja 18-godišnjakinje.

Najviši sud je pojasnio da je riječ o izvanrednom pravnom lijeku koji je Kovačević podnio tvrdeći kako je presudom povrijeđen zakon na njegovu štetu, da je uskraćen u svojim pravima te da mu je povrijeđeno pravo na pravično suđenje i pravo na privatnost, a što je, kako tvrdi, utjecalo na pravomoćnu presudu.

Vrhovni sud je ocijenio da presuda Kovačeviću nije utemeljena na nezakonitim dokazima. Sud je precizirao da se to odnosi na snimku videonadzora iz kafića, medicinsku dokumentaciju koju je žrtva predala u spis te naloga za pretragu doma i drugih prostorija.
