Nemogućnost vlasnika da koriste vlastite stanove u kojima žive zaštićeni najmoprimci, odnosno ostvare odgovarajuću najamninu predstavlja povredu prava na mirno uživanje vlasništva, zaključio je Europski sud za ljudska prava.

U presudi nakon tužbe dvoje podnositelja protiv Hrvatske sud je zaključio da je država povrijedila prava na mirno uživanje vlasništva vlasnika stanova u kojima žive zaštićeni najmoprimci.

Podnositelji su podnijeli tužbu sudu u Strasbourgu jer dugi niz godina nisu mogli koristiti stanove koje imaju u vlasništvu niti dobiti tržišnu najamninu zbog toga što su njihovi stanovi dani na korištenje zaštićenim najmoprimcima.

Odlučujući u ovim predmetima sud je odbio sve formalne prigovore tužene države smatrajući da se radi o situaciji kontinuirane povrede prava vlasništva podnositelja, izvijestio je ured hrvatske predstavnice pred tim sudom.

Sud je u presudi notirao izmjene Zakona o najmu stanova koje su stupile na snagu 2018. koje je Ustavni sud ukinuo u rujnu 2020.

Stoga je sud primijetio da se ovi predmeti ni po čemu ne razlikuju od već presuđenog predmeta Statileo protiv Hrvatske s obzirom da nije došlo do zakonskih promjena u odnosu na prava vlasnika stanova u kojima žive zaštićeni najmoprimci, odnosno da i one promjene koje su učinjene nisu stupile na snagu jer su poništene odlukom Ustavnog suda, navode u priopćenju.

Sud je stoga utvrdio da nema razloga odstupiti od svog stajališta koji je zauzeo u ranijoj presudi u drugom slučaju te je utvrdio da je i u ovim predmetima došlo do povrede prava na mirno uživanje vlasništva.

Procjenjujući odgovarajuću visinu najamnine sud je imao u vidu informacije o tržišnoj najamnini za slične stanove u relevantnom razdoblju i o zaštićenoj najamnini na koju su podnositelji kao vlasnici imali pravo. Na taj je način odredio naknadu uzimajući u obzir kvadraturu stanova.

Sud je prvoj podnositeljici zahtjeva dosudio iznos od 54,200 eura na ime materijalne štete, 5000 eura na ime nematerijalne štete te 1245 eura na ime troškova postupka.

Drugom podnositelju dosuđeno je 95,100 eura na ime materijalne štete, 5000 eura na ime nematerijalne štete te tisuću eura za troškove postupka.

Nemogućnost vlasnika da koriste vlastite stanove u kojima žive zaštićeni najmoprimci, odnosno ostvare odgovarajuću najamninu predstavlja povredu prava na mirno uživanje vlasništva, zaključio je Europski sud za ljudska prava.

U presudi nakon tužbe dvoje podnositelja protiv Hrvatske sud je zaključio da je država povrijedila prava na mirno uživanje vlasništva vlasnika stanova u kojima žive zaštićeni najmoprimci.

Podnositelji su podnijeli tužbu sudu u Strasbourgu jer dugi niz godina nisu mogli koristiti stanove koje imaju u vlasništvu niti dobiti tržišnu najamninu zbog toga što su njihovi stanovi dani na korištenje zaštićenim najmoprimcima.

Odlučujući u ovim predmetima sud je odbio sve formalne prigovore tužene države smatrajući da se radi o situaciji kontinuirane povrede prava vlasništva podnositelja, izvijestio je ured hrvatske predstavnice pred tim sudom.

Sud je u presudi notirao izmjene Zakona o najmu stanova koje su stupile na snagu 2018. koje je Ustavni sud ukinuo u rujnu 2020.

Stoga je sud primijetio da se ovi predmeti ni po čemu ne razlikuju od već presuđenog predmeta Statileo protiv Hrvatske s obzirom da nije došlo do zakonskih promjena u odnosu na prava vlasnika stanova u kojima žive zaštićeni najmoprimci, odnosno da i one promjene koje su učinjene nisu stupile na snagu jer su poništene odlukom Ustavnog suda, navode u priopćenju.

Sud je stoga utvrdio da nema razloga odstupiti od svog stajališta koji je zauzeo u ranijoj presudi u drugom slučaju te je utvrdio da je i u ovim predmetima došlo do povrede prava na mirno uživanje vlasništva.

Procjenjujući odgovarajuću visinu najamnine sud je imao u vidu informacije o tržišnoj najamnini za slične stanove u relevantnom razdoblju i o zaštićenoj najamnini na koju su podnositelji kao vlasnici imali pravo. Na taj je način odredio naknadu uzimajući u obzir kvadraturu stanova.

Sud je prvoj podnositeljici zahtjeva dosudio iznos od 54,200 eura na ime materijalne štete, 5000 eura na ime nematerijalne štete te 1245 eura na ime troškova postupka.

Drugom podnositelju dosuđeno je 95,100 eura na ime materijalne štete, 5000 eura na ime nematerijalne štete te tisuću eura za troškove postupka.

Nemogućnost vlasnika da koriste vlastite stanove u kojima žive zaštićeni najmoprimci, odnosno ostvare odgovarajuću najamninu predstavlja povredu prava na mirno uživanje vlasništva, zaključio je Europski sud za ljudska prava.

U presudi nakon tužbe dvoje podnositelja protiv Hrvatske sud je zaključio da je država povrijedila prava na mirno uživanje vlasništva vlasnika stanova u kojima žive zaštićeni najmoprimci.

Podnositelji su podnijeli tužbu sudu u Strasbourgu jer dugi niz godina nisu mogli koristiti stanove koje imaju u vlasništvu niti dobiti tržišnu najamninu zbog toga što su njihovi stanovi dani na korištenje zaštićenim najmoprimcima.

Odlučujući u ovim predmetima sud je odbio sve formalne prigovore tužene države smatrajući da se radi o situaciji kontinuirane povre...
