Tužiteljica Marija Božić je 1998. naknadnim uplatama premija mirovinskog osiguranja u mirovinski fond dokupila mirovinski staž za razdoblje od 1992. do 1998. o čemu joj je HZMO izdao odgovarajuće potvrde. Međutim, kada je 2000. zatražila priznanje prava na mirovinu HZMO je odbio to učiniti, uz obrazloženje da od 1992. do 1998. nije imala status osigurane osobe.

Tek kada je tužiteljica po drugi puta zatražila priznanje prava na mirovinu 2012. HZMO joj je to pravo priznao, utvrdivši da je imala status osigurane osobe zbog naknadnih uplata u mirovinski fond. Međutim, to pravo joj je HZMO priznao tek počevši od 2011.

Europski sud je zaključio da je naknadnim priznanjem prava na mirovinu HZMO de facto priznao da je njegova prva odluka o tom pravu tužiteljice bila pogrešna. Međutim, priznajući tu pogrešku HZMO nije njezine posljedice u potpunosti ispravio, zato što je tužiteljici priznao pravo na mirovinu tek od 2011. ali ne i od 2000, iako su činjenice bitne za priznanje tog prava postojale još i 2000. kada je HZMO o njezinom pravu na mirovinu odlučio drukčije.

Za utvrđenu povredu konvencijskog prava Sud je tužiteljici dosudio ukupno 20.500 eura na ime materijalne i nematerijalne štete te još 2.500 eura na ime troškova postupka.

U Uredu zastupnika Republike Hrvatske pred Europskim sudom za ljudska prava ističu da će presuda postati konačna ukoliko niti jedna od strana u postupku u roku od tri mjeseca od objave presude ne podnese zahtjev za preispitivanje presude pred Velikim vijećem. Nakon konačnosti predmet će se nalaziti u postupku izvršenja pred Odborom ministara Vijeća Europe.

Tužiteljica Marija Božić je 1998. naknadnim uplatama premija mirovinskog osiguranja u mirovinski fond dokupila mirovinski staž za razdoblje od 1992. do 1998. o čemu joj je HZMO izdao odgovarajuće potvrde. Međutim, kada je 2000. zatražila priznanje prava na mirovinu HZMO je odbio to učiniti, uz obrazloženje da od 1992. do 1998. nije imala status osigurane osobe.

Tek kada je tužiteljica po drugi puta zatražila priznanje prava na mirovinu 2012. HZMO joj je to pravo priznao, utvrdivši da je imala status osigurane osobe zbog naknadnih uplata u mirovinski fond. Međutim, to pravo joj je HZMO priznao tek počevši od 2011.

Europski sud je zaključio da je naknadnim priznanjem prava na mirovinu HZMO de facto priznao da je njegova prva odluka o tom pravu tužiteljice bila pogrešna. Međutim, priznajući tu pogrešku HZMO nije njezine posljedice u potpunosti ispravio, zato što je tužiteljici priznao pravo na mirovinu tek od 2011. ali ne i od 2000, iako su činjenice bitne za priznanje tog prava postojale još i 2000. kada je HZMO o njezinom pravu na mirovinu odlučio drukčije.

Za utvrđenu povredu konvencijskog prava Sud je tužiteljici dosudio ukupno 20.500 eura na ime materijalne i nematerijalne štete te još 2.500 eura na ime troškova postupka.

U Uredu zastupnika Republike Hrvatske pred Europskim sudom za ljudska prava ističu da će presuda postati konačna ukoliko niti jedna od strana u postupku u roku od tri mjeseca od objave presude ne podnese zahtjev za preispitivanje presude pred Velikim vijećem. Nakon konačnosti predmet će se nalaziti u postupku izvršenja pred Odborom ministara Vijeća Europe.
