OTP banka isplatila je tužitelju koji je dobio 7. travnja 2020. u Sisku prvostupanjsku presudu za CHF preplaćeni kredit već 16. travnja, osam dana nakon dobivene prvostupanjske presude, objavili su iz udruge Franak.

Radi se o auto kreditu u iznosu 110.000 kuna (23.500 CHF), dok je dosuđeno i tužitelju već isplaćeno ukupno 58.000 kuna preplaćenih anuiteta i pripadajućih zateznih kamata. Osim toga, banka je platila još i 11.000 kuna sudskih troškova.
Presudu je donijela sutkinja Sanda Navara Sladović, dok je tužitelja zastupala odvjetnica Vlasta Joksimović.

-To je dobar znak da OTP banka priznaje da po presudama za nekonvertirane CHF kredite nema razloga žaliti se, i da će za nekonvertirane kredite isplaćivati po prvostupanjskim presudama ono što je dosuđeno svakome tužitelju. To je racionalno u financijskom smislu, jer nastavak procesa znači veći trošak za banku. Znači li to da možemo očekivati da će uskoro možda biti prihvaćene i ponude nagodbi prije nego što se pokrene sudski spor? - poručuju iz udruge Franak.

Nadalje, savjetuju svim tužiteljima da prije pokretanja sudskoga postupka pokušaju mirnim putem zatražiti svoj novac, tako da banci upute prijedlog za isplatu preplaćenih iznosa i pripadajućih zateznih kamata prije nego što banku tuže.

- Jasno je da svi CHF dužnici koji su otplatili kredite prije konverzije, ili su unatoč mogućnosti konverzije nastavili otplaćivati kredite u CHF anuitetima, imaju sigurnu pobjedu na sudu, i 100%-nu sigurnost da će tužbom ostvariti vraćanje svojeg novca - ističu u objavi.

Također navode kako su u Vukovaru, Kutini i Sisku u zadnjih 10 dana donesene još tri pozitivne presude za konvertirane kredite, pa poručuju istodobno svima onima koji su konvertirali kredite da budu strpljivi dok se ne razriješe pravne dvojbe koje su se pojavile nakon nepotrebno provedenog oglednog postupka.

- Kao što smo najavili, uskoro ćemo pokrenuti prethodno pitanje na Sudu EU vezano za konvertirane kredite, ali i za ništetnost temeljnih CHF ugovora općenito. Ujedno pozivamo sve fizičke osobe korisnike kredita s valutnom klauzulom CHF koji su te kredite otplatili prije zakonske konverzije ili i dalje plaćaju CHF anuitete, bez obzira na vrstu kredita (auto, hipotekarni, stambeni, nenamjenski), da se jave Udruzi Franak radi savjetovanja o pokretanju tužbe. Vrijeme je da uzmete svoj novac od banaka! - zaključuju u objavi.

OTP banka isplatila je tužitelju koji je dobio 7. travnja 2020. u Sisku prvostupanjsku presudu za CHF preplaćeni kredit već 16. travnja, osam dana nakon dobivene prvostupanjske presude, objavili su iz udruge Franak.

Radi se o auto kreditu u iznosu 110.000 kuna (23.500 CHF), dok je dosuđeno i tužitelju već isplaćeno ukupno 58.000 kuna preplaćenih anuiteta i pripadajućih zateznih kamata. Osim toga, banka je platila još i 11.000 kuna sudskih troškova.
Presudu je donijela sutkinja Sanda Navara Sladović, dok je tužitelja zastupala odvjetnica Vlasta Joksimović.

-To je dobar znak da OTP banka priznaje da po presudama za nekonvertirane CHF kredite nema razloga žaliti se, i da će za nekonvertirane kredite isplaćivati po prvostupanjskim presudama ono što je dosuđeno svakome tužitelju. To je racionalno u financijskom smislu, jer nastavak procesa znači veći trošak za banku. Znači li to da možemo očekivati da će uskoro možda biti prihvaćene i ponude nagodbi prije nego što se pokrene sudski spor? - poručuju iz udruge Franak.

Nadalje, savjetuju svim tužiteljima da prije pokretanja sudskoga postupka pokušaju mirnim putem zatražiti svoj novac, tako da banci upute prijedlog za isplatu preplaćenih iznosa i pripadajućih zateznih kamata prije nego što banku tuže.

- Jasno je da svi CHF dužnici koji su otplatili kredite prije konverzije, ili su unatoč mogućnosti konverzije nastavili otplaćivati kredite u CHF anuitetima, imaju sigurnu pobjedu na sudu, i 100%-nu sigurnost da će tužbom ostvariti vraćanje svojeg novca - ističu u objavi.

Također navode kako su u Vukovaru, Kutini i Sisku u zadnjih 10 dana donesene još tri pozitivne presude za konvertirane kredite, pa poručuju istodobno svima onima koji su konvertirali kredite da budu strpljivi dok se ne razriješe pravne dvojbe koje su se pojavile nakon nepotrebno provedenog oglednog postupka.

- Kao što smo najavili, uskoro ćemo pokrenuti prethodno pitanje na Sudu EU vezano za konvertirane kredite, ali i za ništetnost temeljnih CHF ugovora općenito. Ujedno pozivamo sve fizičke osobe korisnike kredita s valutnom klauzulom CHF koji su te kredite otplatili prije zakonske konverzije ili i dalje plaćaju CHF anuitete, bez obzira na vrstu kredita (auto, hipotekarni, stambeni, nenamjenski), da se jave Udruzi Franak radi savjetovanja o pokretanju tužbe. Vrijeme je da uzmete svoj novac od banaka! - zaključuju u objavi.

Osam dana nakon prvostupanjske presude, OTP banka isplatila tužitelju preplaćeni novac; Iz Udruge Franak poručuju: To je dobar znak

OTP banka isplatila je tužitelju koji je dobio 7. travnja 2020. u Sisku prvostupanjsku presudu za CHF preplaćeni kredit već 16. travnja, osam dana nakon dobivene prvostupanjske presude, objavili su iz udruge Franak.

Radi se o auto kreditu u iznosu 110.000 kuna (23.500 CHF), dok je dosuđeno i tužitelju već isplaćeno ukupno 58.000 kuna preplaćenih anuiteta i pripadajućih zateznih kamata. Osim toga, banka je platila još i 11.000 kuna sudskih troškova.
Presudu je donijela sutkinja Sanda Navara Sladović, dok je tužitelja zastupala odvjetnica Vlasta Joksimović.

-To je dobar znak da OTP banka priznaje da po presudama za nekonvertirane CHF kredite nema razloga žaliti se, i da će za nekonvertirane kredite isplaćivati po prvostupanjskim presudama ono što je dosuđeno svakome tužitelju. ...
