Ana Magaš više nema sudskih prepreka za viđanje svog djeteta, doznaje se u priopćenju Ustavnoga suda gdje se ne navodi njeno ime. Ustavni je sud, naime, usvojio ustavnu tužbu Ane Magaš i ukinuo rješenja Županijskog suda u Zadru i Općinskog suda u Zadru koji su joj odbili ostvarivanje prava na susrete i druženja s njezinim maloljetnim djetetom, prenosi Index.

Ana Magaš je, podsjetimo, prošle godine pomilovana nakon tri i pol godine provedene u zatvoru zbog "prekoračenje nužne obrane" od svog muža Lucijana.

On ju je nakon svađe koja se odigrala 2005. godine u njihovom domu počeo daviti rukama, a ona je dohvatila nož i ubila ga.

Po izlasku iz zatvora započela je borba za skrbništvo nad sinom Lovrom kojega je obitelj ubijenog Lucijana Magaša. Uspjeli izboriti i zabranu Aninog viđanja sa sinom, za koji je sud naveo da nije ni "dobar niti koristan". No, ta je odluka 20. svibnja ukinuta odlukom Ustavnog suda.

Ana Magaš osporavala je zabranu temeljem 35. članka Ustava RH koji kaže da je svakom hrvatskom državljaninu zajamčeno štovanje obiteljskog života i temeljem članka 8. Konvencije za zaštitu ljudskih prava i sloboda koji također jamči štovanje obiteljskog života, donosi Index.

Ustavni je sud ovom odlukom ujedno naložio Centru za socijalnu skrb Zadar da u okviru zakonskih ovlasti poduzme sve što je potrebno za ostvarenje susreta i druženja Ane Magaš i njenog sina.

Zaključio je da "osobite okolnosti konkretnog slučaja sagledavane u cjelini, uz određene propuste tijela koja su vodila postupke i sporost postupanja koja je objektivno otvorila mogućnost utjecaja na promjenu djetetovog odnosa prema majci, ukazuju da su postupanjem nadležnih tijela povrijeđena podnositeljičina prava na poštovanje njezina obiteljskog života, zajamčenog člankom 35. Ustava i člankom 8. Konvencije, u dijelu koji se odnosi na susrete i druženja podnositeljice kao biološke majke sa svojim djetetom". Ana Magaš više nema sudskih prepreka za viđanje svog djeteta, doznaje se u priopćenju Ustavnoga suda gdje se ne navodi njeno ime. Ustavni je sud, naime, usvojio ustavnu tužbu Ane Magaš i ukinuo rješenja Županijskog suda u Zadru i Općinskog suda u Zadru koji su joj odbili ostvarivanje prava na susrete i druženja s njezinim maloljetnim djetetom, prenosi Index.

Ana Magaš je, podsjetimo, prošle godine pomilovana nakon tri i pol godine provedene u zatvoru zbog "prekoračenje nužne obrane" od svog muža Lucijana.

On ju je nakon svađe koja se odigrala 2005. godine u njihovom domu počeo daviti rukama, a ona je dohvatila nož i ubila ga.

Po izlasku iz zatvora započela je borba za skrbništvo nad sinom Lovrom kojega je obitelj ubijenog Lucijana Magaša. Uspjeli izboriti i zabranu Aninog viđanja sa sinom, za koji je sud naveo da nije ni "dobar niti koristan". No, ta je odluka 20. svibnja ukinuta odlukom Ustavnog suda.

Ana Magaš osporavala je zabranu temeljem 35. članka Ustava RH koji kaže da je svakom hrvatskom državljaninu zajamčeno štovanje obiteljskog života i temeljem članka 8. Konvencije za zaštitu ljudskih prava i sloboda koji također jamči štovanje obiteljskog života, donosi Index.

Ustavni je sud ovom odlukom ujedno naložio Centru za socijalnu skrb Zadar da u okviru zakonskih ovlasti poduzme sve što je potrebno za ostvarenje susreta i druženja Ane Magaš i njenog sina.

Zaključio je da "osobite okolnosti konkretnog slučaja sagledavane u cjelini, uz određene propuste tijela koja su vodila postupke i sporost postupanja koja je objektivno otvorila mogućnost utjecaja na promjenu djetetovog odnosa prema majci, ukazuju da su postupanjem nadležnih tijela povrijeđena podnositeljičina prava na poštovanje njezina obiteljskog života, zajamčenog člankom 35. Ustava i člankom 8. Konvencije, u dijelu koji se odnosi na susrete i druženja podnositeljice kao biološke majke sa svojim djetetom".
