Bivšemu premijeru Ivi Sanaderu te pravnoj osobi HDZ-u bilo je povrijeđeno pravo na pravično suđenje zbog toga jer tijekom suđenja u slučaju Fimi Media nisu mogli ispitati suokrivljenike Mladena Barišića, Branku Pavošević i Nevenku Jurak, koji su ih u istrazi teretili dok su na suđenju odbili odgovarati na pitanja - temeljni je zaključak presude Vrhovnog suda, piše Jutarnji list.
Riječ je o antikorupcijskom slučaju, tzv. aferi Fimi Media, u kojemu je nedavno Vrhovni sud ukinuo presudu kojom su Sanader i ostali, uključujući i HDZ, bili proglašeni krivima zbog izvlačenja nekoliko desetaka milijuna kuna iz javnih poduzeća tijekom Sanaderova mandata.
“Iskazi koje se nije moglo dovesti u pitanje bili su, prema mišljenju Vrhovnog suda, presudni za ishod ovog postupka, odnosno presuda se temeljila na njima u odlučujućem dijelu.” Obrazloženje odluke Vrhovnog suda za ukidanje presude sve do ponedjeljka nije bilo poznato. Vrhovni sud je, kako doznajemo, najviše problematizirao Sanaderovu nepripadajuću imovinsku korist od 15 milijuna kuna, koje mu je prema optužnici donio Barišić u vilu u Kozarčevoj, a koja predstavlja “najtanji” dio optužbe budući da je jedini očevidac navodne primopredaje bio Barišić, kojega pak Sanader nije mogao ispitati.
Vrhovni sud je također naložio da se u ponovljenom suđenju, pred istim vijećem, jasnije obrazloži je li Sanader bio proglašen krivim kao službena ili odgovorna osoba, dakle predsjednik Vlade ili HDZ-a, navodeći tu i odredbu da u zakonu nije taksativno navedeno da je predsjednik Vlade službena osoba.
Vrhovni sud je također zaključio da samo činjenica postojanja HDZ-ova crnoga fonda, odnosno primanja donacija koje nisu evidentirane, ne znači nužno da je u pitanju kazneno djelo jer su ta sredstva, a riječ je o 9,6 milijuna kuna, bila utrošena za poslovanje stranke.
“Moguće je, naravno pod određenim pravnim uvjetima, da se radi o financijskom prekršaju”, navodi se u presudi Vrhovnoga suda.

Bivšemu premijeru Ivi Sanaderu te pravnoj osobi HDZ-u bilo je povrijeđeno pravo na pravično suđenje zbog toga jer tijekom suđenja u slučaju Fimi Media nisu mogli ispitati suokrivljenike Mladena Barišića, Branku Pavošević i Nevenku Jurak, koji su ih u istrazi teretili dok su na suđenju odbili odgovarati na pitanja - temeljni je zaključak presude Vrhovnog suda, piše Jutarnji list.
Riječ je o antikorupcijskom slučaju, tzv. aferi Fimi Media, u kojemu je nedavno Vrhovni sud ukinuo presudu kojom su Sanader i ostali, uključujući i HDZ, bili proglašeni krivima zbog izvlačenja nekoliko desetaka milijuna kuna iz javnih poduzeća tijekom Sanaderova mandata.
“Iskazi koje se nije moglo dovesti u pitanje bili su, prema mišljenju Vrhovnog suda, presudni za ishod ovog postupka, odnosno presuda se temeljila na njima u odlučujućem dijelu.” Obrazloženje odluke Vrhovnog suda za ukidanje presude sve do ponedjeljka nije bilo poznato. Vrhovni sud je, kako doznajemo, najviše problematizirao Sanaderovu nepripadajuću imovinsku korist od 15 milijuna kuna, koje mu je prema optužnici donio Barišić u vilu u Kozarčevoj, a koja predstavlja “najtanji” dio optužbe budući da je jedini očevidac navodne primopredaje bio Barišić, kojega pak Sanader nije mogao ispitati.
Vrhovni sud je također naložio da se u ponovljenom suđenju, pred istim vijećem, jasnije obrazloži je li Sanader bio proglašen krivim kao službena ili odgovorna osoba, dakle predsjednik Vlade ili HDZ-a, navodeći tu i odredbu da u zakonu nije taksativno navedeno da je predsjednik Vlade službena osoba.
Vrhovni sud je također zaključio da samo činjenica postojanja HDZ-ova crnoga fonda, odnosno primanja donacija koje nisu evidentirane, ne znači nužno da je u pitanju kazneno djelo jer su ta sredstva, a riječ je o 9,6 milijuna kuna, bila utrošena za poslovanje stranke.
“Moguće je, naravno pod određenim pravnim uvjetima, da se radi o financijskom prekršaju”, navodi se u presudi Vrhovnoga suda.
