Europska policijska agencija Europol morat će obrisati veliku većinu ogromne baze osobnih podataka koje je, zaključilo je nadzorno tijelo EU-a, nezakonito prikupila. Dosad neviđena otkrića Europskog supervizora za zaštitu podataka (EDPS) tiču se milijarda informacija.

Osjetljive informacije u “velikoj škrinji podataka”, kako ju nazivaju stručnjaci za privatnost, dolaze od izvještaja o zločinima, hakirani su od telefonskih usluga pod enkripcijom i dobiveni od tražitelja azila koji nikada nisu bili povezani ni s kakvim zločinima, prenosi Guardian.

Prema internim dokumentima koje je Guardian dobio na uvid, Europolova baza sadrži najmanje 4 petabajta podataka – ekvivalent 3 milijuna CD-a ili petine kompletnog sadržaja američke Kongresne knjižnice. Zagovaratelji zaštite podataka kažu da količina informacija u Europolovim sustavima izgleda kao masovno nadgledanje i predstavlja još jedan korak u tome da agencija postane europski pandan američkoj Agenciji za nacionalnu sigurnost (NSA), organizaciji čije je online špijuniranje otkrio zviždač Edward Snowden.

Među kvadrilijunima bajtova podataka nalaze se osjetljive informacije o najmanje četvrt milijuna trenutnih ili bivših osumnjičenika za terorizam i teške zločine, kao i mnoštvu drugih ljudi s kojima su oni došli u kontakt. Nacionalne policije podatke su skupljale unutar prethodnih šest godina u serijama ispisa podataka od nepoznatih brojeva u kriminalističkim istragama.

Nadzorno tijelo je naredilo Europolu da obriše podatke koje drže dulje od šest mjeseci i dalo mu rok od godinu dana da organizira podatke koje zakonski mogu zadržati. Time su se na suprotstavljenim stranama našli europsko tijelo za zaštitu podataka i moćna sigurnosna agencija koja se priprema da postane centar korištenja umjetne inteligencije u policijskim poslovima.

Presuda je također ogolila duboke političke podjele među europskim političarima po pitanju kompromisa između sigurnosti i privatnosti. Ishod ovih sukoba imat će posljedice na budućnost privatnosti u Europi, ali i šire, prenosi N1.

Europska povjerenica za unutarnje poslove, Ylva Johansson, branila je Europol.

“Policijska tijela trebaju alate, resurse i vrijeme da analiziraju podatke koji su im po zakonu poslani,” rekla je. “U Europi, Europol je platforma koja podržava nacionalne policije u ovom ogromnom zadatku.”

Povjerenstvo za unutarnje poslove kaže da zabrinutosti koje je iznio EDPS “predstavljaju ozbiljan izazov” za sposobnost Europola da izvršava svoje dužnosti. Prošle godine Povjerenstvo je predložilo ogromne promjene u regulacijama kojima bi se ojačale ovlasti Europola. Ako se te promjene izglasaju, njima bi se moglo legalizirati čuvanje podataka za potrebe testiranja novih alata umjetne inteligencije.

Europol negira da je učinio išta pogrešno, rekavši da nadzorno tijelo možda interpretira trenutna pravila na nepraktičan način: “Regulacija Europola nije osmišljena od strane legislatora kao nužnost koju je nemoguće ispuniti u praksi.”

“Europol je s EDPS-om surađivao da bi se pronašao balans između sigurnosti EU i njenih građana i pridržavanja najviših standarda privatnosti podataka,” rekli su iz agencije.

Osnovan kao tijelo za koordinaciju nacionalnih policijskih snaga u EU sa sjedištem u Den Haagu, neke zemlje članice Europol predstavljaju kao rješenje pitanja borbe protiv terorizma nakon napada na Bataclan 2015.

U teoriji, Europol je podvrgnut oštrim regulacijama po pitanju vrste podataka koje smije čuvati, kao i koliko dugo. Podatke koje dobivaju moraju jasno kategorizirati i procesuirati i čuvati samo ako su potencijalno relevantni za prioritetne poslove kao što je borba protiv terorizma. Ipak, potpuni sadržaj njihovih baza još uvijek je nepoznat, dijelom i zbog neuređenog načina na koji je Europol upravljao podacima, kako je saznao EDPS.

Europska policijska agencija Europol morat će obrisati veliku većinu ogromne baze osobnih podataka koje je, zaključilo je nadzorno tijelo EU-a, nezakonito prikupila. Dosad neviđena otkrića Europskog supervizora za zaštitu podataka (EDPS) tiču se milijarda informacija.

Osjetljive informacije u “velikoj škrinji podataka”, kako ju nazivaju stručnjaci za privatnost, dolaze od izvještaja o zločinima, hakirani su od telefonskih usluga pod enkripcijom i dobiveni od tražitelja azila koji nikada nisu bili povezani ni s kakvim zločinima, prenosi Guardian.

Prema internim dokumentima koje je Guardian dobio na uvid, Europolova baza sadrži najmanje 4 petabajta podataka – ekvivalent 3 milijuna CD-a ili petine kompletnog sadržaja američke Kongresne knjižnice. Zagovaratelji zaštite podataka kažu da količina informacija u Europolovim sustavima izgleda kao masovno nadgledanje i predstavlja još jedan korak u tome da agencija postane europski pandan američkoj Agenciji za nacionalnu sigurnost (NSA), organizaciji čije je online špijuniranje otkrio zviždač Edward Snowden.

Među kvadrilijunima bajtova podataka nalaze se osjetljive informacije o najmanje četvrt milijuna trenutnih ili bivših osumnjičenika za terorizam i teške zločine, kao i mnoštvu drugih ljudi s kojima su oni došli u kontakt. Nacionalne policije podatke su skupljale unutar prethodnih šest godina u serijama ispisa podataka od nepoznatih brojeva u kriminalističkim istragama.

Nadzorno tijelo je naredilo Europolu da obriše podatke koje drže dulje od šest mjeseci i dalo mu rok od godinu dana da organizira podatke koje zakonski mogu zadržati. Time su se na suprotstavljenim stranama našli europsko tijelo za zaštitu podataka i moćna sigurnosna agencija koja se priprema da postane centar korištenja umjetne inteligencije u policijskim poslovima.

Presuda je također ogolila duboke političke podjele među europskim političarima po pitanju kompromisa između sigurnosti i privatnosti. Ishod ovih sukoba imat će posljedice na budućnost privatnosti u Europi, ali i šire, prenosi N1.

Europska povjerenica za unutarnje poslove, Ylva Johansson, branila je Europol.

“Policijska tijela trebaju alate, resurse i vrijeme da analiziraju podatke koji su im po zakonu poslani,” rekla je. “U Europi, Europol je platforma koja podržava nacionalne policije u ovom ogromnom zadatku.”

Povjerenstvo za unutarnje poslove kaže da zabrinutosti koje je iznio EDPS “predstavljaju ozbiljan izazov” za sposobnost Europola da izvršava svoje dužnosti. Prošle godine Povjerenstvo je predložilo ogromne promjene u regulacijama kojima bi se ojačale ovlasti Europola. Ako se te promjene izglasaju, njima bi se moglo legalizirati čuvanje podataka za potrebe testiranja novih alata umjetne inteligencije.

Europol negira da je učinio išta pogrešno, rekavši da nadzorno tijelo možda interpretira trenutna pravila na nepraktičan način: “Regulacija Europola nije osmišljena od strane legislatora kao nužnost koju je nemoguće ispuniti u praksi.”

“Europol je s EDPS-om surađivao da bi se pronašao balans između sigurnosti EU i njenih građana i pridržavanja najviših standarda privatnosti podataka,” rekli su iz agencije.

Osnovan kao tijelo za koordinaciju nacionalnih policijskih snaga u EU sa sjedištem u Den Haagu, neke zemlje članice Europol predstavljaju kao rješenje pitanja borbe protiv terorizma nakon napada na Bataclan 2015.

U teoriji, Europol je podvrgnut oštrim regulacijama po pitanju vrste podataka koje smije čuvati, kao i koliko dugo. Podatke koje dobivaju moraju jasno kategorizirati i procesuirati i čuvati samo ako su potencijalno relevantni za prioritetne poslove kao što je borba protiv terorizma. Ipak, potpuni sadržaj njihovih baza još uvijek je nepoznat, dijelom i zbog neuređenog načina na koji je Europol upravljao podacima, kako je saznao EDPS.

Europska policijska agencija Europol morat će obrisati veliku većinu ogromne baze osobnih podataka koje je, zaključilo je nadzorno tijelo EU-a, nezakonito prikupila. Dosad neviđena otkrića Europskog supervizora za zaštitu podataka (EDPS) tiču se milijarda informacija.

Osjetljive informacije u “velikoj škrinji podataka”, kako ju nazivaju stručnjaci za privatnost, dolaze od izvještaja o zločinima, hakirani su od telefonskih usluga pod enkripcijom i dobiveni od tražitelja azila koji nikada nisu bili povezani ni s kakvim zločinima, prenosi Guardian.
