stdClass Object ( [id] => 226492 [title] => Giovanelliju ukinut pritvor, branit će se sa slobode [alias] => giovanelliju-ukinut-pritvor-branit-ce-se-sa-slobode [catid] => 243 [published] => 1 [introtext] => [fulltext] => Nakon tjedan dana ukinut je tzv. disciplinski pritvor nad Nikšom Giovanellijem (60), bivšim predsjednikom Uprave "Jadroplova", koji je završio u ćeliji na Bilicama zbog nedolaska na suđenje na Općinskom sudu u Splitu.

Postupak se vodi nad Giovanellijem i Ratkom Božićem (60),  bivšim tehničkim menadžerom "Jadroplova" zbog 3,3 milijuna dolara koje su uzeli od osiguravajućeg društva "Croatia osiguranje" na ime odštetnih zahtjeva za kvarove na motornim brodovima koje uopće nisu nastupile ili je bila puno manja.

Optužnica je podignuta 2000. godine, a od tada je već dio kaznenih predmeta pao u zastaru. Tijekom protekle tri godine zakazana je i odgađana rasprava deset puta, najčešće zbog izostanka optuženog Giovanellija.

Na posljednjem ročištu je Općinsko državno odvjetništvo u Splitu zatražilo pritvor za njega zbog odugovlačenja postupka. Izavnarspavno vijeće Općinskog suda u Splitu suglasilo se s njihovim mišljenjem i  odredilo pritvor početkom prošlog tjedna.

Nakon toga se  Giovanelli sam prijavio splitskoj policiji te je odveden u pritvor.

- Radilo se o pritvoru koji može trajati do 30 dana. Prije nego li je otišao na policiju prošle srijede, moj klijent se javio i sudu uz obećanje kako će ubuduće dolaziti na rasprave. Kada je određeno da se rasprava nastavi početkom ožujka, predložio sam sudu da se ukine pritvor jer je moj klijent dolaskom na sud i dobrovoljnim odlaskom na policiju pokazao će ubuduće bit redovito na ročištima - kazao nam je odvjetnik Vinko Gulišija koji zastupa Giovanellija.

Prijedlog odvjetnika Gulištije je prihvaćen te će se njegov klijent nadalje braniti sa slobode.

Giovanelli i Božić terete se za zlouporabu ovlasti u gospodarskom poslovanju u razdoblju od lipnja 1994. do ožujka 1997. godine.

Njih dvojica su u tom razdoblju osiguravajućoj kući podnosili odštetne zahtjeve za naknadu štete na brodovima poduzeća "Jadroplov", iako štete uopće nije ni bilo ili je nastupila u manjem opsegu, navodi optužnica. Tim zahtjevima za isplatu prilagali su fiktivne, u većini slučajeva krivotvorene račune domaćih i stranih tvrtki za izvršene popravke i ugrađene dijelove.

Postupak se vodi nad Giovanellijem i Ratkom Božićem (60),  bivšim tehničkim menadžerom "Jadroplova" zbog 3,3 milijuna dolara koje su uzeli od osiguravajućeg društva "Croatia osiguranje" na ime odštetnih zahtjeva za kvarove na motornim brodovima koje uopće nisu nastupile ili je bila puno manja.

Optužnica je podignuta 2000. godine, a od tada je već dio kaznenih predmeta pao u zastaru. Tijekom protekle tri godine zakazana je i odgađana rasprava deset puta, najčešće zbog izostanka optuženog Giovanellija.

Na posljednjem ročištu je Općinsko državno odvjetništvo u Splitu zatražilo pritvor za njega zbog odugovlačenja postupka. Izavnarspavno vijeće Općinskog suda u Splitu suglasilo se s njihovim mišljenjem i  odredilo pritvor početkom prošlog tjedna.

Nakon toga se  Giovanelli sam prijavio splitskoj policiji te je odveden u pritvor.

- Radilo se o pritvoru koji može trajati do 30 dana. Prije nego li je otišao na policiju prošle srijede, moj klijent se javio i sudu uz obećanje kako će ubuduće dolaziti na rasprave. Kada je određeno da se rasprava nastavi početkom ožujka, predložio sam sudu da se ukine pritvor jer je moj klijent dolaskom na sud i dobrovoljnim odlaskom na policiju pokazao će ubuduće bit redovito na ročištima - kazao nam je odvjetnik Vinko Gulišija koji zastupa Giovanellija.

Prijedlog odvjetnika Gulištije je prihvaćen te će se njegov klijent nadalje braniti sa slobode.

Giovanelli i Božić terete se za zlouporabu ovlasti u gospodarskom poslovanju u razdoblju od lipnja 1994. do ožujka 1997. godine.

Njih dvojica su u tom razdoblju osiguravajućoj kući podnosili odštetne zahtjeve za naknadu štete na brodovima poduzeća "Jadroplov", iako štete uopće nije ni bilo ili je nastupila u manjem opsegu, navodi optužnica. Tim zahtjevima za isplatu prilagali su fiktivne, u većini slučajeva krivotvorene račune domaćih i stranih tvrtki za izvršene popravke i ugrađene dijelove.
