Zbog poduzeća čiji je temeljni kapital 10 kuna (1,33 eura) država gubi milijune neplaćenog poreza. Riječ je o jednostavnim društvima s ograničenom odgovornošću (j.d.o.o.), poduzećima koji uglavnom posluju nekoliko godina, ne plate porez niti podnesu financijska izvješća da bi se na kraju naprasno ugasila.

Ovakva poduzeća počela su se osnivati prije desetak godina s ciljem lakšeg ulaska u svijet biznisa mladim ljudima ali i svima onima koji su imali poslovne ideje a bili su bez novca za temeljni ulog. Zakonodavcu koji je ovakvo nešto omogućio ni na kraju pameti nije bilo da će jednostavna dionička društva biti poligoni za varanje države na neplaćenom porezu.

Naime, u prvoj godini poslovanja ove firme oslobođene su PDV-a, ali ga moraju platiti u drugoj i daljnjim godinama rada ako ne ugase djelatnost. Jednostavna dionička društva uz hrvatske državljane često otvaraju i stranci koji nakon što se otkrije da nisu platili porez a radili su i izdavali račune nisu dostupni hrvatskom pravosuđu.

Najnoviji primjer takvog varanja države je slučaj iz Metkovića kada je firma za trgovinu mobitelima i elektroničkom opremom čiji je osnivač za ulog od deset kuna bio stranac, državljanin BiH iz Prijedora državi ostala dužna 357.000 eura poreza.

Policija sumnjiči državljanina Bosne i Hercegovine u dobi od 65 godina za kazneno djelo utaje poreza ili carine i kazneno djelo povrede obveze vođenja trgovačkih i poslovnih knjiga.

Naime, kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni 65-godišnjak, kao vlasnik i odgovorna osoba trgovačkog društva čije je sjedište u Metkoviću, a djelatnost prodaja tehničke opreme, od početka do kraja 2020. godine, s ciljem potpunog izbjegavanja obveze plaćanja poreza na dobit i PDV-a, nadležnoj poreznoj upravi nije podnosio prijavu PDV-a i poreza na dobit, odnosno nije iskazivao oporezive isporuke temeljem 68 izlaznih računa izdanih raznim trgovačkim društvima u ukupnom iznosu od 971.000 eura bez PDV-a, čime je prikrio obvezu obračuna i plaćanja PDV-a u iznosu od 241.000 eura i poreza na dobit u iznosu od 115.000 eura. Na opisane načine osumnjičeni je utajio 357.000 eura poreza.

Kriminalističkim istraživanjem je također utvrđeno kako osumnjičeni 65-godišnjak, kao direktor trgovačkog društva, poslovne knjige nije vodio na propisani način, čime je počinio kazneno djelo povrede obveze vođenja poslovnih i trgovačkih knjiga.

Prema podacima iz sudskog registra, najviše jednostavnih dioničkih društava registrirano je za djelatnost trgovine, zatim slijede različite usluge a tek sporadično prerađivačka djelatnost. Osumnjičena tvrtka za utaju poreza iz Metkovića uz trgovinu mobitelima od 2018 godine bila je registrirana i za trgovinu žitaricama, sirovim duhanom, sjemenjem i stočnom hranom a kako nije plaćala porez niti podnosila financijska izvješća o svom poslovanju našla se na meti istražitelja i poreznika.

Poduzeće u Metkoviću samo je jedno od mnogih registriranih samo za jednokratne transakcije i izbjegavanje poreza. Trgovački sud u Dubrovniku u prošloj je godini pokrenuo postupak brisanja tridesetak jednostavnih trgovačkih društava iz sudskih registara jer tri godine nisu objavili financijska izvješća o svom poslovanju.

Zbog poduzeća čiji je temeljni kapital 10 kuna (1,33 eura) država gubi milijune neplaćenog poreza. Riječ je o jednostavnim društvima s ograničenom odgovornošću (j.d.o.o.), poduzećima koji uglavnom posluju nekoliko godina, ne plate porez niti podnesu financijska izvješća da bi se na kraju naprasno ugasila.

Ovakva poduzeća počela su se osnivati prije desetak godina s ciljem lakšeg ulaska u svijet biznisa mladim ljudima ali i svima onima koji su imali poslovne ideje a bili su bez novca za temeljni ulog. Zakonodavcu koji je ovakvo nešto omogućio ni na kraju pameti nije bilo da će jednostavna dionička društva biti poligoni za varanje države na neplaćenom porezu.

Naime, u prvoj godini poslovanja ove firme oslobođene su PDV-a, ali ga moraju platiti u drugoj i daljnjim godinama rada ako ne ugase djelatnost. Jednostavna dionička društva uz hrvatske državljane često otvaraju i stranci koji nakon što se otkrije da nisu platili porez a radili su i izdavali račune nisu dostupni hrvatskom pravosuđu.

Najnoviji primjer takvog varanja države je slučaj iz Metkovića kada je firma za trgovinu mobitelima i elektroničkom opremom čiji je osnivač za ulog od deset kuna bio stranac, državljanin BiH iz Prijedora državi ostala dužna 357.000 eura poreza.

Policija sumnjiči državljanina Bosne i Hercegovine u dobi od 65 godina za kazneno djelo utaje poreza ili carine i kazneno djelo povrede obveze vođenja trgovačkih i poslovnih knjiga.

Naime, kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni 65-godišnjak, kao vlasnik i odgovorna osoba trgovačkog društva čije je sjedište u Metkoviću, a djelatnost prodaja tehničke opreme, od početka do kraja 2020. godine, s ciljem potpunog izbjegavanja obveze plaćanja poreza na dobit i PDV-a, nadležnoj poreznoj upravi nije podnosio prijavu PDV-a i poreza na dobit, odnosno nije iskazivao oporezive isporuke temeljem 68 izlaznih računa izdanih raznim trgovačkim društvima u ukupnom iznosu od 971.000 eura bez PDV-a, čime je prikrio obvezu obračuna i plaćanja PDV-a u iznosu od 241.000 eura i poreza na dobit u iznosu od 115.000 eura. Na opisane načine osumnjičeni je utajio 357.000 eura poreza.

Kriminalističkim istraživanjem je također utvrđeno kako osumnjičeni 65-godišnjak, kao direktor trgovačkog društva, poslovne knjige nije vodio na propisani način, čime je počinio kazneno djelo povrede obveze vođenja poslovnih i trgovačkih knjiga.

Prema podacima iz sudskog registra, najviše jednostavnih dioničkih društava registrirano je za djelatnost trgovine, zatim slijede različite usluge a tek sporadično prerađivačka djelatnost. Osumnjičena tvrtka za utaju poreza iz Metkovića uz trgovinu mobitelima od 2018 godine bila je registrirana i za trgovinu žitaricama, sirovim duhanom, sjemenjem i stočnom hranom a kako nije plaćala porez niti podnosila financijska izvješća o svom poslovanju našla se na meti istražitelja i poreznika.

Poduzeće u Metkoviću samo je jedno od mnogih registriranih samo za jednokratne transakcije i izbjegavanje poreza. Trgovački sud u Dubrovniku u prošloj je godini pokrenuo postupak brisanja tridesetak jednostavnih trgovačkih društava iz sudskih registara jer tri godine nisu objavili financijska izvješća o svom poslovanju.

Muškarac iz Bosne i Hercegovine u Metkoviću otvorio firmu za deset kuna pa prevario državu za 375.000 eura

Zbog poduzeća čiji je temeljni kapital 10 kuna (1,33 eura) država gubi milijune neplaćenog poreza. Riječ je o jednostavnim društvima s ograničenom odgovornošću (j.d.o.o.), poduzećima koji uglavnom posluju nekoliko godina, ne plate porez niti podnesu financijska izvješća da bi se na kraju naprasno ugasila.

Ovakva poduzeća počela su se osnivati prije desetak godina s ciljem lakšeg ulaska u svijet biznisa mladim ljudima ali i svima onima koji su imali poslovne ideje a bili su bez novca za temeljni ulog. Zakonodavcu koji je ovakvo nešto omogućio ni na kraju pameti nije bilo da će jednostavna dionička društva biti poligoni za varanje države na neplaćenom porezu.

Naime, u prvoj godini poslovanja ove firme oslobođene su PDV-a, ali ga moraju platiti u drugoj i daljnjim godin...
