Etičko vijeće Vrhovnog suda utvrdilo je da su petorica splitskih sudaca povrijedili Kodeks sudačke etike zbog prisustvovanja proslavi za vrijeme trajanja epidemioloških mjera u kaštelanskoj konobi Željka Keruma za koju je postojala zabrana rada.

Kodeks sudske časti povrijedili su predsjednik Županijskog suda u Splitu Bruno Klein, glasnogovornik splitskog Županijskog suda Dinko Mešin, sudac istog suda Miho Mratović, sudac splitskog Općinskog suda Tomislav Zlodre i sudac splitskog Upravnog suda Silvio Čović, priopćio je najviši sud navodeći samo funkcije tih sudaca.

Najviši sud je podsjetio da je Sudačko vijeće splitskog Županijskog suda za Kleina, Mešina, Mratovića i Zlodru odlučilo kako pritužba predsjednika Vrhovnog suda Đure Sesse nije osnovana i da nisu utvrđene povrede Kodeksa sudačke etike u ponašanju tih sudaca. 

No, dodaje najviši sud, Etičko vijeće je usvojilo prigovore i promijenilo odluke Sudačkog vijeća splitskog Županijskog suda.

Vrhovni sud je izvijestio i da je Etičko vijeće najvišeg suda odbilo prigovor suca Čovića, za kojeg je odlukom Sudačkog vijeća Visokog upravnog suda utvrđeno da je povrijedio Kodeks sudačke etike.

Najviši sud je precizirao da su suci prisustvovali proslavi za vrijeme trajanja epidemioloških mjera u ugostiteljskom objektu za koji je postojala zabrana rada te da je bilo prisutno više od deset osoba i to iz više od dva kućanstva. Suci su takvim ponašanjem prekršili epidemiološke mjere propisane tada važećom odlukom Stožera civilne zaštite RH, ističe najviši sud.

Vrhovni sud je pojasnio  da je tada važeća odluka Stožera civilne zaštite propisala epidemiološke mjere donesene zbog svjetske zdravstvene krize koja je, zahvativši cijeli svijet, ugrozila brojne živote. Sud je dodao i da je takva situacija bez presedana.

Pridržavanje mjera zahtjevalo se od svih

''Od svih građana zahtijevalo se da se pridržavaju epidemioloških mjera pod prijetnjom sankcija. Zbog toga su se građani suzdržavali od okupljanja u životno važnijim okolnostima od objedovanja s kolegama, neovisno o povodu okupljanja. Te su mjere građani trebali poštivati ma koliko im to bilo tegobno. U takvoj se situaciji osobito od sudaca očekivalo da poštuju epidemiološke mjere'', smatra Vrhovni sud.

Najviši sud je dodao da se na argumente sudaca da su ''iz pristojnosti'' ostali na proslavi može odgovoriti da bi time postupili prema propisu jer bi odlaskom s okupljanja izbjegli kršenje epidemioloških mjera.

''Građani koji su iste mjere poštivali odricali su se, primjerice, prisustvovanju pogrebima najdražih osoba, njihovim vjenčanjima i drugim važnim događajima, a odgađali su i vjenčanja. Mnogi građani su pridržavajući se epidemioloških mjera imali značajne ekonomske gubitke zbog ograničenja u poslovanju'', prisnažio je Vrhovni sud.

Sud je nadodao da su suci povrijedili Kodeks sudačke časti koji propisuje da je dužan obnašanjem sudačke dužnosti i aktivnostima izvan suda razvijati standarde ponašanja koji pridonose očuvanju ugleda i dostojanstva suda i sudačkog poziva.

''Sudac mora izbjegavati svako ponašanje koje je nedostojno i koje stvara dojam nedoličnosti sudačkom položaju, prihvaćajući i ona ograničenja koja bi se drugim građanima činila opterećujućima. Ponašanje suca mora biti primjereno i primjerno - služiti kao dobar primjer svima'', zaključio je sud utvrdivši da povreda Kodeksa sudačke etike ne predstavlja pretjeranu i neprihvatljivu strogoću u ocjeni ponašanja sudaca.

Splitska policija prijavila je sredinom veljače petoricu sudaca koji su 23. siječnja prisustvovali rođendanskoj proslavi bivšeg nogometaša Ivice Mornara u Kerumovoj kaštelanskoj konobi Pršut. Suci su prekršajno prijavljeni jer nisu nosili maske, dok su Mornar i Kerum prijavljeni i zbog organiziranja okupljanja.

Etičko vijeće Vrhovnog suda utvrdilo je da su petorica splitskih sudaca povrijedili Kodeks sudačke etike zbog prisustvovanja proslavi za vrijeme trajanja epidemioloških mjera u kaštelanskoj konobi Željka Keruma za koju je postojala zabrana rada.

Kodeks sudske časti povrijedili su predsjednik Županijskog suda u Splitu Bruno Klein, glasnogovornik splitskog Županijskog suda Dinko Mešin, sudac istog suda Miho Mratović, sudac splitskog Općinskog suda Tomislav Zlodre i sudac splitskog Upravnog suda Silvio Čović, priopćio je najviši sud navodeći samo funkcije tih sudaca.

Najviši sud je podsjetio da je Sudačko vijeće splitskog Županijskog suda za Kleina, Mešina, Mratovića i Zlodru odlučilo kako pritužba predsjednika Vrhovnog suda Đure Sesse nije osnovana i da nisu utvrđene povrede Kodeksa sudačke etike u ponašanju tih sudaca. 

No, dodaje najviši sud, Etičko vijeće je usvojilo prigovore i promijenilo odluke Sudačkog vijeća splitskog Županijskog suda.

Vrhovni sud je izvijestio i da je Etičko vijeće najvišeg suda odbilo prigovor suca Čovića, za kojeg je odlukom Sudačkog vijeća Visokog upravnog suda utvrđeno da je povrijedio Kodeks sudačke etike.

Najviši sud je precizirao da su suci prisustvovali proslavi za vrijeme trajanja epidemioloških mjera u ugostiteljskom objektu za koji je postojala zabrana rada te da je bilo prisutno više od deset osoba i to iz više od dva kućanstva. Suci su takvim ponašanjem prekršili epidemiološke mjere propisane tada važećom odlukom Stožera civilne zaštite RH, ističe najviši sud.

Vrhovni sud je pojasnio  da je tada važeća odluka Stožera civilne zaštite propisala epidemiološke mjere donesene zbog svjetske zdravstvene krize koja je, zahvativši cijeli svijet, ugrozila brojne živote. Sud je dodao i da je takva situacija bez presedana.

Pridržavanje mjera zahtjevalo se od svih

''Od svih građana zahtijevalo se da se pridržavaju epidemioloških mjera pod prijetnjom sankcija. Zbog toga su se građani suzdržavali od okupljanja u životno važnijim okolnostima od objedovanja s kolegama, neovisno o povodu okupljanja. Te su mjere građani trebali poštivati ma koliko im to bilo tegobno. U takvoj se situaciji osobito od sudaca očekivalo da poštuju epidemiološke mjere'', smatra Vrhovni sud.

Najviši sud je dodao da se na argumente sudaca da su ''iz pristojnosti'' ostali na proslavi može odgovoriti da bi time postupili prema propisu jer bi odlaskom s okupljanja izbjegli kršenje epidemioloških mjera.

''Građani koji su iste mjere poštivali odricali su se, primjerice, prisustvovanju pogrebima najdražih osoba, njihovim vjenčanjima i drugim važnim događajima, a odgađali su i vjenčanja. Mnogi građani su pridržavajući se epidemioloških mjera imali značajne ekonomske gubitke zbog ograničenja u poslovanju'', prisnažio je Vrhovni sud.

Sud je nadodao da su suci povrijedili Kodeks sudačke časti koji propisuje da je dužan obnašanjem sudačke dužnosti i aktivnostima izvan suda razvijati standarde ponašanja koji pridonose očuvanju ugleda i dostojanstva suda i sudačkog poziva.

''Sudac mora izbjegavati svako ponašanje koje je nedostojno i koje stvara dojam nedoličnosti sudačkom položaju, prihvaćajući i ona ograničenja koja bi se drugim građanima činila opterećujućima. Ponašanje suca mora biti primjereno i primjerno - služiti kao dobar primjer svima'', zaključio je sud utvrdivši da povreda Kodeksa sudačke etike ne predstavlja pretjeranu i neprihvatljivu strogoću u ocjeni ponašanja sudaca.

Splitska policija prijavila je sredinom veljače petoricu sudaca koji su 23. siječnja prisustvovali rođendanskoj proslavi bivšeg nogometaša Ivice Mornara u Kerumovoj kaštelanskoj konobi Pršut. Suci su prekršajno prijavljeni jer nisu nosili maske, dok su Mornar i Kerum prijavljeni i zbog organiziranja okupljanja.
